Frequently asked questions

The act of putting someone else’s ideas or words into your own words is called paraphrasing, rephrasing, or rewording. Even though they are often used interchangeably, the terms can mean slightly different things:

Paraphrasing is restating someone else’s ideas or words in your own words while retaining their meaning. Paraphrasing changes sentence structure, word choice, and sentence length to convey the same meaning.

Rephrasing may involve more substantial changes to the original text, including changing the order of sentences or the overall structure of the text.

Rewording is changing individual words in a text without changing its meaning or structure, often using synonyms.

It can. One of the two methods of paraphrasing is called “Fluency.” This will improve the language and fix grammatical errors in the text you’re paraphrasing.

Paraphrasing and using a paraphrasing tool aren’t cheating. It’s a great tool for saving time and coming up with new ways to express yourself in writing.  However, always be sure to credit your sources. Avoid plagiarism.

If you don’t properly cite text paraphrased from another source, you’re plagiarizing. If you use someone else’s text and paraphrase it, you need to credit the original source. You can do that by using citations. There are different styles, like APA, MLA, Harvard, and Chicago. Find more information about citing sources here.

Paraphrasing without crediting the original author is a form of plagiarism , because you’re presenting someone else’s ideas as if they were your own.

However, paraphrasing is not plagiarism if you correctly cite the source . This means including an in-text citation and a full reference, formatted according to your required citation style .

As well as citing, make sure that any paraphrased text is completely rewritten in your own words.

Plagiarism means using someone else’s words or ideas and passing them off as your own. Paraphrasing means putting someone else’s ideas in your own words.

So when does paraphrasing count as plagiarism?

  • Paraphrasing is plagiarism if you don’t properly credit the original author.
  • Paraphrasing is plagiarism if your text is too close to the original wording (even if you cite the source). If you directly copy a sentence or phrase, you should quote it instead.
  • Paraphrasing  is not plagiarism if you put the author’s ideas completely in your own words and properly cite the source .

GPT Essay Checker for Students

How to Interpret the Result of AI Detection

To use our GPT checker, you won’t need to do any preparation work!

Take the 3 steps:

  • Copy and paste the text you want to be analyzed,
  • Click the button,
  • Follow the prompts to interpret the result.

Our AI detector doesn’t give a definitive answer. It’s only a free beta test that will be improved later. For now, it provides a preliminary conclusion and analyzes the provided text, implementing the color-coding system that you can see above the analysis.

It is you who decides whether the text is written by a human or AI:

  • Your text was likely generated by an AI if it is mostly red with some orange words. This means that the word choice of the whole document is nowhere near unique or unpredictable.
  • Your text looks unique and human-made if our GPT essay checker adds plenty of orange, green, and blue to the color palette.

🤖 Will AI Replace Human Writers?

đź”® gpt checker for essays: 5 key benefits.

People have yet to learn where AI and machine learning are taking us, but it has already caused many problems in the education system. This AI essay detector can resolve some of them, at least as of the moment.

There are 5 key benefits of the above GPT checker for essays and other academic writing projects.

Elon Musk, one of Chat GPT creators, said that it was “scary good” and that humanity is approaching the creation of “dangerously strong AI.”

In an interview , Bill Gates commented on the program: “It gives a glimpse of what is to come. I am impressed with this whole approach and the rate of innovation.” And these words give us goosebumps.

Over the first week of its functioning, the program exceeded 1 million users . Therefore, developers are interested in monetizing it, and launching a paid Beta-version won’t take long.

We prefer not to throw out compliments to the chatbot and instead let you check for yourself . It is a chat with AI. The best way to start is to ask a question. It is free so far (still under research), so you can ask as many questions as you please.

We should care about AI-generated content because, in a decade, it will be an everyday reality. Even more so, it is a hot-button issue now. For now, GPT 3 can’t replace human writers. However, AI essay detection has already become an issue for teachers.

You can try asking ChatGPT to write an essay for you. But we do not recommend pass it off as written by you. Not only because it's unethical (although it is). The fact is that ChatGPT has a number of drawbacks that you need to consider before using it.

Chat GPT in Essay Writing – the Shortcomings

  • The tool doesn’t know anything about what happened after 2021. Novel history is not its strong side. Sometimes it needs to be corrected about earlier events. For instance, request information about Heathrow Terminal 1 . The program will tell you it is functioning, although it has been closed since 2015.
  • The reliability of answers is questionable. AI takes information from the web which abounds in fake news, bias, and conspiracy theories.
  • References also need to be checked. The links that the tool generates are sometimes incorrect, and sometimes even fake.
  • Two AI generated essays on the same topic can be very similar. Although a plagiarism checker will likely consider the texts original, your teacher will easily see the same structure and arguments.
  • Chat GPT essay detectors are being actively developed now. Traditional plagiarism checkers are not good at finding texts made by ChatGPT. But this does not mean that an AI-generated piece cannot be detected at all.

🕵 How Do GPT Checkers Work?

An AI-generated text is too predictable. Its creation is based on the word frequency in each particular case.

Thus, its strong side (being life-like) makes it easily discernible for ChatGPT detectors.

Once again, conventional anti-plagiarism essay checkers won’t work there merely because this writing features originality. Meanwhile, it will be too similar to hundreds of other texts covering the same topic.

Here’s an everyday example. Two people give birth to a baby. When kids become adults, they are very much like their parents. But can we tell this particular human is a child of the other two humans? No, if we cannot make a genetic test. This GPT essay checker is a paternity test for written content.

Russia Is Back to the Stalinist Future

With a soviet-style election, vladimir putin’s russia has come full circle..

  • Human Rights

In 1968, the American scholar Jerome M. Gilison described Soviet elections as a “ psychological curiosity ”—a ritualized, performative affirmation of the regime rather than a real vote in any sense of the word. These staged elections with their nearly unanimous official results, Gilison wrote, served to isolate non-conformists and weld the people to their regime.

Last Sunday, Russia completed the circle and returned to Soviet practice. State election officials reported that 87 percent of Russians had cast their vote for Vladimir Putin in national elections, giving the Russian president a fifth term in office. Not only were many of the reported election numbers mathematically impossible , but there was also no longer much of a choice: All prominent opposition figures had been either murdered , imprisoned , or exiled . Like in Soviet times, the election also welded Russians to their regime by serving as a referendum on Putin’s war against Ukraine. All in all, last weekend’s Soviet-style election sealed Putin’s transformation of post-Communist Russia into a repressive society with many of the features of Soviet totalitarianism.

Russia’s return to Soviet practice goes far beyond elections. A recent study by exiled Russian journalists from Proekt Media used data to determine that Russia is more politically repressive today than the Soviet Union under all leaders since Joseph Stalin. During the last six years, the study reports, the Putin regime has indicted 5,613 Russians on explicitly political charges—including “discrediting the army,” “disseminating misinformation,” “justification of terrorism,” and other purported crimes, which have been widely used to punish criticism of Russia’s war on Ukraine and justification of Ukraine’s defense of its territory. This number is significantly greater than in any other six-year period of Soviet rule after 1956—all the more glaring given that Russia’s population is only half that of the Soviet Union before its collapse.

In addition to repressive criminal charges and sentences, over the last six years more than 105,000 people have been tried on administrative charges, which carry heavy fines and compulsory labor for up to 30 days without appeal. Many of these individuals were punished for taking part in unsanctioned marches or political activity, including anti-war protests. Others were charged with violations of COVID pandemic regulations. Such administrative punishments are administered and implemented rapidly, without time for an appeal.

On March 4, 2022, a little over a week after the Russian invasion of Ukraine began, Russia’s puppet parliament rapidly adopted amendments to the Russian Criminal Code and Criminal Procedure Code that established criminal and administrative punishments for the vague transgressions of “discrediting” the Russian military or disseminating “false information” about it. This widely expanded the repressive powers of the state to criminally prosecute political beliefs and activity. Prosecutions have surged since the new laws were passed, likely leading to a dramatic increase in the number of political prisoners in the coming years. In particular, punishments for “discrediting the army” or “justification of terrorism”—which includes voicing support for Ukraine’s right to defend itself—have resulted in hundreds of sentences meted out each year since the war began. The most recent such case: On Feb. 27, the 70-year-old co-chairman of the Nobel Peace Prize-winning human rights group Memorial, Oleg Orlov, was sentenced to two and a half years in prison for “discrediting” the Russian military.

As the Proekt report ominously concludes, “[I]n terms of repression, Putin has long ago surpassed almost all Soviet general secretaries, except for one—Joseph Stalin.” While this conclusion is in itself significant, it is only the tip of the iceberg of the totalitarian state Putin has gradually and systematically rebuilt.

As in the Soviet years, there is no independent media in Russia today. The last of these news organizations were banned or fled the country after Putin’s all-out war on Ukraine, including Proekt, Meduza, Ekho Moskvy, Nobel Prize-winning Novaya Gazeta, and TV Dozhd. In their place, strictly regime-aligned newspapers, social media, and television and radio stations emit a steady drumbeat of militaristic propaganda, promote Russian imperialist grandeur, and celebrate Putin as the country’s infallible commander in chief. In another reprise of totalitarian practice, lists of banned books have been dramatically expanded and thousands of titles have been removed from the shelves of Russian libraries and bookstores. Bans have been extended to numerous Wikipedia pages, social media channels, and websites.

Human rights activists and independent civic leaders have been jailed, physically attacked, intimidated into silence, or driven into exile. Civic organizations that show independence from the state are banned as “ undesirable ” and subjected to fines and prosecution if they continue to operate. The most recent such organizations include the Andrei Sakharov Foundation, Memorial, the legendary Moscow Helsinki Group, and the EU-Russia Civil Society Forum . In their place, the state finances a vast array of pro-regime and pro-war groups, with significant state resources supporting youth groups that promote the cult of Putin and educate children in martial values to prepare them for military service. Then there are the numerous murders of opposition leaders, journalists, and activists at home and abroad. Through these various means, almost all critical Russian voices have been silenced.

Private and family life is also increasingly coming under the scope of government regulation and persecution. The web of repression particularly affects the LGBT community, putting large numbers of Russians in direct peril. A court ruling in 2023 declared the “international LGBT movement” extremist and banned the rainbow flag as a forbidden symbol, which was quickly followed by raids and arrests . Homosexuality has been reclassified as an illness, and Russian gay rights organizations have shut down their operations for fear of prosecution. Legislation aimed at reinforcing “traditional values”—including the right of husbands to discipline their wives—has led to the reduction in sentences and the decriminalization of some forms of domestic violence.

Russia’s Military Is Already Preparing for Its Next War

Moscow is rebuilding its military in anticipation of a conflict with NATO in the next decade, Estonian officials warn.

It’s Time to Declare Putin an Illegitimate Leader

Russia’s sham elections next month—with voting on occupied Ukrainian territory—should not be recognized.

Ukraine Isn’t Putin’s War—It’s Russia’s War

Jade McGlynn’s books paint an unsettling picture of ordinary Russians’ support for the invasion and occupation of Ukraine.

Many of the techniques of totalitarian control now operating throughout Russia were first incubated in territories where the Kremlin spread war and conflict. Chechnya was the first testing ground for widespread repression, including massive numbers of victims subjected to imprisonment, execution, disappearance, torture, and rape. Coupled with the merciless targeting of civilians in Russia’s two wars in Chechnya, these practices normalized wanton criminal behavior within Russian state security structures. Out of this crucible of fear and intimidation, Putin has shaped a culture and means of governing that were further elaborated in other places Russia invaded and eventually came to Russia itself.

In Russian-occupied Crimea and eastern Ukraine since 2014, there has been a widespread campaign of surveillance, summary executions, arrests, torture, and intimidation—all entirely consistent with Soviet practice toward conquered populations. More recently, this includes the old practice of forced political recantations: A Telegram channel ominously called Crimean SMERSH (a portmanteau of the Russian words for “death to spies,” coined by Stalin himself) has posted dozens of videos of frightened Ukrainians recanting their Ukrainian identity or the display of Ukrainian symbols. Made in conjunction with police operations, these videos appear to be coordinated with state security services.

In the parts of Ukraine newly occupied since 2022, human rights groups have widely documented human rights abuses and potential war crimes. These include the abduction of children, imprisonment of Ukrainians in a system of filtration camps that recall the Soviet gulags, and the systematic use of rape and torture to break the will of Ukrainians. Castrations of Ukrainian men have also been employed.

As Russia’s violence in Ukraine has expanded, so, too, has the acceptance of these abominations throughout the state and in much of society. As during the Stalin era, the cult of cruelty and the culture of fear are now the legal and moral standards. The climate of fear initially employed to assert order in occupied regions is now being applied to Russia itself. In this context, the murder of Alexei Navalny ahead of the presidential election was an important message from Putin to the Russian people: There is no longer any alternative to the war and repressive political order he has imposed, of which Navalny’s elimination is a part.

All the techniques and means of repression bespeak a criminal regime that now closely resembles the totalitarian rule of Stalin, whom Putin now fully embraces. After Putin first came to power in 1999, he often praised Stalin as a great war leader while disapproving of his cruelty and brutality. But as Putin pivoted toward war and repression, Russia has systematically promoted a more positive image of Stalin. High school textbooks not only celebrate his legacy but also whitewash his terror regime. There has been a proliferation of new Stalin monuments, with more than 100 throughout the country today. On state-controlled media, Russian propagandists consistently hammer away on the theme of Stalin’s greatness and underscore similarities between his wartime leadership and Putin’s. Discussion of Stalinist terror has disappeared, as has the memorialization of his millions of victims. Whereas only one in five Russians had a positive view of Stalin in the 1990s, polls conducted over the last five years show that number has risen to between 60 percent and 70 percent. In normalizing Stalin, Putin is not glossing over the tyrant’s crimes; rather, he is deliberately normalizing Stalin as a justification for his own war-making and repression.

Putin now resembles Stalin more closely than any other Soviet or Russian leader. Unlike Nikita Khrushchev, Leonid Brezhnev, Konstantin Chernenko, and Yuri Andropov—not to mention Mikhail Gorbachev and Boris Yeltsin—Putin has unquestioned power that is not shared or limited in any way by parliament, courts, or a Politburo. State propaganda has created a Stalin-like personality cult that lionizes Putin’s absolute power, genius as a leader, and role as a brilliant wartime generalissimo. It projects him as the fearsome and all-powerful head of a militarized nation aiming, like Stalin, to defeat a “Nazi” regime in Ukraine and reassert hegemony over Eastern and Central Europe. Just as Stalin made effective use of the Russian Orthodox Church to support Russia’s effort during World War II, Putin has effectively used Russian Orthodox Patriarch Kirill as a critical ally and cheerleader of Russia’s brutal war in Ukraine. And just like Stalin, Putin has made invading neighboring countries and annexing territory a central focus of the Kremlin’s foreign policy.

Putin’s descent into tyranny has been accompanied by his gradual isolation from the rest of society. Like the latter-day Stalin, Putin began living an isolated life as a bachelor even before the COVID-19 pandemic hit. Like the later Stalin, Putin lacks a stable family life and is believed to have replaced it with a string of mistresses, some of whom are reported to have borne him children for whom he remains a remote figure. Like Stalin, he stays up late into the early-morning hours, and like the Soviet dictator, Putin has assembled around him a small coterie of trusted intimates, mostly men in their 60s and 70s, with whom he has maintained friendships for decades, including businessmen Yury Kovalchuk and Igor Sechin, Defense Minister Sergei Shoigu, and security chief Nikolai Patrushev. This coterie resembles Stalin’s small network of cronies: security chief Lavrentiy Beria, military leader Kliment Voroshilov, and Communist Party official Georgy Malenkov. To others in leadership positions, Putin is a distant, absolute leader who openly humiliates seemingly powerful officials, such as spy chief Sergey Naryshkin , when the latter seemed to hesitate in his support during Putin’s declaration of war on Ukraine.

Through near-total control of domestic civic life and media, his widening campaign of repression and terror, relentless state propaganda promoting his personality cult, and his vast geopolitical ambitions, Putin is consciously mimicking the Stalin playbook, especially the parts of that playbook dealing with World War II. Even if Putin has no love for Soviet Communist ideology, he has transformed Russia and its people in ways that are no less fundamental than Stalin’s efforts to shape a new Soviet man.

Putin’s massive victory in a Soviet-style election last weekend represents the ratification by the Russian people of his brutal war, militarization of Russian society, and establishment of a totalitarian dictatorship. It is a good moment to acknowledge that Russia’s descent into tyranny, mobilization of society onto a war footing, spread of hatred for the West, and indoctrination of the population in imperialist tropes represent far more than a threat to Ukraine. Russia’s transformation into a neo-Stalinist, neo-imperialist power represents a rising threat to the United States, its European allies, and other states on Russia’s periphery. By recognizing how deeply Russia has changed and how significantly Putin is borrowing from Stalin’s playbook, we can better understand that meeting the modern-day Russian threat will require as much consistency and as deep a commitment as when the West faced down Stalin’s Soviet Union at the height of the Cold War.

A bot is a software application that uses the internet in order to perform certain functions. However, not all bot traffic is the same and, in reality, there are a number of different ways in which bot traffic can interfere with the operation of a public internet website. In this article, we are going to explore the different types of bot traffic that you might encounter on a public internet website and how you might handle them.

One of the main reasons that bot traffic is a serious consideration for owners of public internet websites is that it can dramatically affect the performance of the website. If not addressed, bot traffic can interfere with the website's ability to provide a good service to genuine users and, ultimately, have a negative impact on the website's performance and reputation. Website owners also have to pay for the hosting of bot traffic, so the financial costs can also be significant. For example, the website may use a web hosting company that charges based on the amount of data that is transmitted to serve the website to visitors.

By generating large amounts of artificial traffic, bots are consuming the owner's internet allowance and running up various types of costs, such as data usage and possibly even 'pay per click' costs. By no means is it unusual for a public site on the internet to receive bot traffic. However, it can be difficult to distinguish between bot visitors and genuine users.

As we will explore later in this article, one technique to filter out bot traffic is to analyze the features of the traffic against the known behaviors and characteristics of different types of bots.

Crawler Bots

Crawler bots, which are sometimes called spider bots, are the most common type of bot. Search engines like Google and Yahoo use their own crawler bots to build and maintain their indices, but there are countless number of custom-designed crawler bots out there. Each of the custom-designed crawler bots is usually created for a specific purpose. For example, a competitor might use a custom-designed crawler bot to track the pricing information on a commercial website and constantly download data from this website so as to monitor the pricing change.

Similarly, a data analysis company can also use a similar custom-designed bot to perform data analysis on a daily basis by seeking some useful information on the internet, such as news or weather conditions. Crawler bots are very important to the operation of the internet. However, they can consume a lot of resources on the internet. For instance, frequent visits to a website from many crawler bots can slow down the response time of the website, and the internet connection of the website can become slow when it is trying to respond to the requests sent from the crawler bots. Besides, the operation of a website can be affected if some of the inbound links to this website are coming from sources that are not friendly, such as referral spam from some crawler bots.

Usually, crawler bots make requests to a website very rapidly and they can make more than ten times of requests if compared to the number of requests made by human users. The server of the website can detect such a high request rate and it can block that IP address automatically. However, it is important to note that a correct and working URL should be provided to the user for certain interactive Facebook tags, such as "share" buttons so that the user can always be directed to the correct URL when the user clicks on the button. Also, the website can provide "robots.txt" to direct the custom-designed bot on when to stop crawling the website. The server can generate this "robots.txt" automatically to meet the requirements of the robot exclusion protocol, which defines how to use the robots.txt file to give instructions to well-behaving crawler bots.

By defining the custom-designed crawler bot's behavior in "robots.txt", the web server can prevent this bot from consuming too much of the server's resources, hence making the website more responsive to the user's requests. Web administrators can always use the information of the bot's user agent string and IP address to identify the bots and decide whether the requests issued to the website are from friends or foes so that certain preventive measures can be taken if necessary.

Malicious Bots

With malicious bots , the main focus is to leverage the website's resources to carry out an attack. One of the most common types of malicious bot that is used is what's called a DDoS bot, or a distributed denial of service bot. What this does is create a significant amount of junk traffic by getting a huge number of 'slave' systems, or 'zombies', to request access to the website in question, often from lots of different places around the world. This traffic can be difficult to filter, as it's usually very similar in makeup to ordinary user requests — just with a hugely multiplied number of hits. This is incredibly effective at overloading a server, as it is usually geared up to provide content to a certain number of legitimate users at once, spread across the globe.

When an excessive number of requests are generated by a botnet, which is the collective name for a group of 'slave' systems, then legitimate traffic is unable to be fulfilled and the server becomes overwhelmed, slowing down or preventing all requests. Another type of malicious bot is a spam bot. These are used to propagate illegal nonsense text or advertising material onto the internet with the aim of driving traffic to the originator. Spam bots launch their payloads onto forums, blogs, web forms, and wikis, as these generally allow unfiltered content. This allows for the spread of materials which might not usually make it through traditional search engines and web filtering. This sort of bot is easy to counter, as servers can ask users to complete a simple test to confirm that a human is sending the content. However, when used as part of a larger and more complex attack that leverages the effects of spam and other types of bot-driven attacks, the overall challenge to keep a website secure, increases.

These sorts of attacks are sometimes called 'compound attacks', as they are ones that are made up of multiple different stages, each of which might be relatively minor on its own, but together are much more damaging than the sum of their parts.

Scraping Bots

So-called " scraping bots " use web scraping, a technique in which a computer program extracts data from output generated by another computer program. When a user views a webpage, that webpage's data is typically sent from the website's server to the user's browser, where it is rendered on the screen. Scraping bots bypass the need for a user to view the data in a web browser; the bot sends a request to the website's server, which then sends the data directly back to the bot.

The bot can then navigate and extract what it needs from the page on its own, rather than relying on a user to do so. The ability of bots to scrape data with relative ease — and without the website owner's permission — leads to significant issues for the targets of such bots. In general, website administrators prohibit data scraping in their website's terms of service.

Moreover, some states and countries have computer crime laws that prohibit unauthorized access to a computer system or the unauthorized gathering of certain data types. However, a bot operator must actually violate these laws to be held criminally liable, which is a warning to many a significant impediment to recourse. An operator of a scraping bot can be criminally liable under the federal Computer Fraud and Abuse Act or an equivalent state law providing the operator knew that access to the data was not authorized or that using the bot violated the terms of service on the website being scraped. However, both state and federal law enforcement actions are historically rare, particularly in cases where consumer data rather than trade secrets or government data is targeted.

This means most website owners who bring suit against scraping bot operators will do so in civil court based on a number of different legal theories. Given that the targets of scraping bots have a variety of recourses, the operators of such bots should proceed with caution.

After going through the different types of bot traffic introduced in the previous sections, I think it is not difficult to understand that bot traffic is becoming a more and more severe problem faced by public internet websites. Business competition is one of the key drivers that drive various individuals with different business orientations to use bot traffic, which creates unfair competition. S

ome of the websites use bot traffic for commercial purposes like pulling data from other websites and using the information on their own websites. Some individuals create bot traffic for their self-interests and gains, like spying and click fraud.

I hope this article provides a valuable source to raise your awareness and understanding of this growing and complex online issue and the impacts of such issues and helps to reduce the chance of being victims of these bot traffics. Bot traffic is advantageous in some cases, but it becomes harmful when it impacts society and businesses. And again, the importance of security for websites and the education of the public to tackle bot traffic becomes self-evident. Through public awareness and a tight legal framework, I believe one day the harmful bot traffic will become history.

Even the Supreme Court’s Conservatives Are Fed Up With the Garbage Coming Out of the 5th Circuit

What happens when a lawless judge and a terrible appeals court embrace the dopiest First Amendment claim you’ve ever heard out of pure spite toward a Democratic president? That would be Murthy v. Missouri , a brain-meltingly dumb case that the Supreme Court was unfortunate enough to hear oral arguments in on Monday. Murthy poses a question so asinine that to ask it is to answer it: Can government officials encourage social media companies to moderate certain content that they deem harmful—most importantly, disinformation about COVID-19 in the middle of the pandemic?

Yes, of course they can: The First Amendment does not gag public officials from urging Facebook or the Washington Post or anyone else to publish or not publish certain information, especially when it contains dangerous lies about a once-in-a-century pandemic that could exacerbate the crisis. The First Amendment bars government censorship, not government persuasion, and the Biden administration planted itself on the latter side of that bright line. At least six justices grasped this basic constitutional principle on Monday. Several of them used arguments to highlight how this inane case illustrates so much of what’s wrong with the judiciary today, and hinted at the dangers it could pose to American democracy in the future. That we should pay attention to. The rest was an unfortunate sideshow.

Like so many Supreme Court cases these days, Murthy is built atop a heap of fake facts. The case began when Missouri and Louisiana sued agencies and officials across the Biden administration, falsely accusing them of coercing social media companies into censoring their residents’ free speech. (These states later added a handful of fringe anti-vaxxers to the suit.) They filed their complaint in the Monroe Division of the Western District of Louisiana, where—surprise!—they were guaranteed to draw a Trump appointee, Terry Doughty, the one judge hearing cases in that division. Judge Doughty has a record of issuing nationwide injunctions against the Biden administration on the basis of dubious legal and factual analysis. Most notably, he issued a nationwide bar against Biden’s vaccine mandate for health care workers in an opinion riddled with anti-vax nonsense (which the Supreme Court reversed ).

Doughty, in other words, was certain to rule against Biden in the social media case. Even still, the opinion he handed down on July 4, 2023, was a humiliating mess of contradictions, fabrications , and (ironically) misinformation . Doughty adopted the plaintiffs’ theory that the administration “coerced” social media companies into removing “conservative” speech about COVID, including posts promoting hydroxychloroquine and rejecting the efficacy of vaccines. He accused government officials of launching a “coordinated campaign” to silence conservatives by forcing private companies to take down anti-vax content, as well as false claims about election fraud. And he issued one of the most sweeping injunctions in the history of the American legal system, prohibiting any employee—including Homeland Security, the State Department, the Department of Justice, and the FBI—from “engaging in any communication of any kind with social-media companies” encouraging content moderation.

Doughty, it turns out, grievously butchered the record to reach his conclusion. An exhaustive analysis by Mike Masnick proves that Doughty consistently misrepresented testimony and other evidence in the record to construct a conspiracy theory with zero basis in reality. He distorted emails and other exchanges to make them look coercive when they were nothing of the sort, cherry-picking and rearranging quotations to put them in a censorious light. Yet the hard-right U.S. Court of Appeals for the 5 th Circuit, where law goes to die , affirmed Doughty’s conclusions and upheld much of his injunction (while narrowing it in part). That move sent the administration racing to the Supreme Court for an emergency stay, which it granted in October, over the dissents of Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas. Monday’s arguments confirmed that a majority is prepared to side with Biden on the merits.

The justices did not sound happy to have the case before them. Justice Sonia Sotomayor scolded Louisiana Solicitor General Benjamin Aguiñaga (a former Alito clerk) for his lack of candor. “I have such a problem with your brief,” she told him. “You omit information that changes the context of some of your claims. You attribute things to people who it didn’t happen to.” Aguiñaga was unable to defend Doughty’s more extreme deceptions. So he had to fall back on what Justice Elena Kagan called an “extremely expansive” argument: the notion that “encouraging people to suppress their own speech” violates the First Amendment, even if it isn’t coercive. Kagan drew upon her past work in the executive branch to explain that, actually, government officials do this all the time . “I’ve had some experience encouraging press to suppress their own speech,” Kagan told Aguiñaga. Example: “You just wrote a bad editorial. Here are the five reasons you shouldn’t write another one.” Is that really unconstitutional?

Justice Brett Kavanaugh, a former White House staff secretary, also provided a real-world perspective after Alito fumed that officials had been too mean to the platforms and would never treat the traditional press so sharply. Kavanaugh gave Alito a reality check: “I’d assumed, thought, [and] experienced government press people throughout the federal government who regularly call up the media and berate them,” he told Deputy Solicitor General Brian Fletcher, who defended the administration. “You said the anger was unusual. I wasn’t entirely clear on that from my own experience.” Translation: Government employees yell at members of the media all the time. The media can accept or reject their requests. That is how it works .

But did Biden officials berate social media employees? Only on a few rare occasions. Here’s what really happened: The platforms in question, most prominently Facebook and Twitter, invited the government to help them identify and remove the most toxic disinformation. At the time, as Fletcher explained, these companies were eager to present themselves as “partners” with the administration in its push for COVID vaccination. Officials could “flag” questionable content, but the platforms made their own judgment calls, without any demonstrable fear of retaliation. Everyone agrees that the government violates free speech when it explicitly coerces companies into censoring expression under the threat of punishment. But, Fletcher persuasively argued, no such thing happened here.

That left Aguiñaga to lean on the theory that the government contravenes the First Amendment when it merely “encourages” specific content moderation. Justice Amy Coney Barrett, a stickler for legible rules, sounded borderline aghast at this baggy, boundless standard; she lobbed a series of hypotheticals at Aguiñaga that showed he was pushing a meaningless and impracticable test. Chief Justice John Roberts tried to help Aguiñaga understand that multiple agencies with competing agendas may pressure platforms in contradictory directions; doesn’t that “dilute the concept of coercion significantly?” (Aguiñaga just sounded confused.) Kavanaugh pointed out that the plaintiffs’ position could prevent officials from urging the press to safeguard national security by, for instance, asserting that a forthcoming article might imperil the troops.

Even Gorsuch, who started out sympathetic to Aguiñaga, was exasperated by the end, complaining that Doughty’s “universal injunction” was part of the “epidemic” that had to be stopped. Only Alito and Thomas sounded like surefire votes for the plaintiffs after nearly two hours of arguments, and Thomas’ heart was not fully in it. Alito stood alone in his increasingly uncontrolled and seething aggrievement .

The pandemic may be over, but Murthy remains a hugely relevant case. Perhaps most obviously, it is a cautionary tale about the extremism of Trump judges like Doughty, who keep issuing these lawless injunctions at the behest of red-state politicians, and the 5 th Circuit, which keeps upholding them. A disproportionate number of the Supreme Court’s cases this term emerge from the 5 th Circuit, which keeps appeasing the Trump-appointed zealots attempting to seize unimaginable amounts of power from the democratic branches. The chief justice is attempting to crack down on the kind of judge-shopping that occurred here, but the fight is just beginning. The evident frustration of Roberts, Kavanaugh, Barrett, and even Gorsuch on Monday suggests that a majority of the court is fed up with this political manipulation of the judiciary by rogue judges with undisguised partisan loyalties.

So, yes, SCOTUS is likely to reach the right result in Murthy . Alarmingly, though, so much damage has already been done. In light of Doughty’s injunction, the federal government shut down all of its efforts to combat disinformation, fearful of judicial sanctions. Bad actors have exploited this development to flood the internet with lies about the upcoming 2024 election. If foreign entities attempt to interfere with the election via social media, the Biden administration will have few tools left to fight them. It is just too late to revive the various task forces that worked with platforms before Doughty disbanded them last year. For the Murthy plaintiffs, then, a Supreme Court defeat may not matter much. They have already done immense damage to truth and transparency on the internet. And at this late date, the worst of it cannot be undone.

When It Comes to Politics, Are Any of Us Really Thinking for Ourselves?

An illustration of sheep, some red, some blue, lining up to vote at a ballot box.

By Neil Gross

Dr. Gross is a professor of sociology at Colby College who studies the social aspects of intellectual life.

If you’re trying to guess whether people are Republicans or Democrats, knowing a few basic facts about them will take you a long way. What’s their race and gender? How far did they get in school? What part of the country do they live in and is their community urban, suburban or rural?

Between 2016 and 2020, for example, white Americans without college degrees favored the Republican Party by nearly 24 percentage points. Strike up a conversation about politics with such a person in rural central Maine, near where I live, and chances are that his or her sympathies will lie with the G.O.P.

Or consider gender and attitudes about crime and public safety: Men are about 10 percentage points more supportive than women of the death penalty and 10 percentage points less supportive of gun control. Or how about ethnicity and views on illegal immigration? Relative to Latino Americans, non-Latinos endorse “increasing deportation” as a partial solution by a 22-point margin.

Although there are certainly people whose politics defy generalization, the underlying demographic tendencies are powerful predictors of belief — powerful enough that elections have become as much a turnout game as an exercise in persuasion.

But this raises an important question. If our political views and behavior can be so easily predicted by characteristics like race (over which we have no control) or by factors like education (where our choices may be highly constrained by other things such as the social class of our parents), then when it comes to politics, are any of us really thinking for ourselves?

The accusation that people on the other side of the political divide have abandoned critical thinking and moral reasoning is now commonplace in American political discourse. Many on the left interpret the political tendencies of white voters without college educations as evidence that the Republican Party’s core constituency is ill informed or even unintelligent. Who else could fall for the lies of Donald Trump? Republicans, for their part, regularly invoke the idea of “liberal groupthink,” using it to make sense of how some of America’s ostensibly brightest minds could champion simplistic, unworkable policies like defunding the police.

These accusations form part of the broader phenomenon of partisan stereotyping, which has flourished as the country has pulled apart. Alongside the charge that those in the opposite political camp don’t think for themselves, Democrats in 2022 were considerably more likely than they were in 2016 to say that Republicans were closed-minded, dishonest and immoral. Republicans felt pretty much the same way about Democrats.

Yet the possibility that our own political views may reflect something other than our intellectual or moral virtue barely seems to register. College-educated professionals too seldom acknowledge, for example, that they may feel an affinity for the Democrats in part because the party has been more supportive than Republicans of both higher education and claims to expertise (and remuneration) based on educational credentials. Instead they recast their class interests as altruism, imagining that they believe what they do solely out of concern for the future of the country.

Similarly, when evangelical Christians back Mr. Trump because they expect him to appoint more pro-Christian judges to the federal bench and enact educational policies favorable to religious schools, they view themselves as patriots, not maximizers of their group’s standing. None of us want to admit that our most cherished political opinions may be largely a function of our position in society and the associated social pressures, not the end result of a process of intellectual, moral or spiritual inquiry.

There are many situations, of course, in which it is permissible, even beneficial, for people not to think for themselves . Whatever cognitive losses accrue when we let our phones navigate for us in unfamiliar cities are probably offset by the gains in driving safety and efficiency. When we fall ill and trust a doctor to give us a diagnosis and tell us how to regain our health, we’re letting that doctor (and the broader medical system) think for us, to some extent. Our outcomes will be far better on average than if we acted from our lay knowledge, as higher death rates among Covid vaccine deniers attest.

On most political matters, however, it is an abdication of personal responsibility to allow our opinions to be unreflectively determined by our social position. It may be inevitable that our group identities, interests and experiences shape our political inclinations. But it’s up to each of us to scrutinize the beliefs we’ve absorbed from our social milieu to ensure that our values and political commitments are what we truly think they should be — that our beliefs are based on sound reasons rather than brute social forces.

Regrettably, a hyperpartisan society does little to reward such independence of thought, even as both progressives and conservatives claim its mantle.

If nothing else, reflecting on the social roots of your political opinions and behavior should prompt some humility. Even if you hold the “correct” political beliefs, you may not deserve to congratulate yourself for them; your moral righteousness could be an accident of birth or a product of good social fortune. So on what grounds are you permitted to feel snidely superior to your peers who — simply because of their different life circumstances — wound up on the other side of the political aisle?

This doesn’t imply moral relativism, but it does suggest that we should take greater care when assigning praise or blame. The contingency of our own positions also raises the distinct possibility that others’ opinions contain overlooked elements of truth.

By all means, let’s duke it out in the public sphere and at the ballot box. You’ll fight for your interests and values, I’ll fight for mine. That’s democracy in a big, diverse, boisterous nation. But if we could bear in mind that we sometimes stumble into our most passionately held beliefs, the tenor of our discourse might be a bit saner and more cordial. The fact that we are all deeply social creatures, in politics and otherwise, underscores our shared humanity — something that we would be wise to never lose sight of.
