Preparing Court Forms

Below is a possible list of forms you might need to start your divorce case. Consult the Superior Court of California County of San Diego - Dissolution Packet for more information.

  • SDSC D-049: Family Law Certificate of Assignment - Venue Declaration
  • FL-100: Petition for Dissolution of Marriage, Legal Separation, or Nullity of Marriage
  • FL-105/GC-120: Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) - Only if you have minor children
  • FL-110: Summons (Family Law)
  • FL-115: Proof of Service of Summons
  • FL-140: Declaration of Disclosure - To exchange with your spouse
  • FL-142: Schedule of Assets and Debts - To exchange with your spouse
  • FL-150: Income and Expense Declaration
  • FL-160: Property Declaration
  • FL-311: Child Custody and Visitation Application Attachment - Optional 

File and Serve Paperwork

Use the San Diego Superior Court's zip code directory to figure out where to file your paperwork. To file in San Diego County, you must live in the county for 3 months and the state of California for 6 months.

Once you determine the courthouse you will file, take your forms to the court clerk at the Family Law Business Office and pay the filing fee .

Serve Your Forms

The next step in the process is to "serve" your spouse or domestic partner with copies of all your court papers AND a blank response form ( FL-120 ). If you have minor children with your spouse, also include the following blank form FL-105/GC-120 .

Legally, the papers must be served by someone other than yourself who is 18 or older. Depending on how your spouse is served, the server will need to fill out one of the following forms, which you will then file with the court:

  • FL-117 - Notice and Acknowledgment of Receipt 
  • FL-330 - Proof of Personal Service 
  • FL-335 - Proof of Service by Mail

Summary Dissolution

Instead of the regular dissolution process, you may instead pursue a summary dissolution . This process is generally easier and faster than the typical process, but you do give up certain legal rights, such as the right to request a trial. 

You may qualify for a summary dissolution if you meet the following requirements:

  • You were married for less than 5 years before the date of separation,
  • You have no children with your spouse (born before or during the marriage),
  • You have no adopted children together,
  • Neither one of you is pregnant,
  • Neither of you own any land or buildings,
  • Your community property is not worth more than $45,000 (do not count cars in this total),
  • Neither of you have separate property worth more than $45,000 (do not count cars in this total), AND
  • The total of your debt owned together (other than cars) is $6,000 or less.
