Ethical Business Practices: Case Studies and Lessons Learned

Introduction

Ethical business practices are a cornerstone of any successful company, influencing not only the public perception of a brand but also its long-term profitability. However, understanding what constitutes ethical behavior and how to implement it can be a complex process. This article explores some case studies that shine a light on ethical business practices, offering valuable lessons for businesses in any industry.

Case Study 1: Patagonia’s Commitment to Environmental Ethics

Patagonia, the outdoor clothing and gear company, has long set a standard for environmental responsibility. The company uses eco-friendly materials, promotes recycling of its products, and actively engages in various environmental causes.

Lessons Learned

  • Transparency : Patagonia is vocal about its ethical practices and even provides information on the environmental impact of individual products.
  • Consistency: Ethics are not an “add-on” for Patagonia; they are integrated into the very fabric of the company’s operations, from sourcing to production to marketing.
  • Engagement: The company doesn’t just focus on its practices; it encourages consumers to get involved in the causes it supports.

Case Study 2: Salesforce and Equal Pay

Salesforce, the cloud-based software company, took a stand on the gender pay gap issue. They conducted an internal audit and found that there was indeed a significant wage disparity between male and female employees for similar roles. To address this, Salesforce spent over $6 million to balance the scales.

  • Self-Audit: It’s crucial for companies to actively review their practices. What you don’t know can indeed hurt you, and ignorance is not an excuse.
  • Taking Responsibility: Rather than sweeping the issue under the rug, Salesforce openly acknowledged the problem and took immediate corrective action.
  • Long-Term Benefits: Fair treatment boosts employee morale and productivity, leading to long-term profitability.

Case Study 3: Starbucks and Racial Sensitivity Training

In 2018, Starbucks faced a public relations crisis when two Black men were wrongfully arrested at one of their Philadelphia stores. Instead of issuing just a public apology, Starbucks closed down 8,000 of its stores for an afternoon to conduct racial sensitivity training.

Lessons   Learned

  • Immediate Action : Swift and meaningful action is critical in showing commitment to ethical behavior.
  • Education: Sometimes, the problem is a lack of awareness. Investing in employee education can avoid repeated instances of unethical behavior.
  • Public Accountability: Starbucks made their training materials available to the public, showing a level of transparency and accountability that helped regain public trust.

Why Ethics Matter

Ethical business practices are not just morally correct; they have a direct impact on a company’s bottom line. Customers today are more informed and more sensitive to ethical considerations. They often make purchasing decisions based on a company’s ethical standing, and word-of-mouth (or the digital equivalent) travels fast.

The case studies above show that ethical business practices should be a top priority for companies of all sizes and industries. These are not isolated examples but are representative of a broader trend in consumer expectations and regulatory frameworks. The lessons gleaned from these cases—transparency, consistency, engagement, self-audit, taking responsibility, and education—are universally applicable and offer a robust roadmap for any business seeking to bolster its ethical standing.

By implementing ethical business practices sincerely and not as a marketing gimmick, companies not only stand to improve their public image but also set themselves up for long-term success, characterized by a loyal customer base and a motivated, satisfied workforce.

The plurality of languages and ethnicities, the geographic fragmentation, the predominant Roman Catholic religion, together with the still relatively short experience in nationhood account for a very peculiar understanding of "business ethics" in the Philippines. The rapid growth and liberalization of the economy, coupled with the inequitable distribution of wealth, the destruction of the environment and corruption are the main ethical concerns. Businesspersons and the academe endeavor to find creative solutions for these unique challenges.

2020 is the epitome of change–but business ethics are still needed

  • Henry J. Schumacher
  • August 31, 2020
  • 3 minute read

IN addition to all the effects on every one of us, companies must break new ground more than ever. This year clearly shows how important it is for organizations to be adaptable and to be able to rethink and react quickly.

But how do I get myself, my team or my organization to act more agile? How can I act flexibly in the currently unpredictable situation and also prepare myself for an uncertain future? Companies ask themselves these questions.

As we are all thinking of strategies into the future, looking at disruptive innovation, or creative disruption, I would like to remind everybody that building and maintaining an ethical business culture must be part of the agenda. Business leaders must be aware that being caught in corruption, unfair competition, data breaches, cybercrime etc. will not only lead to heavy fines but will definitely affect the reputation of the company.

So let’s talk about building an ethical culture in practice. What is the difference between ethics and building a culture of trust?

Ethics are a set of principles. An ethical culture is a culture committed to pursuing those principles—and sometimes the pursuit of those principles leads an employee to take actions somebody else might dislike. Perhaps the employee reports suspicions of  misconduct, involving bribery, or collusion, in competition, or mismanagement of data privacy.

Either way, the employee needs to trust that the company will support that decision to step forward. The apparatus of a corporate compliance program—the training, the internal reporting systems, the code of conduct, the due diligence procedures; all of it—should work toward the goal of a strong sense of trust within the organization. PhilHealth employees would certainly have pressed the “red button” much earlier, had there been that trust.

When you view “building an ethical culture” from that perspective, suddenly several tasks rise to the top of the priority list.

For example, as much as we all love a strong internal reporting system, most employees report their concerns to managers. Most employees also take their cues about how to behave from managers. Consequently, the training of managers about how to weave ethical standards into the company’s daily routines is critical.

Formal training will always be important; employees will always need to know what the law says about bribery, or privacy, or collusion, or whatever else comes along. Culture, however, is much more than training, full of informal practices, norms, and expectations. Therefore, ethics and compliance programs must work with middle managers on what those practices, norms, and expectations are, and how to base them on the company’s ethical principles. That’s where you win, or lose, this battle.

Senior leaders in government and in the private sector have a crucial role in building an ethical culture since they send the signals about the corporate culture that people in operations translate into daily routines.

Let’s look at three ways you can build an ethical culture:

Develop clear ethical values—honesty, respect, fairness; whatever fits your organization. Talk with senior leaders and the board about what those values should be. Put them in the Code of Conduct, in a place of prominence so that every employee is aware of it.

Develop clear  training materials  based on those values. Create real-life scenarios that employees might encounter, where the resolution shows how ethical conduct is the higher priority than commercial success.

Refine your internal reporting system to assure the confidentiality of whistle-blowers. Someone who does report an allegation to a hot line (or some other system that circumvents his or her manager) has a fear about doing the ethical thing. He or she needs to trust that the company will protect their identity—that is, they need to trust the system. They need to see that your internal reporting system is trustworthy.

Those are only a few examples of what building an ethical culture entails. It’s long, painstaking work, that relies on communication and collaboration but that’s how you get to an ethical culture.

Both, the Integrity Initiative Inc. and EITSC, have developed training materials to assist companies in creating trust and ethics—with special emphasis on anti-corruption and data privacy protection. Both organizations are in standby to assist.

Disaster reporting entails multi-layered responsibilities to the reading public. Thus, it must be done carefully to give the public accurate updates. The Filipino newspapers are one in providing precautionary advisories before the disaster, on the dot news stories during disaster, and description of the aftermath. To describe the disaster-stricken areas, the Filipino news stories use coined words through Tagalog affixation, figures of speech, tabloid jargons, English words transliterated into Filipino orthography, and words for approximation. They also include sentences relevant to the Filipino values and traits. These elements do not only provide vivid picture of the effects of the disasters but also reflect some Filipino values such as resourcefulness, creativity, adaptability, religious, hopeful, bayanihan, and hardworking. They also reveal some of the negative traits of the Filipinos like colonial mentality, reliance on luck, and gossiping.

The paper examined the value system in Philippine firms against the backdrop of Eastern-Western cultural dynamics in East Asia. The Asian milieu presents coexistence of cultural stasis and unease-balance and tension between Eastern values and Western ideas. Successful Asian countries demonstrated their ability to blend conflicting cultures and highlight certain values in order to promote nation-building efforts. The Philippine value system is a stark contrast to its East Asian neighbors'. It partakes of both Asian traditions and Western practices but curiously is neither Asian nor Western. The absence of more solid foundation, the inability to distill foreign values, and the "disconnects" between national culture and local articulation have resulted in the "adulteration" of Philippine management culture. This culture gap might have been responsible for the country's slower pace of development.
