With the arrival of Ramadan, the first week of the blessed month can be difficult in terms of adjusting to a different eating and sleeping schedule. Most Muslims manage to be back on track by the second week. For others, it may take longer or it may be more difficult.

At work, this can raise questions about productivity and concentration. If you feel it is helpful, inform your boss before Ramadan begins about the coming changes. Every employer is different, and while many, if not most, are very understanding and make allowances for Muslim employees, others may use it as an excuse for discrimination. 

If you feel your boss or supervisor is someone who will understand your situation, then consider sending this sample letter to them before Ramadan begins. You can adjust the letter according to your needs.

You have always been a supportive boss, and I appreciate everything you have done for me. I also like the fact that there is a culture of respect for employees at  (NAME OF YOUR COMPANY). 

This is why I wanted to let you know about the upcoming month of Ramadan, a month of fasting for Muslims all around the world. This year, it is expected to begin on Tuesday March 12. Muslims are required to fast during this month. This entails avoiding all food and drink between dawn and sunset each day for 29 or 30 days.

Despite the physical challenges, Ramadan is a time of joy, spiritual fulfillment, generosity, and greater God-consciousness for Muslims. 

I have fasted for over a decade, even during work hours at (NAME OF YOUR COMPANY). Although this has not affected my productivity on the job, it has not been easy.  With this in mind, I would like to suggest three things that can help make Ramadan at (NAME OF YOUR COMPANY) easier this year for myself and other Muslim employees:  

  • Giving fasting employees the option to come in earlier and leave earlier. Or arriving and leaving a little later.
  • Setting aside an empty room where employees can pray and/or take a short nap during lunch break.
  • Scheduling work meetings in the late morning or later in the afternoon (e.g. 3 pm or afterward), when employees tend to be less tired.

TABLE OF CONTENTS

The law on malaysian public holidays, which public holidays should the organization observe, what about holidays declared at short notice, what if the employee can’t get the day off, manage leave and public holidays with briohr.

We in Malaysia are ‘blessed’ with a bounty of public holidays. Depending on the state, organizations can observe anywhere from 21 to 25 days of public holiday per year.

And that’s not counting the holidays that are declared by the federal and state governments, such as the recent holidays for the 2023 state elections . Furthermore, it’s not uncommon for such holidays to be announced at short notice. Such holidays are known as ‘ cuti peristiwa ’ or ‘occasional holidays’.

As the public holidays in Malaysia can get confusing, we present to you this guide on when and how Malaysian public holidays work.

Two main Acts affect which public holidays employees may take:

  • Employment Act 1955.
  • Holidays Act 1951.

Holidays in the Employment Act

Section 60D of the Employment Act 1955 defines which holidays employees are entitled to.

  • (i) the National Day;
  • (ii) the Birthday of the Yang di-Pertuan Agong;
  • (iii) the Birthday of the Ruler or the Yang di-Pertua Negeri, as the case may be, of the State in which the employee wholly or mainly works under his contract of service, or the Federal Territory Day, if the employee wholly or mainly works in the Federal Territory;
  • (iv) the Workers’ Day; and
  • (v) Malaysia Day; and
  • (b) on any day appointed as a public holiday for that particular year under section 8 of the Holidays Act 1951.

Holidays in the Holidays Act

Sections 8 and 9 of the Holidays Act 1951 define how cuti peristiwa or occasional holidays are declared.

  • The Minister may, by notification in the Gazette or in such other manner as he thinks fit, appoint, in respect of Peninsular Malaysia, or the Federal Territory or, after consultation with the State Authority, in respect of a State, a day to be observed as a public holiday or a bank holiday in addition to, or in substitution for, any of the days mentioned in the Schedules and thereupon this Act shall, in Peninsular Malaysia, or in the Federal Territory, or in the State in respect of which a day is appointed to be observed as a holiday as aforesaid, be applicable to such day in the same manner as if the said day had been mentioned in the First Schedule or the Second Schedule, as the case may be.
  • (1) The State Authority may, by notification in the Gazette or in such other manner as it thinks fit, appoint a day to be observed as a State public holiday in any such State, and such day shall, except as hereinafter provided, be observed in such State as a public holiday.
  • (2) The Minister may, by notification in the Gazette, or in such other manner as he thinks fit, appoint a day to be observed as a Federal Territory public holiday in the Federal Territory, and such day shall, except as hereinafter provided, be observed in the Federal Territory as a public holiday.

This is governed by Section 60D of the Employment Act 1955 as shown above. 

As a minimum, companies should observe 11 days of public holidays. The five compulsory holidays include:

  • National Day (31 August)
  • Birthday of the Yang di-Pertuan Agong (first Monday of June)
  • Birthday of the Ruler or the Yang di-Pertua Negeri or the Federal Territory Day (varies by state, 1 February for Federal Territory Day)
  • Workers’ Day (1 May)
  • Malaysia Day (16 September)

*Dates are as of 2023.

In addition, the company needs to observe six more public holidays chosen by the company. These can be any combination of national and state holidays as defined by the Government . 

Despite this, many companies choose to observe all public holidays, as do schools and the Malaysian civil service. This way, it makes administrative matters easier.

Whether the company chooses to observe the minimum amount of public holidays or all holidays, it should be spelled out in the company policy, employee handbook, or employment contract.

This is what every employer dreads – holidays declared a day or two prior by either the Federal or State Governments.

For Malaysia-wide public holidays declared under section 8 of the Holidays Act 1951, it is compulsory for the company to observe it, regardless of their public holiday observance policy. An example of this would be the additional holiday declared by the Government in conjunction with Hari Raya Aidilfitri earlier this year .

As for state holidays declared under section 9:

  • Companies that observe the minimum 11 days of public holiday do not need to observe it.
  • Companies that observe all public holidays will need to observe it.

An example of a section 9 holiday would be the holidays declared due to the 2023 state elections held in Selangor, Negeri Sembilan, Kedah, Kelantan, and Terengganu.

In case employees can’t get the day off for compulsory holidays declared on short notice, employers have three options:

  • Replace the public holiday on another day as determined by the company.
  • Give the employee an additional day of annual leave.
  • Pay the employee overtime pay at public holiday rates.

However, for public holidays declared for the purposes of a general or state election, employers must still give employees reasonable time off from work to cast their vote. Otherwise, the employer will be in breach of section 25 of the Election Offences Act 1954 .

How to maximise your annual paid leave and public holidays in 2022?

Malaysians love public holidays and 2022 happens to be a bonanza.

Malaysia is blessed. Thanks to the unique social fabric, woven by people of various ethnicities and religions, there is always a cultural festival to celebrate. Hari Raya Aidilfitri, Chinese New Year, Deepavali, Hari Raya Haji, Christmas and so on, every prominent day is commensurate with a public holiday. If it isn’t falling in the current month, it’s the following. There is always a reason to look forward to and we need not cast our gaze afar. Office workers practically live for public holidays, while entrepreneurs footing the paid time-off understandably don’t share the same enthusiasm.

By law, as enshrined in the Employment Act , an employee is entitled to annual paid leave of 8 days, rising to 16 days in accordance to the duration of one’s employment. However, it is customary for employers to offer 16 days minimum to new recruits. Some financial institutions go a step further by promising in excess of 20 days and allowing replacement leave for public holidays that coincide with Saturdays.  

If you play your card right, you can really stretch your paid leave to the span of a month, if not more. Work and life have never been so balanced. 

How to plan your paid leave around Malaysian public holidays in 2022? 

1 january 2022, saturday, new year’s day  .

National except Johor, Kedah, Kelantan, Perlis and Terengganu 

It’s a forfeit and there’s nothing you can do about it. 

18 January 2022, Tuesday, Thaipusam 

Limited to Johor, Kuala Lumpur, Negeri Sembilan, Penang, Perak, Putrajaya and Selangor 

Easy, take Monday off for a 4-day weekend. 

1 February 2022, Tuesday, Chinese New Year  

National 

2 February 2022, Wednesday, Chinese New Year 

With the Federal Territory Day falling on the first day of Chinese New Year, KL-lites are losing out. However, you can salvage it somewhat by not clocking in on Monday for a 5-day weekend, or take the whole week off, going on a 9-day see-you-later, consuming only 3 days of your annual leave by doing so. 

19 April 2022, Tuesday, Nuzul Al-Quran 

National except Johor, Kedah, Melaka, Negeri Sembilan, Sabah and Sarawak 

Call off Monday for an extra-long weekend amounting to 4 days. 

1 May 2022, Sunday, Labour Day 

3 may 2022, tuesday, hari raya aidilfitri , 4 may 2022, wednesday, hari raya aidilfitri .

Despite falling on Sunday, employees are compensated with a mandatory replacement the immediate Monday. Factoring in 2 days of Hari Raya Aidilfitri, that amounts to a 5-day weekend. I would suggest that you take the preceding Friday, the immediate Thursday, Friday and the following Monday off, so you can enjoy a 11-day holiday, plus to avoid the crowds on both weekends. 

15 May 2022, Sunday, Wesak

If you haven’t known yet, the immediate Monday would be a public holiday. So that’s a 3-day weekend. 

6 June 2022, Monday, Yang di-Pertuan Agong’s Birthday 

Thanks to the King, a 3-day weekend beckons. 

10 July 2022, Sunday, Hari Raya Haji 

A 3-day weekend for all, unless you work in Johor.  

30 July 2022, Saturday, Awal Muharram 

A public holiday falling on Saturday isn’t replaceable unless your employment contract states otherwise. 

31 August 2022, Wednesday, Merdeka Day 

Here’s a difficult choice to make: Should you go on leave the preceding Monday and Tuesday or the immediate Thursday and Friday, for a 5-day weekend? If you are undecided but still have plenty of paid leave in reserve, why not roll it into a 9-day holiday? 

16 September 2022, Friday, Malaysia Day  

A 3-day weekend, but you can make it even better, no? 

9 October 2022, Sunday, Prophet Muhammad’s Birthday  

The immediate Monday is a public holiday for all, except if your workplace is located in Johor, Kedah, Kelantan and Terengganu. 

24 October 2022, Monday, Deepavali

National except Sarawak 

A 3-day weekend ends on a high note with the festival of lights falling on Monday. You could take Tuesday off too for an extra-long weekend. 

11 December 2022, Sunday, Sultan of Selangor’s Birthday 

Selangor 

With the Sultan’s birthday falling on Sunday, which is then replaced on the immediate Monday, workers in Selangor are presented with a long weekend. As December is a month typified by workers clearing their annual leave allowance, you might want to consider adding a couple of days onto the existing 3-day weekend. 

25 December 2022, Sunday, Christmas 

Workers nationwide, excluding those in Johor, Kedah, Kelantan and Terengganu, get a replacement holiday on Monday. You should also be aware that New Year’s Day 2023 falls on Sunday, which is then substituted with a public holiday on Monday. If you still have sufficient annual leave leftover, now’s the time to go all in with an extended holiday from 24 December 2022 till 2 January 2023.

  • Annual Leave Application:  A planned time off that can be accrued over a particular year.
  • Sick Leave Application:  An application granted for medical appointments or health-related issues.
  • Vacation Leave Application:  This time off is similar to the annual leave application and can be used for relaxation and travel purposes.
  • Casual Leave Application:  A short or unplanned leave granted to employees for unforeseen or incidental reasons.
  • Emergency Leave Application:  A compassionate or urgent time off granted to address sudden or unforeseen family and personal emergencies.
  • Half-day Leave Application:  A type of   leave application for an office that grants the employee permission to be absent from work for half of the usual working hours in a day.

What to Include in an Office Leave Application Letter/Email?

Learning how to write a leave application begins with knowing the content that you must include in your letter or email. Therefore, what follows is my list of points that should definitely be included in your leave application for office.

  • Salutation:  Such an approach will usually include the name of an addressee whose name is written in your notice of leave.
  • Subject:  This section of the leave application should include the cause behind your request for leave and the date you filed for it.
  • Reason for Leave: I advise that you put across the necessary details so that your application for a leave grant while transiting from office receives the attention it deserves.
  • Work Plan: To assure peace of mind to customers, talk about your colleague who will look after all responsibilities when you are not there.
  • Closing Sentence: Give thanks to the said individual.
  • Name:  State your correct name.
  • Designation:  Tell about your exact job function in the company.
  • Date:  Cite the present date.

The mandatory types of leave listed below can be found in the act, and employers must obey them or expose the company to legal action. Give the act a read – but finish this guide first!

1. Paid annual leave

Paid annual leave is simply a way for employees to take a break and unwind while still receiving their monthly salary. Bosses may not like the sound of that, but the fact is it avoids burnout and slumps in productivity.

Legal entitlement to paid annual leave In Malaysia is as follows:

  • 8 days annually if employed between 1 – 2 years
  • 12 days annually if employed between 2 – 5 years
  • 16 days annually if employed for more than 5 years

If an employee has worked for less than 12 months, their annual leave will be proportional to the number of months in employment. For example, if Abu has been a cashier at a supermarket for six months, he is entitled to 4 days of paid annual leave.

Some additional notes:

  • It’s separate from rest days, holidays, and other types of leave.
  • If an employee is eligible to claim sick or maternity leave while on annual leave, their annual leave is considered unclaimed.
  • If an employee misses work for more than 10% of their working days in a year without cause, they forfeit their right to annual leave (though in a way, they’ve already taken it).
  • There is no legal obligation to carry unused annual leave forward.
  • There is no legally mandated notice period for annual leave – it’s up to the employer to set guidelines.

2. Paid sick leave

On account of pesky bacteria and whatnot, people tend to get sick. When your head feels like a kettle of boiling water and your nose leaks radioactive waste, spreadsheets are the last thing on your mind. We’re not showing a photo – too gross even for us.

That’s when you go to the doctor and claim paid sick leave.

Legal entitlement to paid sick leave (without hospitalisation) in Malaysi is as follows:

  • 14 days annually if employed for 1 – 2 years
  • 18 days annually if employed for 2 – 5 years
  • 22 days annually if employed for more than 5 years
  • Employees must get certified by a registered medical practitioner or dental surgeon (covered by the Dental Act 1971 ).
  • Employees must at least make an honest attempt to inform employers of their situation within 48 hours of needing to take sick leave.
  • Failing the above, the employee may be considered absent from work without just cause.

3. Hospitalisation leave

This is an extension of sick leave, but we think it’s significant enough to merit its own section.

Where hospitalisation is necessary, add 60 days to each of the paid sick leave categories above, which means:

74 days annually if employed for 1 – 2 years 78 days annually if employed for 2 – 5 years 82 days annually if employed for more than 5 years

4. Maternity leave

From time to time, your female employees will take Human Resources a little too literally and produce a tiny human being of their own. Woohoo – new future unpaid interns!

By law, they will be entitled to paid maternity leave if they meet the following two conditions:

  • they have worked for a total of at least 90 days in the nine months before childbirth, and
  • they have been employed within the four months before childbirth.

In Malaysia, the legal entitlement to maternity leave is 98 days .

  • It cannot start earlier than 30 days before the expected date of childbirth and cannot start later than the day after giving birth
  • If an employee chooses to begin maternity leave earlier than 30 days before her due date, those extra days won’t be counted as part of her official maternity leave.
  • A medical professional can decide that an employee should start her maternity leave within 14 days before her due date (this one is for the workaholics out there).

You may find versions of the Employment Act that mandate 60 days of maternity leave; those are outdated after an amendment was passed in 2022 . That same amendment is also the reason for the next entry.

5. Paternity leave

Thanks to the 2022 amendment to the Employment Act, fathers are entitled to 7 consecutive days of paid paternity leave, provided they are legally married to the mother of the child.

Every employee in Malaysia is entitled to eleven gazetted public holidays, with five specific holidays:

  • National Day,
  • Birthday of the Yang di-Pertuan Agong
  • Birthday of the Ruler of the State OR Federal Territory Day
  • Workers’ Day, and
  • Malaysia Day

The remaining six days can fall on any public holidays that year that are included in the Holidays Act 1951 .

  • If a public holiday falls on a rest day (such as a Sunday) or another public holiday, the day immediately after will be turned into a paid holiday as a substitute.
  • If an employee is on sick or annual leave during a public holiday, they are owed a replacement day.
  • If an employee is absent from work on the day immediately before or after a public holiday with no just cause, they forfeit the right to the paid holiday.

PUTRAJAYA: There will be increased Electric Train Service (ETS) frequency to northern parts of Peninsular Malaysia from April 4 to 15 to cater for expected demand during the Hari Raya Aidilfitri season, says Transport Minister Anthony Loke.

Loke said six additional services will be added daily for KL Sentral-Padang Besar and KL Sentral-Butterworth as well as two additional express lane services from KL Sentral-Ipoh.

“This will add 1,260 tickets daily for a total of 15,120 additional tickets for the 12 days.

“The total number of ETS tickets offered for the Hari Raya Aidilfitri celebration will be 135,000,” he said, adding that the additional tickets are available to purchase from 5pm on Friday (March 22).

“The public can purchase tickets through the KTMB mobile app, KITS (integrated ticketing system) or ticketing counters at any KTMB main stations,” he told a press conference at the Transport Ministry headquarters here.

For those travelling to the east coast for the festive season, Loke said KTMB is also offering two additional train services namely the Ekspres Lambaian Aidilfitri (ELA) which operates from KL Sentral to Tumpat station and vice versa.

A total of 952 tickets will be available from Friday evening for the special train service.

Loke said the special train service will cover 17 stations: KL Sentral, Bandar Tasik Selatan, Kajang, Seremban, Pulau Sebang, Gemas, Bahau, Mentakab, Jerantut, Kuala Lipis, Gua Musang, Dabong, Kuala Krai, Tanah Merah, Pasir Mas, Wakaf Bharu and Tumpat.

On bus services, he advised consumers to report any surcharge of more than 10% for the festive season to the Land Public Transport Agency (Apad).

“The surcharge is not new, it has been practised for 20 years during every festive season. It (is usually imposed) a week before and a week after the festive season.

“If we do not allow (bus operators) to impose the surcharge, they will not be able to increase capacity.

“Maybe with the surcharge, they are able to pay allowances to the drivers. But if they charge more than 10%, the passengers can report to Apad,” he said.

On March 13, Apad announced that express bus fare rates for the economy service category will increase by 10% from April 4 to 17.

The agency said the Cabinet had approved a festive season surcharge of RM0.009 per kilometre, and this would raise the fare rate for the respective express bus category to RM0.102/km, compared to the regular fare rate of RM0.093/km.
