What is a PhD?

• A Doctor of Philosophy (PhD) is the highest globally recognized postgraduate degree that higher education institutions can award.
• PhDs are awarded to candidates who undertake original and extensive research in a particular field of study.
• Full time PhD programmes typically last three to four years, whilst part time PhD programmes typically last six to seven years.
• A PhD can lead to an academia teaching role or a career in research. A PhD can also equip you with skills suitable for a wide range of jobs unrelated to your research topic or academia.

Definition of a PhD – A Doctor of Philosophy (commonly abbreviated to PhD , Ph.D or a DPhil ) is a university research degree awarded from across a broad range of academic disciplines; in most countries, it is a terminal degree, i.e. the highest academic degree possible.

PhDs differ from undergraduate and master’s degrees in that PhDs are entirely research-based rather than involving taught modules (although doctoral training centres (DTCs) offer programmes that start with a year of lecture-based teaching to help develop your research skills prior to starting your project).

In most English-speaking countries, those that complete a PhD use the title “Doctor” (typically abbreviated to Dr) in front of their names and are referred to as such within academic and/or research settings. Those that work in fields outside of academia may decide not to use the formal doctor title but use post-nominal letters (e.g. John Smith PhD); it’s unusual though for someone to use both the Doctor title and post-nominal letters in their name.

PhD vs Doctorate

A PhD and a professional doctorate are both research-based terminal degrees.

However, where a PhD focuses on original research mostly around theoretical concepts, a professional doctorate focuses on examining existing knowledge to solve real-life, practical problems.

While there is much crossover between the two, a PhD is generally better suited for an individual to wants to advance the knowledge and understanding in their field, and a professional doctorate degree is better suited to a working professional who wants to better be able to apply knowledge and understanding to their field.

What Are the Entry Requirements for a PhD?

To be accepted on to a PhD programme, students usually need to hold at least a high ( 2:1 and above ) undergraduate degree that is related to the field of research that they want to pursue. A PhD candidate may also be expected to hold a Master’s degree , however, this does not mean you must have one, as it is still possible to enrol into a PhD without a Master’s .

Self-funded courses may sometimes be more relaxed in relation to entry requirements. It may be possible to be accepted onto a self-funded PhD programme with lower grades, though these students typically demonstrate their suitability for the role through professional work experience.

Whilst a distance learning project is possible , most PhD candidates will carry out their research over at least three years based at their university, with regular contact with two academic supervisors (primary and secondary). This is particularly the case for lab-based projects, however, some PhD projects require spending time on-site away from university (e.g. at a specialist research lab or at a collaborating institution abroad).

How Long Does a PhD Take?

Typically, full-time PhDs last 3-4 years and part-time PhDs last 6-7 years. However, at the discretion of the university, the thesis writing-up period can be extended by up to four years.

Although most doctoral programmes start in September or October, they are generally much more flexible than taught-courses and can start at any time of the year.

How Much Does a PhD Cost?

Tuition fees for UK and EU students vary between £3,000 and £6,000 per year, with the average tuition fee of £4,712 per year for 2023/24 programmes.

Tuition fees increase considerably for international students, varying between £16,000 to £25,000 per year, with an average tuition fee of £19,600 per year .

Nonetheless, most students will secure PhD funding in the form of studentships, scholarships and bursaries to help pay for these fees. These funding opportunities can either be partial, which cover tuition fees only, or full, which cover both tuition fees and living expenses.

UK national students can also apply for Doctoral Loans from Student Finance England if they are unable to secure funding.

What Does a PhD Involve?

To be awarded a PhD, a doctoral student is required to produce a substantial body of work that adds new knowledge to their chosen field.

A PhD programme will typically involve four key stages:

Stage 1: Literature Review

The first year of a PhD involves attending regular meetings with your supervisors and carrying out a search on previously published work in your subject area. This search will be used to produce a literature review which should set the context of the project by explaining the foundation of what is currently known within the field of research, what recent developments have occurred, and where the gaps in knowledge are. In most cases, this will be an extension of your research proposal should you have produced one as part of your application. The literature review should conclude by outlining the overarching aims and objectives of the research project. This stage of setting achievable goals which are original and contribute to the field of research is an essential first step in a successful PhD.

The supervisor is the main point of contact through the duration of a PhD – but remember: they are there to mentor, not to teach, or do it for you . It will be your responsibility to plan, execute and monitor your own work as well as to identify gaps in your own knowledge and address them.

Stage 2: Research

The second year (and prehapse some of your third year) is when you work on your research. Having identified novel research questions from your review of the literature, this is where you collect your data to help answer these questions. How you do this will depend on the nature of your doctoral research: for example, you may design and run experiments in a lab alongside other PhD students or visit excavation sites in remote regions of the world. You should check in regularly with your supervisors to update them and run any ideas or issues past them.

Have the structure and chapters of your thesis in mind as you develop and tackle your research questions. Working with a view of publishing your work will be very valuable later on.

Stage 3: Write up of Thesis

The next key stage of a PhD is writing a doctoral thesis , which typically takes from anywhere between three months to one year. A thesis is a substantial body of work that describes the work and outcomes of the research over the previous two to three years. It should tell a detailed story of the PhD project – focusing on:

• The motivations for the research questions identified from the literature review.
• The methodologies used, results obtained, and a comprehensive analysis and discussion of the findings.
• A detailed discussion of the key findings with an emphasis on the original contributions made to your field of research and how this has been impactful.

There is no universal rule for the length of a PhD thesis, but general guidelines set the word count between 80,000 to 100,000 words.

For your thesis to be successful, it needs to adequately defend your argument and provide a unique or increased insight into your field that was not previously available.

Stage 4: Attending the Viva

A viva voce , most commonly referred to as just a ‘ viva ‘, is an interview-style examination where the PhD student is required to engage in a critical appraisal of their work and defend their thesis against at least two examiners. The examiners will ask questions to check the PhD student has an in-depth understanding of the ideas and theories proposed in their thesis, and whether they have developed the research skills that would be expected of them.

The viva is one of the final steps in achieving a PhD, and typically lasts at least two hours, but this duration can vary depending on the examiners, the university and the PhD project itself.

Once you have done the viva – you’re on the home stretch. You will typically be asked to make some amendments to your thesis based on the examiner’s feedback. You are then ready to submit your final thesis for either:

• PhD – If you pass the requirements you will be awarded a PhD degree (most common outcome),
• MPhil – If you failed to meet requirements for a PhD, you may be downgraded to an MPhil degree (uncommon outcome),
• Fail – No award is given, typically for cases of plagiarism (extremely uncommon outcome).

Career Opportunities

First, a PhD prepares you for a career in academia if you wish to continue in this area. This takes form as a career in the Higher Education sector, typically as a lecturer working their way to becoming a professor leading research on the subject you’ve studied and trained in.

Second, a PhD also enables the opportunity for landing a job in a research & development role outside of the academic environment. Examples of this include laboratory work for a private or third sector company, a governmental role and research for commercial and industrial applications.

Transferable Skills

What Can I Do After a PhD?

One of the most desirable postdoctoral fields is working within independent Research and Development (R&D) labs and new emerging companies. Both industries, especially R&D labs, have dedicated groups of PhD graduates who lead research activities, design new products and take part in crucial strategic meetings. Not only is this a stimulating line of work, but the average salaries in R&D labs and emerging start-ups are lucrative. In comparison, an undergraduate with five years of experience within their given field will, on average, likely earn less than a new PhD graduate taking on a R&D position.

It’s a common misunderstanding that PhDs only opens the door for an academic career such as university lecturers and training providers. Although obtaining a PhD opens these doors, the opportunities extend far beyond educational roles. In fact, recent data from the UK’s Higher Education Statistics Agency (HESA) indicates only 23% of PhD graduates take a position in educational roles . This low percentage is primarily because PhD graduates have a wide range of skills that make them suitable for a broad spectrum of roles. This is being seen first hand by the increasing number of PhD graduates who are entering alternative roles such as research, writing, law and investment banking.

We appreciate that finding a PhD programme to undertake can be a relatively daunting process. According to Higher Education Student Statistics , over 22,000 PhDs were awarded in 2016/17 within the United Kingdom alone. Clearly there are a huge number of PhD programmes available. This can sometimes be confusing for prospective doctorates, particularly when different programmes are advertised in different places. The doctoral degree is awarded for excellence in research scholarship. It signifies the attainment of independently acquired and comprehensive learning attesting to general professional competence. The doctoral degree requires at least 90 post-baccalaureate hours, including both formal coursework and hours of research. 

All Ph.D. students are expected to choose two research areas, one primary and one secondary, in which to focus their coursework and writing. Students will design these areas of study in close consultation with the chair of their committee. These areas of study may be selected from well-established fields of national literature and/or historical periods (e.g., British, American, Native American, post-colonial Anglophone, medieval, early modern, Eighteenth, Nineteenth or Twentieth century), Rhetoric and Writing Studies, theoretical approaches (feminism/gender studies, critical race/ethnicity studies, Marxism, poststructuralism), media studies (film, graphic novel), more recent areas of scholarly interest (transnational literatures, new kinds of interdisciplinary studies, digital humanities). The committee must consist of a committee chair, an outside member, and at least two other members of the English graduate faculty.

The faculty are committed to preparing graduate students through preparation in coursework, mentoring, and professional development. Students have published their work in prominent journals and presented at national and local conferences. Teaching assistantships are competitive with peer institutions, and financial assistance for dissertation completion and conference travel is available through the department, the College of Arts and Sciences, and the Graduate College. The department has been successful in helping students find tenure-track positions and other employment in the field. 

 Admissions Requirements:

• Prospective graduate students must submit an application for admission and official transcripts to the Office of Admissions .
• A $50 non-refundable application processing fee is required of all applicants for admission to the University of Oklahoma.
• The English Department deadline for applying to the Graduate Program for the Fall term is January 5th. New students are not accepted into the graduate programs during the Spring or Summer terms.
• To be considered for admission into the Ph.D. program, we require the following: a Grade Point Average of 3.5 or better on a 4.00 scale in graduate work already completed; and an M.A. in English or in a closely related field. A student with a slightly lower G.P.A. may be considered if the application is otherwise very strong. Candidates are admitted on a competitive basis.
• A Financial Aid Services packet, and information about eligibility for financial aid, can be obtained from the Office of Financial Aid at (405) 325-4521.

Application Requirements (to be submitted with online application):

• Three (3) Letters of Reference: On your online application, you will be asked to provide emails for three references who will be contacted by the University with a request for a letter of recommendation. Your recommenders should comment specifically upon (1) your qualifications as a graduate student (literary judgment, writing ability, originality, diligence) and, if you are applying for Graduate Teaching Assistantship (GTA), (2) your qualifications as a prospective teacher (ability to organize, enthusiasm, responsibility, objectivity). If possible, referees should use the online reference system, but if they prefer, they may send hardcopy letters directly to the Office of Graduate Admissions (731 Elm Avenue, Room 318 Norman, OK 73019).
• Official Transcripts: These should be sent directly to the Office of Graduate Admissions (731 Elm Avenue, Room 318 Norman, OK 73019). Unofficial transcripts may also be uploaded to your online application.
• Statement of Goals in Graduate education: This should include your reasons for the choice of Field of Specialization and be 250-500 words. Upload this statement to your online application.
• Critical Writing Sample: It should be no more than 25 pages, appropriate to program and area. Uploaded to your online application.

Teaching Assistantships:

• Teaching Assistantships with stipends of $16,404 are available on a competitive basis for up to five years at the Ph.D. level. Prospective students interested in teaching assistantship support should indicate that on the application. 
• Two weeks before the beginning of the first semester, all students who receive teaching appointments will also participate in a workshop to help them prepare for their courses, covering topics such as reading assignments, writing assignments, paper grading, and classroom strategy. 
• Students awarded graduate teaching assistantship (GTA) positions will typically teach one to two composition courses each semester under the supervision of the First Year Composition Office (FYC). 
• After a student has completed coursework and passed the Ph.D. General Exams, dissertation research can be supported with a $1000 increase in the assistantship stipend for one year.

Dissertation Fellowships:

• Ph.D. students working on their dissertations are eligible to apply for a one-year dissertation fellowship, which will provide them financial support without any teaching duties. 
• Students applying will need to demonstrate that substantial work on the dissertation is already completed, and that they have a clear plan for a writing schedule for the rest of the chapters. 
• Students awarded fellowships will be expected not to take on any additional work responsibilities so that they can concentrate on research and writing.

• Initial advisement should occur just prior to the beginning of the fall and spring semesters. In your admission letter you are informed of the name of the assigned faculty member from the Graduate Committee who will be your adviser for the first semester or year. As soon as possible, students should seek an advisor from among the faculty in their area of study. Until the student has found a permanent adviser, he or she should seek advisement from the assigned adviser and the Director of Graduate Studies.
• During the first several weeks of the first semester in the program, new graduate students will meet collectively with the faculty and advanced students for an Orientation session and Q&A.
• After the student has chosen a faculty member to serve as adviser, the adviser will thereafter help the student construct a coherent plan of study according to the regulations of the Graduate College and the structure of the Ph.D. program.
• A plan of study will be prepared by the student and the Adviser, and approved by the Director of Graduate Studies, before enrollment for the second semester.

• ENGL 5113 Teaching College Composition Proseminar (3 Credits)
• ENGL 5313 Literary Criticism Proseminar (3 Credits)
• 7 Seminars (21 Credits)
• ENGL 6880 PhD Exam Hours (3 Credits)
• ENGL 6980 PhD Dissertation Hours (30 Credits)

Total Credits = 60 Hours + 30 Hours at the MA level = 90 Hours

*If a student has gone through our MA program and remained in our program to pursue a PhD, that student would not be required to retake either the ENGL 5113 Teaching Proseminar (3 Credits) or the ENGL 5313 Literary Criticism Proseminar (3 Credits). Instead, that student can take an additional 2 seminars as Proseminars in the first year by completing a Proseminar contract with the instructor. Contact the Graduate Director, Dr. Amit R. RWS Ph.D. Program Requirements

• ENGL 5403 Introduction to Rhetoric and Writing Studies Proseminar (3 Credits)
• ENGL 6103 Research Methods in Rhetoric and Writing Proseminar (3 Credits)
• 6 Additional Seminars (18 Credits)

*If a student has gone through our MA program in RWS and remained in our program to pursue a PhD in that area, that student would not be expected to retake the required courses again. Instead, the student can take any other seminars to replace the required courses. In the first year at the PhD level, the student may take two of those seminars as Proseminars. Ph.D. Exam Committee :

The exam committee should be composed of at least 3 faculty members of the English Department and one external member. These members should be submitted to the Graduate College via the Advisory Conference Report form. In addition to the Advisory Conference Report form, students must complete a General Examination Application form the semester before they intend to take their exams.

2 Reading Lists :

• Primary list:  50 entries
• Secondary list:  30 entries

Students will compose 2 reading lists to prepare for their General Examination. The first list is connected to their primary area of interest and the second is for their secondary field. Lists should be determined in consultation with the PhD Exam Committee, particularly with the guidance of the Committee Chair.

Questions :

The student provides questions for the exam in consultation with the Committee. The student will provide three questions for the primary list and two for the secondary list. The Committee chooses two questions, one for each area, from the list provided by the student.

Written Requirement:

• 2 take home essays
• First Essay will be on the Primary list and should be 15-20 pages
• Second Essay will be on the Secondary list and should be 10-15 pages

Oral Requirement (Oral Defense of the PhD Written Exams) :

The student writes and defends the exam essays in the fourth semester at the PhD level. Sometimes students will wait until the beginning of the fifth semester to take the exam. Students should not take their exams any later than early fall of the fifth semester to remain on track.

After successfully passing their PhD exams, students will sign up for dissertation credits and tuition waivers (usually five credits/semester- sometimes they will need to take more or fewer credits depending on how long they are in the program to make a full 30 Credits. Details can be discussed with Brenda Mackey, Graduate Coordinator).

Typically students will complete and defend their dissertation two or three years after passing their exams.

Written Requirement

Students will write a dissertation in consultation with their Dissertation Committee, particularly their Dissertation Chair.

Oral Requirement (Oral Defense of the Dissertation)

Language Requirements :

One language at reading proficiency level.

• Two undergraduate courses in the language (must have received at least a B in each class)
• A translation exam offered by the Department of Modern Languages or other appropriate department.
• A graduate level reading class offered in Modern Languages (this class is offered each summer and only Spanish or French are offered).
• Native proficiency

*Before the department informs the Graduate College that a graduate student has met the requirement for language proficiency, the student’s chair must determine whether the student has met the necessary proficiency level for the student’s particular area and research project. Some fields require greater language proficiency than the first three options above may allow for.

**The graduate level reading course does not count for the degree credits nor do any other language courses taken during degree time count for credits toward the degree. Students can petition the graduate college for extra waivers to take language classes.

With permission, students may avail themselves of all three options. However, these options will only be approved in exceptional circumstances.

• Directed Readings (3 Credits):  When a student cannot proceed with their main course of study without taking a directed reading, the student and their chair can petition the graduate committee for permission to replace a seminar with a directed reading. Students may petition to take up to one directed reading at the M.A. level and one directed reading at the Ph.D. level. The student and faculty must also fill out a directed reading contract specifying required assignments, readings, and meetings.
• Students may take up to one graduate 4000 level course (3 Credits) when that course is truly necessary for the student’s course of study with the approval of the graduate committee and the student’s chair. This course must result in a 20+ page research paper. Students may petition to take up to one 4000 level course at the M.A. level and one at the Ph.D. level.
• Students may take up to one graduate level seminar (3 Credits) in another department when that course is truly necessary for the student’s course of study with the approval of the graduate committee and the student’s chair. Students may petition to take up to one seminar in another department at the M.A. level and one at the Ph.D. level.
• Each graduate student will be evaluated formally and collectively at the end of each academic year during a meeting of the faculty. The annual evaluation of each current graduate student will be an occasion for a careful (re)assessment of his or her scholastic progress, accomplishments, and prospects of continuation in the program. Students are evaluated upon their timely progress in the program and the quality of their work.
• In the spring semester, students will submit a self-assessment to their Adviser on the Annual Student Progress Report (ASPR), sent through email by Sara Knight, with the required information for that academic year. The Adviser will submit the ASPR with his or her written evaluation of the student’s work based on a review of the student's grades, performance in courses, and timely progress toward degree. At the end of the Spring semester, the full graduate faculty meet to discuss each student’s performance and consider whether or not the student’s progress is satisfactory or unsatisfactory.
• If a student's annual evaluation indicates that he or she is not making satisfactory progress in the program, the Graduate Committee will review the case and make an official recommendation to the Graduate College. If a student receives an “Unsatisfactory” on an annual review, thereafter, he or she will be evaluated every semester. The Graduate College automatically disenrolls students who receive two “Unsatisfactory” reports. Unless there are extenuating circumstances approved by the advisor, students are automatically disenrolled by the Department if their cumulative GPA falls below 3.0.

4 weeks prior to the last day of finals  (and at least 10 working days prior to the defense): Deadline to submit a reading copy of the dissertation to the committee and to submit the  Report of Reading Copy Submission and Request for Authority to Defend  to the Graduate College.

• Explanation: Students will now be required to submit a full reading copy to the committee and to report to the Graduate College that they have done so as part of the process of requesting authority to defend.   

3 weeks prior to the last day of finals  (and at least 5 working days prior to the defense): Deadline for committee members to sign the  Report of Reading Copy Submission and Request for Authority to Defend .

• Explanation: Committee members will affirm that they received the reading copy as reported by the student and will provide their assessment of whether the thesis or dissertation is ready to defend. The timeline provides committee members with one week (5 working days) to make this assessment.   

2 weeks (10 working days) prior to the last day of finals:  Deadline to defend the thesis or dissertation.

• Explanation: This deadline allows the student to spend one week making limited revisions and still graduate during the current semester.  Academic units may wish to encourage or require earlier defenses  if more extensive revisions tend to be needed, or to encourage committees to provide feedback earlier in the process- talk to your advisor about their requirements.    

1 week (5 working days) prior to the last day of finals:  Deadline to submit the thesis or dissertation to SHAREOK in order to graduate during the current academic term.

• Explanation: A large proportion of theses and dissertations require formatting adjustments or other corrections after initial submission to SHAREOK. This deadline allows these issues to be resolved by the end of the semester for graduation and timely degree clearance. 

Two additional changes in policy and practice will accompany these timelines.

• The  Request for Degree Check  will be due during the  first two weeks  of the semester. This will enable the grad college to identify and address any potential barriers to graduation early in the semester and facilitate processing of the  Request for Authority to Defend  once all signatures are received. The  Request for Degree Check  is easy to submit, and there is no penalty for requesting a degree check but not graduating that semester. In addition, requiring it early in the semester will encourage students and committees to confer about the plan for completion. 
• The grad college will enforce the requirement to enroll in the subsequent semester if degree completion requirements are not met in accordance with the above timelines. Students will be eligible to graduate without repeating the defense if they submit their thesis or dissertation to SHAREOK within 60 calendar days after the defense, but they will be required to enroll in the following semester if their submission occurs after the final day of classes. (The grad college will continue to entertain petitions to waive the enrollment requirement if serious exigent circumstances are present, but the grad college will not approve petitions in the absence of such circumstances.)

Financial Assistance

Full-time PhD students admitted into the PhD program are eligible to be considered for an Institute fellowship of Rs. 34,000 or Rs. 37,000 per month in the first year based on their qualifications at the time of admission. Students admitted with M.E./M.Tech./M.Pharm./MBA/M.Phil. or an equivalent Degree are eligible to receive an Institute fellowship of Rs. 37,000/-. Students admitted with M.Sc./B.E./B.Pharm. or an equivalent degree are eligible to receive an Institute fellowship of Rs. 34,000/-. These students on successful completion of coursework will receive Rs. 37,000/- from the Semester following the one in which the course work was completed Higher fellowship may be made available in subsequent years. Consideration for Institute fellowship will be as per Institute norms. It will be obligatory on the part of every admitted full time student to undertake 8 hours (per week) of work as assigned to him/her by the institute.

Despite objections from Donald Trump’s attorneys, adult-film actress Daniels shared details of the alleged sexual encounter in the New York hush money trial.

Adult-film actress Stormy Daniels appeared on the witness stand at Donald Trump’s hush money trial Tuesday, offering an account of her alleged one-night stand with the former president . Despite the repeated objections of Trump’s lawyers, Daniels went into great detail about the 2006 sexual encounter; her description at times made it sound like the sex could be viewed as nonconsensual . The presumptive Republican nominee could be heard muttering profanities at certain points in the proceedings.

Trump, who denies ever having sex with Daniels, has pleaded not guilty to charges of falsifying business records to conceal hush money payments to Daniels during the 2016 election.

Here are key moments from Tuesday’s trial in New York, based on an early transcript and lightly edited for brevity and clarity.

Trump hush money trial

Trump’s lawyer seeks to block Daniels from sharing sexual details

At the opening of Tuesday’s court session, Trump’s attorney Susan Necheles began by objecting — in advance of testimony by Daniels, whose legal name is Stephanie Clifford — to the prosecution seeking “any details of any sexual acts.” The charges, the defense noted, are not over alleged sexual acts.

Susan Necheles, defense attorney: We think that this is irrelevant. It has nothing to do with the charges in this case. And to the extent that it has any relevance, it’s unduly prejudicial. And there really is no reason for it to be coming into the case about books and records here.

Justice Juan Merchan: And when you say “details of any sexual act,” what do you mean? Do you mean more than just “we had sex?”

Necheles: Yes, your honor.

The prosecution argued that Daniels’s account — particularly of a conversation with Trump in a hotel suite where Daniels says they had sex — was important for establishing her credibility as a witness.

Susan Hoffinger, prosecution attorney: The general details of what occurred, including the sex act, barring certain details that are unnecessary, are a significant part of the story, but also very important for us in terms of her credibility.

Merchan : So when you say that some details are necessary, can you give me a sense of what you have in mind?

The prosecution argued that the details are important if the jury is to understand why Trump would have been motivated to pay money to prevent a story about the alleged encounter with Daniels from appearing in news reports.

Hoffinger : How she even ended up having a sexual act with him, and then in terms of the sexual act, it will be just very basic. It’s not going to involve any descriptions of genitalia or anything of that nature.

The judge ruled that prosecution lawyers can ask Daniels for background information about the events leading up to the encounter.

Merchan : But we don’t need to know the details of the intercourse.

Daniels describes alleged sexual encounter with Trump

Daniels, who appeared nervous and spoke quickly, gave an incredibly detailed account of the evening she went to Trump’s suite at a Lake Tahoe resort following a golf event, where she said they had sex.

When she arrived for what she thought was just dinner, Daniels said Trump was wearing silk or satin pajamas, but that he changed into a suit after she made a joke about it. When they sat down at the dining room table, Trump asked her questions about the adult-film business including whether she tested for sexually transmitted diseases, she said. At one point, she says she spanked him with a rolled-up magazine.

After emerging from the bathroom, Daniels said she was “startled” to find Trump on the bed in a T-shirt and boxer shorts. Daniels told jurors she did not want to have sex with him.

Daniels: Then I just thought, oh, my God, what did I misread to get here. Because the intention was pretty clear, somebody stripped down in their underwear and posing on the bed, like waiting for you.

Daniels said she never felt physically or verbally threatened by Trump, but did feel a power imbalance between them. Trump was bigger than her, she said, and there was a bodyguard outside the door.

Daniels: The next thing I know, I was on the bed, somehow on the opposite side of the bed from where we had been standing. I had my clothes and shoes off. I believe my bra, however, was still on.

Daniels’s account also included how she stared at the ceiling during sex, since she was “trying to think about anything other than what was happening there” — to which the judge sustained an objection. She also said Trump didn’t wear a condom, and described the position in which they had sex. After the encounter, Daniels said she remained silent as she gathered her possessions.

Daniels: My hands were shaking so hard. I was having a hard time getting dressed. He said, “Oh, great. Let’s get together again honey bunch. We were great together.” I just wanted to leave.

Daniels said they stayed in touch because she hoped Trump would let her appear on his hit reality show, “The Apprentice.”

Judge requests Trump stop cursing

Even before Daniels described the alleged sexual encounter, the judge was concerned about Trump’s reaction to her initial testimony. As the court rose for its morning recess, Merchan beckoned Trump’s defense lawyers to a sidebar.

Merchan : I understand that your client is upset at this point, but he is cursing audibly, and he is shaking his head visually and that’s contemptuous. It has the potential to intimidate the witness and the jury can see that.

Trump’s attorney Todd Blanche said he would talk to his client.

Merchan : One time I noticed when Ms. Daniels was testifying about rolling up the magazine, and presumably smacking your client, and after that point he shook his head and he looked down. And, later, I think he was looking at you, Mr. Blanche, later when we were talking about The Apprentice, at that point he again uttered a vulgarity and looked at you this time. Please talk to him at the break.

The judge rejects a mistrial request from Trump’s lawyers

Immediately after the lunch break, Trump’s attorneys argued that Daniels’s testimony about the sex act was irrelevant and prejudicial to the point that it warranted a mistrial.

Trump’s lawyer Blanche : The Court set guardrails for this testimony. And the guardrails by this witness, answering questions from the government, were just thrown to the side.

In particular, Trump’s attorney argued that many of the details were simply intended to embarrass his client and “inflame the jury” in a trial fundamentally about business records, including any suggestion there were “safety concerns” in the encounter.

The prosecution responded that it had been “extremely mindful of not eliciting too much testimony about the actual act.”

Hoffinger: But, at the end of the day, your Honor, this is what defendant was trying to hide … in terms of the payoff in 2016 before the election. This is an exhibit. If you were … of what Mr. Trump wanted to make sure didn’t get disclosed. We have carved back details.

The judge said it “would have been better” if the prosecution hadn’t gone into certain areas, but suggested that “in fairness,” the witness was “a little difficult to control.”

Merchan: I do think that there were some things that were better left unsaid. Having said that, I don’t believe we are at the point where a mistrial is warranted.

Daniels admits to signing a false statement in 2018

In a statement in 2018 ahead of an appearance on “Jimmy Kimmel Live,” Daniels denied getting paid to keep quiet about her encounter with Trump — one of several claims that she has since renounced but that Trump and his allies have seized on to undermine her credibility. “I am denying it [the affair] because it never happened,” the statement said.

But in Tuesday’s testimony, Daniels said she signed the statement differently than how she usually signs things as a “tip off” to indicate that the statement was false .

Hoffinger: What kind of a tip off?

Daniels: That I didn’t — that either I didn’t sign it — that I didn’t sign it willingly.

Hoffinger: Is that because you were upset about signing it?

Daniels: Yes.

Hoffinger: And is this statement false?

Daniels’s 2018 statement echoed a similar one provided by Daniels’s lawyer to the Wall Street Journal the same year, when it reported that Trump’s attorney Michael Cohen had negotiated a secret $130,000 payment to secure Daniels’s silence ahead of the 2016 presidential election. On Tuesday, Daniels said she did not want to sign off on that statement to the Journal “because it’s not true,” but worried about violating a nondisclosure agreement.
