You'll no doubt have to write a number of argumentative essays in both high school and college, but what, exactly, is an argumentative essay and how do you write the best one possible? Let's take a look.

A great argumentative essay always combines the same basic elements: approaching an argument from a rational perspective, researching sources, supporting your claims using facts rather than opinion, and articulating your reasoning into the most cogent and reasoned points. Argumentative essays are great building blocks for all sorts of research and rhetoric, so your teachers will expect you to master the technique before long.

But if this sounds daunting, never fear! We'll show how an argumentative essay differs from other kinds of papers, how to research and write them, how to pick an argumentative essay topic, and where to find example essays. So let's get started.

What Is an Argumentative Essay? How Is it Different from Other Kinds of Essays?

There are two basic requirements for any and all essays: to state a claim (a thesis statement) and to support that claim with evidence.

Though every essay is founded on these two ideas, there are several different types of essays, differentiated by the style of the writing, how the writer presents the thesis, and the types of evidence used to support the thesis statement.

Essays can be roughly divided into four different types:

#1: Argumentative #2: Persuasive #3: Expository #4: Analytical

So let's look at each type and what the differences are between them before we focus the rest of our time to argumentative essays.

Argumentative Essay

Argumentative essays are what this article is all about, so let's talk about them first.

An argumentative essay attempts to convince a reader to agree with a particular argument (the writer's thesis statement). The writer takes a firm stand one way or another on a topic and then uses hard evidence to support that stance.

An argumentative essay seeks to prove to the reader that one argument —the writer's argument— is the factually and logically correct one. This means that an argumentative essay must use only evidence-based support to back up a claim , rather than emotional or philosophical reasoning (which is often allowed in other types of essays). Thus, an argumentative essay has a burden of substantiated proof and sources , whereas some other types of essays (namely persuasive essays) do not.

You can write an argumentative essay on any topic, so long as there's room for argument. Generally, you can use the same topics for both a persuasive essay or an argumentative one, so long as you support the argumentative essay with hard evidence.

Example topics of an argumentative essay:

  • "Should farmers be allowed to shoot wolves if those wolves injure or kill farm animals?"
  • "Should the drinking age be lowered in the United States?"
  • "Are alternatives to democracy effective and/or feasible to implement?"

The next three types of essays are not argumentative essays, but you may have written them in school. We're going to cover them so you know what not to do for your argumentative essay.

Persuasive Essay

Persuasive essays are similar to argumentative essays, so it can be easy to get them confused. But knowing what makes an argumentative essay different than a persuasive essay can often mean the difference between an excellent grade and an average one.

Persuasive essays seek to persuade a reader to agree with the point of view of the writer, whether that point of view is based on factual evidence or not. The writer has much more flexibility in the evidence they can use, with the ability to use moral, cultural, or opinion-based reasoning as well as factual reasoning to persuade the reader to agree the writer's side of a given issue.

Instead of being forced to use "pure" reason as one would in an argumentative essay, the writer of a persuasive essay can manipulate or appeal to the reader's emotions. So long as the writer attempts to steer the readers into agreeing with the thesis statement, the writer doesn't necessarily need hard evidence in favor of the argument.

Often, you can use the same topics for both a persuasive essay or an argumentative one—the difference is all in the approach and the evidence you present.

Example topics of a persuasive essay:

  • "Should children be responsible for their parents' debts?"
  • "Should cheating on a test be automatic grounds for expulsion?"
  • "How much should sports leagues be held accountable for player injuries and the long-term consequences of those injuries?"

Expository Essay

An expository essay is typically a short essay in which the writer explains an idea, issue, or theme , or discusses the history of a person, place, or idea.

This is typically a fact-forward essay with little argument or opinion one way or the other.

Example topics of an expository essay:

  • "The History of the Philadelphia Liberty Bell"
  • "The Reasons I Always Wanted to be a Doctor"
  • "The Meaning Behind the Colloquialism ‘People in Glass Houses Shouldn't Throw Stones'"

Analytical Essay

An analytical essay seeks to delve into the deeper meaning of a text or work of art, or unpack a complicated idea . These kinds of essays closely interpret a source and look into its meaning by analyzing it at both a macro and micro level.

This type of analysis can be augmented by historical context or other expert or widely-regarded opinions on the subject, but is mainly supported directly through the original source (the piece or art or text being analyzed) .

Example topics of an analytical essay:

  • "Victory Gin in Place of Water: The Symbolism Behind Gin as the Only Potable Substance in George Orwell's 1984"
  • "Amarna Period Art: The Meaning Behind the Shift from Rigid to Fluid Poses"
  • "Adultery During WWII, as Told Through a Series of Letters to and from Soldiers"

There are many different types of essay and, over time, you'll be able to master them all.

A Typical Argumentative Essay Assignment

The average argumentative essay is between three to five pages, and will require at least three or four separate sources with which to back your claims . As for the essay topic , you'll most often be asked to write an argumentative essay in an English class on a "general" topic of your choice, ranging the gamut from science, to history, to literature.

But while the topics of an argumentative essay can span several different fields, the structure of an argumentative essay is always the same: you must support a claim—a claim that can reasonably have multiple sides—using multiple sources and using a standard essay format (which we'll talk about later on).

This is why many argumentative essay topics begin with the word "should," as in:

  • "Should all students be required to learn chemistry in high school?"
  • "Should children be required to learn a second language?"
  • "Should schools or governments be allowed to ban books?"

These topics all have at least two sides of the argument: Yes or no. And you must support the side you choose with evidence as to why your side is the correct one.

But there are also plenty of other ways to frame an argumentative essay as well:

  • "Does using social media do more to benefit or harm people?"
  • "Does the legal status of artwork or its creators—graffiti and vandalism, pirated media, a creator who's in jail—have an impact on the art itself?"
  • "Is or should anyone ever be ‘above the law?'"

Though these are worded differently than the first three, you're still essentially forced to pick between two sides of an issue: yes or no, for or against, benefit or detriment. Though your argument might not fall entirely into one side of the divide or another—for instance, you could claim that social media has positively impacted some aspects of modern life while being a detriment to others—your essay should still support one side of the argument above all. Your final stance would be that overall , social media is beneficial or overall , social media is harmful.

If your argument is one that is mostly text-based or backed by a single source (e.g., "How does Salinger show that Holden Caulfield is an unreliable narrator?" or "Does Gatsby personify the American Dream?"), then it's an analytical essay, rather than an argumentative essay. An argumentative essay will always be focused on more general topics so that you can use multiple sources to back up your claims.

Good Argumentative Essay Topics

So you know the basic idea behind an argumentative essay, but what topic should you write about?

Again, almost always, you'll be asked to write an argumentative essay on a free topic of your choice, or you'll be asked to select between a few given topics . If you're given complete free reign of topics, then it'll be up to you to find an essay topic that no only appeals to you, but that you can turn into an A+ argumentative essay.

What makes a "good" argumentative essay topic depends on both the subject matter and your personal interest —it can be hard to give your best effort on something that bores you to tears! But it can also be near impossible to write an argumentative essay on a topic that has no room for debate.

As we said earlier, a good argumentative essay topic will be one that has the potential to reasonably go in at least two directions—for or against, yes or no, and why . For example, it's pretty hard to write an argumentative essay on whether or not people should be allowed to murder one another—not a whole lot of debate there for most people!—but writing an essay for or against the death penalty has a lot more wiggle room for evidence and argument.

A good topic is also one that can be substantiated through hard evidence and relevant sources . So be sure to pick a topic that other people have studied (or at least studied elements of) so that you can use their data in your argument. For example, if you're arguing that it should be mandatory for all middle school children to play a sport, you might have to apply smaller scientific data points to the larger picture you're trying to justify. There are probably several studies you could cite on the benefits of physical activity and the positive effect structure and teamwork has on young minds, but there's probably no study you could use where a group of scientists put all middle-schoolers in one jurisdiction into a mandatory sports program (since that's probably never happened). So long as your evidence is relevant to your point and you can extrapolate from it to form a larger whole, you can use it as a part of your resource material.

Argumentative Essay Format

Argumentative Essays are composed of four main elements:

  • A position (your argument)
  • Your reasons
  • Supporting evidence for those reasons (from reliable sources)
  • Counterargument(s) (possible opposing arguments and reasons why those arguments are incorrect)

If you're familiar with essay writing in general, then you're also probably familiar with the five paragraph essay structure . This structure is a simple tool to show how one outlines an essay and breaks it down into its component parts, although it can be expanded into as many paragraphs as you want beyond the core five.

The standard argumentative essay is often 3-5 pages, which will usually mean a lot more than five paragraphs, but your overall structure will look the same as a much shorter essay.

An argumentative essay at its simplest structure will look like:

Paragraph 1: Intro

  • Set up the story/problem/issue
  • Thesis/claim

Paragraph 2: Support

  • Reason #1 claim is correct
  • Supporting evidence with sources

Paragraph 3: Support

  • Reason #2 claim is correct

Paragraph 4: Counterargument

  • Explanation of argument for the other side
  • Refutation of opposing argument with supporting evidence

Paragraph 5: Conclusion

  • Re-state claim
  • Sum up reasons and support of claim from the essay to prove claim is correct

Now let's unpack each of these paragraph types to see how they work (with examples!), what goes into them, and why.

Paragraph 1—Set Up and Claim

Your first task is to introduce the reader to the topic at hand so they'll be prepared for your claim. Give a little background information, set the scene, and give the reader some stakes so that they care about the issue you're going to discuss.

Next, you absolutely must have a position on an argument and make that position clear to the readers. It's not an argumentative essay unless you're arguing for a specific claim, and this claim will be your thesis statement.

Your thesis CANNOT be a mere statement of fact (e.g., "Washington DC is the capital of the United States"). Your thesis must instead be an opinion which can be backed up with evidence and has the potential to be argued against (e.g., "New York should be the capital of the United States").

Paragraphs 2 and 3—Your Evidence

These are your body paragraphs in which you give the reasons why your argument is the best one and back up this reasoning with concrete evidence .

The argument supporting the thesis of an argumentative essay should be one that can be supported by facts and evidence, rather than personal opinion or cultural or religious mores.

For example, if you're arguing that New York should be the new capital of the US, you would have to back up that fact by discussing the factual contrasts between New York and DC in terms of location, population, revenue, and laws. You would then have to talk about the precedents for what makes for a good capital city and why New York fits the bill more than DC does.

Your argument can't simply be that a lot of people think New York is the best city ever and that you agree.

In addition to using concrete evidence, you always want to keep the tone of your essay passionate, but impersonal . Even though you're writing your argument from a single opinion, don't use first person language—"I think," "I feel," "I believe,"—to present your claims. Doing so is repetitive, since by writing the essay you're already telling the audience what you feel, and using first person language weakens your writing voice.

For example,

"I think that Washington DC is no longer suited to be the capital city of the United States."

"Washington DC is no longer suited to be the capital city of the United States."

The second statement sounds far stronger and more analytical.

Paragraph 4—Argument for the Other Side and Refutation

Even without a counter argument, you can make a pretty persuasive claim, but a counterargument will round out your essay into one that is much more persuasive and substantial.

By anticipating an argument against your claim and taking the initiative to counter it, you're allowing yourself to get ahead of the game. This way, you show that you've given great thought to all sides of the issue before choosing your position, and you demonstrate in multiple ways how yours is the more reasoned and supported side.

Paragraph 5—Conclusion

This paragraph is where you re-state your argument and summarize why it's the best claim.

Briefly touch on your supporting evidence and voila! A finished argumentative essay.

Argumentative Essay Example: 5-Paragraph Style

It always helps to have an example to learn from. I've written a full 5-paragraph argumentative essay here. Look at how I state my thesis in paragraph 1, give supporting evidence in paragraphs 2 and 3, address a counterargument in paragraph 4, and conclude in paragraph 5.

Topic: Is it possible to maintain conflicting loyalties?

Paragraph 1

It is almost impossible to go through life without encountering a situation where your loyalties to different people or causes come into conflict with each other. Maybe you have a loving relationship with your sister, but she disagrees with your decision to join the army, or you find yourself torn between your cultural beliefs and your scientific ones. These conflicting loyalties can often be maintained for a time, but as examples from both history and psychological theory illustrate, sooner or later, people have to make a choice between competing loyalties, as no one can maintain a conflicting loyalty or belief system forever.

The first two sentences set the scene and give some hypothetical examples and stakes for the reader to care about.

The third sentence finishes off the intro with the thesis statement, making very clear how the author stands on the issue ("people have to make a choice between competing loyalties, as no one can maintain a conflicting loyalty or belief system forever." )

Paragraphs 2 and 3

Psychological theory states that human beings are not equipped to maintain conflicting loyalties indefinitely and that attempting to do so leads to a state called "cognitive dissonance." Cognitive dissonance theory is the psychological idea that people undergo tremendous mental stress or anxiety when holding contradictory beliefs, values, or loyalties (Festinger, 1957). Even if human beings initially hold a conflicting loyalty, they will do their best to find a mental equilibrium by making a choice between those loyalties—stay stalwart to a belief system or change their beliefs. One of the earliest formal examples of cognitive dissonance theory comes from Leon Festinger's When Prophesy Fails . Members of an apocalyptic cult are told that the end of the world will occur on a specific date and that they alone will be spared the Earth's destruction. When that day comes and goes with no apocalypse, the cult members face a cognitive dissonance between what they see and what they've been led to believe (Festinger, 1956). Some choose to believe that the cult's beliefs are still correct, but that the Earth was simply spared from destruction by mercy, while others choose to believe that they were lied to and that the cult was fraudulent all along. Both beliefs cannot be correct at the same time, and so the cult members are forced to make their choice.

But even when conflicting loyalties can lead to potentially physical, rather than just mental, consequences, people will always make a choice to fall on one side or other of a dividing line. Take, for instance, Nicolaus Copernicus, a man born and raised in Catholic Poland (and educated in Catholic Italy). Though the Catholic church dictated specific scientific teachings, Copernicus' loyalty to his own observations and scientific evidence won out over his loyalty to his country's government and belief system. When he published his heliocentric model of the solar system--in opposition to the geocentric model that had been widely accepted for hundreds of years (Hannam, 2011)-- Copernicus was making a choice between his loyalties. In an attempt t o maintain his fealty both to the established system and to what he believed, h e sat on his findings for a number of years (Fantoli, 1994). But, ultimately, Copernicus made the choice to side with his beliefs and observations above all and published his work for the world to see (even though, in doing so, he risked both his reputation and personal freedoms).

These two paragraphs provide the reasons why the author supports the main argument and uses substantiated sources to back those reasons.

The paragraph on cognitive dissonance theory gives both broad supporting evidence and more narrow, detailed supporting evidence to show why the thesis statement is correct not just anecdotally but also scientifically and psychologically. First, we see why people in general have a difficult time accepting conflicting loyalties and desires and then how this applies to individuals through the example of the cult members from the Dr. Festinger's research.

The next paragraph continues to use more detailed examples from history to provide further evidence of why the thesis that people cannot indefinitely maintain conflicting loyalties is true.

Paragraph 4

Some will claim that it is possible to maintain conflicting beliefs or loyalties permanently, but this is often more a matter of people deluding themselves and still making a choice for one side or the other, rather than truly maintaining loyalty to both sides equally. For example, Lancelot du Lac typifies a person who claims to maintain a balanced loyalty between to two parties, but his attempt to do so fails (as all attempts to permanently maintain conflicting loyalties must). Lancelot tells himself and others that he is equally devoted to both King Arthur and his court and to being Queen Guinevere's knight (Malory, 2008). But he can neither be in two places at once to protect both the king and queen, nor can he help but let his romantic feelings for the queen to interfere with his duties to the king and the kingdom. Ultimately, he and Queen Guinevere give into their feelings for one another and Lancelot—though he denies it—chooses his loyalty to her over his loyalty to Arthur. This decision plunges the kingdom into a civil war, ages Lancelot prematurely, and ultimately leads to Camelot's ruin (Raabe, 1987). Though Lancelot claimed to have been loyal to both the king and the queen, this loyalty was ultimately in conflict, and he could not maintain it.

Here we have the acknowledgement of a potential counter-argument and the evidence as to why it isn't true.

The argument is that some people (or literary characters) have asserted that they give equal weight to their conflicting loyalties. The refutation is that, though some may claim to be able to maintain conflicting loyalties, they're either lying to others or deceiving themselves. The paragraph shows why this is true by providing an example of this in action.

Paragraph 5

Whether it be through literature or history, time and time again, people demonstrate the challenges of trying to manage conflicting loyalties and the inevitable consequences of doing so. Though belief systems are malleable and will often change over time, it is not possible to maintain two mutually exclusive loyalties or beliefs at once. In the end, people always make a choice, and loyalty for one party or one side of an issue will always trump loyalty to the other.

The concluding paragraph summarizes the essay, touches on the evidence presented, and re-states the thesis statement.

How to Write an Argumentative Essay: 8 Steps

Writing the best argumentative essay is all about the preparation, so let's talk steps:

#1: Preliminary Research

If you have the option to pick your own argumentative essay topic (which you most likely will), then choose one or two topics you find the most intriguing or that you have a vested interest in and do some preliminary research on both sides of the debate.

Do an open internet search just to see what the general chatter is on the topic and what the research trends are.

Did your preliminary reading influence you to pick a side or change your side? Without diving into all the scholarly articles at length, do you believe there's enough evidence to support your claim? Have there been scientific studies? Experiments? Does a noted scholar in the field agree with you? If not, you may need to pick another topic or side of the argument to support.

#2: Pick Your Side and Form Your Thesis

Now's the time to pick the side of the argument you feel you can support the best and summarize your main point into your thesis statement.

Your thesis will be the basis of your entire essay, so make sure you know which side you're on, that you've stated it clearly, and that you stick by your argument throughout the entire essay .

#3: Heavy-Duty Research Time

You've taken a gander at what the internet at large has to say on your argument, but now's the time to actually read those sources and take notes.

Check scholarly journals online at Google Scholar , the Directory of Open Access Journals , or JStor . You can also search individual university or school libraries and websites to see what kinds of academic articles you can access for free. Keep track of your important quotes and page numbers and put them somewhere that's easy to find later.

And don't forget to check your school or local libraries as well!

#4: Outline

Follow the five-paragraph outline structure from the previous section.

Fill in your topic, your reasons, and your supporting evidence into each of the categories.

Before you begin to flesh out the essay, take a look at what you've got. Is your thesis statement in the first paragraph? Is it clear? Is your argument logical? Does your supporting evidence support your reasoning?

By outlining your essay, you streamline your process and take care of any logic gaps before you dive headfirst into the writing. This will save you a lot of grief later on if you need to change your sources or your structure, so don't get too trigger-happy and skip this step.

Now that you've laid out exactly what you'll need for your essay and where, it's time to fill in all the gaps by writing it out.

Take it one step at a time and expand your ideas into complete sentences and substantiated claims. It may feel daunting to turn an outline into a complete draft, but just remember that you've already laid out all the groundwork; now you're just filling in the gaps.

If you have the time before deadline, give yourself a day or two (or even just an hour!) away from your essay . Looking it over with fresh eyes will allow you to see errors, both minor and major, that you likely would have missed had you tried to edit when it was still raw.

Take a first pass over the entire essay and try your best to ignore any minor spelling or grammar mistakes—you're just looking at the big picture right now. Does it make sense as a whole? Did the essay succeed in making an argument and backing that argument up logically? (Do you feel persuaded?)

If not, go back and make notes so that you can fix it for your final draft.

Once you've made your revisions to the overall structure, mark all your small errors and grammar problems so you can fix them in the next draft.

#7: Final Draft

Use the notes you made on the rough draft and go in and hack and smooth away until you're satisfied with the final result.

A checklist for your final draft:

  • Formatting is correct according to your teacher's standards
  • No errors in spelling, grammar, and punctuation
  • Essay is the right length and size for the assignment
  • The argument is present, consistent, and concise
  • Each reason is supported by relevant evidence
  • The essay makes sense overall

#8: Celebrate!

Once you've brought that final draft to a perfect polish and turned in your assignment, you're done! Go you!

This is followed by an example, and ends with a summary. This is a very basic structure, but it gives you a bird-eye-view of how a proper argumentative essay can be built.

Writing an argumentative essay (for a class, a news outlet, or just for fun) can help you improve your understanding of an issue and sharpen your thinking on the matter. Using researched facts and data, you can explain why you or others think the way you do, even while other reasonable people disagree.

What Is an Argumentative Essay?

An argumentative essay is an explanatory essay that takes a side.

Instead of appealing to emotion and personal experience to change the reader’s mind, an argumentative essay uses logic and well-researched factual information to explain why the thesis in question is the most reasonable opinion on the matter.  

Over several paragraphs or pages, the author systematically walks through:

  • The opposition (and supporting evidence)
  • The chosen thesis (and its supporting evidence)

At the end, the author leaves the decision up to the reader, trusting that the case they’ve made will do the work of changing the reader’s mind. Even if the reader’s opinion doesn’t change, they come away from the essay with a greater understanding of the perspective presented — and perhaps a better understanding of their original opinion.

All of that might make it seem like writing an argumentative essay is way harder than an emotionally-driven persuasive essay — but if you’re like me and much more comfortable spouting facts and figures than making impassioned pleas, you may find that an argumentative essay is easier to write. 

Plus, the process of researching an argumentative essay means you can check your assumptions and develop an opinion that’s more based in reality than what you originally thought. I know for sure that my opinions need to be fact checked — don’t yours?

So how exactly do we write the argumentative essay?

How do you start an argumentative essay

First, gain a clear understanding of what exactly an argumentative essay is. To formulate a proper topic sentence, you have to be clear on your topic, and to explore it through research.

Students have difficulty starting an essay because the whole task seems intimidating, and they are afraid of spending too much time on the topic sentence. Experienced writers, however, know that there is no set time to spend on figuring out your topic. It's a real exploration that is based to a large extent on intuition.

6 Steps to Write an Argumentative Essay (Persuasion Formula)

Use this checklist to tackle your essay one step at a time:

1. Research an issue with an arguable question

To start, you need to identify an issue that well-informed people have varying opinions on. Here, it’s helpful to think of one core topic and how it intersects with another (or several other) issues. That intersection is where hot takes and reasonable (or unreasonable) opinions abound. 

I find it helpful to stage the issue as a question.

For example: 

Is it better to legislate the minimum size of chicken enclosures or to outlaw the sale of eggs from chickens who don’t have enough space?

Should snow removal policies focus more on effectively keeping roads clear for traffic or the environmental impacts of snow removal methods?

Once you have your arguable question ready, start researching the basic facts and specific opinions and arguments on the issue. Do your best to stay focused on gathering information that is directly relevant to your topic. Depending on what your essay is for, you may reference academic studies, government reports, or newspaper articles.

‍ Research your opposition and the facts that support their viewpoint as much as you research your own position . You’ll need to address your opposition in your essay, so you’ll want to know their argument from the inside out.

2. Choose a side based on your research

You likely started with an inclination toward one side or the other, but your research should ultimately shape your perspective. So once you’ve completed the research, nail down your opinion and start articulating the what and why of your take. 

What: I think it’s better to outlaw selling eggs from chickens whose enclosures are too small.

Why: Because if you regulate the enclosure size directly, egg producers outside of the government’s jurisdiction could ship eggs into your territory and put nearby egg producers out of business by offering better prices because they don’t have the added cost of larger enclosures.

This is an early form of your thesis and the basic logic of your argument. You’ll want to iterate on this a few times and develop a one-sentence statement that sums up the thesis of your essay.

Thesis: Outlawing the sale of eggs from chickens with cramped living spaces is better for business than regulating the size of chicken enclosures.

Now that you’ve articulated your thesis , spell out the counterargument(s) as well. Putting your opposition’s take into words will help you throughout the rest of the essay-writing process. (You can start by choosing the counter argument option with Wordtune Spices .)

Counterargument: Outlawing the sale of eggs from chickens with too small enclosures will immediately drive up egg prices for consumers, making the low-cost protein source harder to afford — especially for low-income consumers.

There may be one main counterargument to articulate, or several. Write them all out and start thinking about how you’ll use evidence to address each of them or show why your argument is still the best option.

3. Organize the evidence — for your side and the opposition

You did all of that research for a reason. Now’s the time to use it. 

Hopefully, you kept detailed notes in a document, complete with links and titles of all your source material. Go through your research document and copy the evidence for your argument and your opposition’s into another document.

List the main points of your argument. Then, below each point, paste the evidence that backs them up.

If you’re writing about chicken enclosures, maybe you found evidence that shows the spread of disease among birds kept in close quarters is worse than among birds who have more space. Or maybe you found information that says eggs from free-range chickens are more flavorful or nutritious. Put that information next to the appropriate part of your argument. 

Repeat the process with your opposition’s argument: What information did you find that supports your opposition? Paste it beside your opposition’s argument.

You could also put information here that refutes your opposition, but organize it in a way that clearly tells you — at a glance — that the information disproves their point.

Counterargument: Outlawing the sale of eggs from chickens with too small enclosures will immediately drive up egg prices for consumers.

BUT: Sicknesses like avian flu spread more easily through small enclosures and could cause a shortage that would drive up egg prices naturally, so ensuring larger enclosures is still a better policy for consumers over the long term.

As you organize your research and see the evidence all together, start thinking through the best way to order your points.  

Will it be better to present your argument all at once or to break it up with opposition claims you can quickly refute? Would some points set up other points well? Does a more complicated point require that the reader understands a simpler point first?

Play around and rearrange your notes to see how your essay might flow one way or another.

4. Freewrite or outline to think through your argument

Is your brain buzzing yet? At this point in the process, it can be helpful to take out a notebook or open a fresh document and dump whatever you’re thinking on the page.

Where should your essay start? What ground-level information do you need to provide your readers before you can dive into the issue?

Use your organized evidence document from step 3 to think through your argument from beginning to end, and determine the structure of your essay.

There are three typical structures for argumentative essays:

  • Make your argument and tackle opposition claims one by one, as they come up in relation to the points of your argument - In this approach, the whole essay — from beginning to end — focuses on your argument, but as you make each point, you address the relevant opposition claims individually. This approach works well if your opposition’s views can be quickly explained and refuted and if they directly relate to specific points in your argument.
  • Make the bulk of your argument, and then address the opposition all at once in a paragraph (or a few) - This approach puts the opposition in its own section, separate from your main argument. After you’ve made your case, with ample evidence to convince your readers, you write about the opposition, explaining their viewpoint and supporting evidence — and showing readers why the opposition’s argument is unconvincing. Once you’ve addressed the opposition, you write a conclusion that sums up why your argument is the better one.
  • Open your essay by talking about the opposition and where it falls short. Build your entire argument to show how it is superior to that opposition - With this structure, you’re showing your readers “a better way” to address the issue. After opening your piece by showing how your opposition’s approaches fail, you launch into your argument, providing readers with ample evidence that backs you up.

As you think through your argument and examine your evidence document, consider which structure will serve your argument best. Sketch out an outline to give yourself a map to follow in the writing process. You could also rearrange your evidence document again to match your outline, so it will be easy to find what you need when you start writing.

5. Write your first draft

You have an outline and an organized document with all your points and evidence lined up and ready. Now you just have to write your essay.

In your first draft, focus on getting your ideas on the page. Your wording may not be perfect (whose is?), but you know what you’re trying to say — so even if you’re overly wordy and taking too much space to say what you need to say, put those words on the page.

Follow your outline, and draw from that evidence document to flesh out each point of your argument. Explain what the evidence means for your argument and your opposition. Connect the dots for your readers so they can follow you, point by point, and understand what you’re trying to say.

As you write, be sure to include:

1. Any background information your reader needs in order to understand the issue in question.

2. Evidence for both your argument and the counterargument(s). This shows that you’ve done your homework and builds trust with your reader, while also setting you up to make a more convincing argument. 3. A conclusion that sums up your overall argument and evidence — and leaves the reader with an understanding of the issue and its significance. This sort of conclusion brings your essay to a strong ending that doesn’t waste readers’ time, but actually adds value to your case.

6. Revise (with Wordtune)

The hard work is done: you have a first draft. Now, let’s fine tune your writing.

I like to step away from what I’ve written for a day (or at least a night of sleep) before attempting to revise. It helps me approach clunky phrases and rough transitions with fresh eyes. A good structure to ensure a well-written and effective argumentative essay includes:

Introduction

●  State your thesis statement, a one-to-two sentence summary of your claim.

●  This is the section where you’ll develop and expand on your argument.

●  It should be split into three or four coherent paragraphs, with each one presenting its own idea.

●  Start each paragraph with a topic sentence that indicates why readers should adopt your belief or stance.

●  Include your research, statistics, citations, and other supporting evidence.

●  Discuss opposing viewpoints and why they’re invalid.

●  This part typically consists of one paragraph.

●  Summarize your research and the findings that were presented.

●  Emphasize your initial thesis statement.

●  Persuade readers to agree with your stance.

How to write an argumentative essay

The argumentative essay is a staple in university courses, and writing this style of essay is a key skill for students across multiple disciplines. Here’s what you need to know to write an effective and compelling argumentative essay.

What is an argumentative essay?

An argumentative essay takes a stance on an issue and presents an argument to defend that stance with the intent of persuading the reader to agree. It generally requires extensive research into a topic so that you have a deep grasp of its subtleties and nuances, are able to take a position on the issue, and can make a detailed and logical case for one side or the other.

It’s not enough to merely have an opinion on an issue—you have to present points to justify your opinion, often using data and other supporting evidence.

When you are assigned an argumentative essay, you will typically be asked to take a position, usually in response to a question, and mount an argument for it. The question can be two-sided or open-ended, as in the examples provided below.

Examples of argumentative essay prompts:

Two-sided Question

Should completing a certain number of volunteer hours be a requirement to graduate from high school? Support your argument with evidence.

Open-ended Question

What is the most significant impact that social media has had on this generation of young people?

Once again, it’s important to remember that you’re not just conveying facts or information in an argumentative essay. In the course of researching your topic, you should develop a stance on the issue. Your essay will then express that stance and attempt to persuade the reader of its legitimacy and correctness through discussion, assessment, and evaluation.

The main types of argumentative essays

Although you are advancing a particular viewpoint, your argumentative essay must flow from a position of objectivity. Your argument should evolve thoughtfully and rationally from evidence and logic rather than emotion.

There are two main models that provide a good starting point for crafting your essay: the Toulmin model and the Rogerian model.

The Toulmin Model

This model is commonly used in academic essays. It mounts an argument through the following four steps:

  • Make a claim.
  • Present the evidence, or grounds, for the claim.
  • Explain how the grounds support the claim.
  • Address potential objections to the claim, demonstrating that you’ve given thought to the opposing side and identified its limitations and deficiencies.

As an example of how to put the Toulmin model into practice, here’s how you might structure an argument about the impact of devoting public funding to building low-income housing.

  • Make your claim that low-income housing effectively solves several social issues that drain a city’s resources, providing a significant return on investment.
  • Cite data that shows how an increase in low-income housing is related to a reduction in crime rates, homelessness, etc.
  • Explain how this data proves the beneficial impact of funding low-income housing.
  • Preemptively counter objections to your claim and use data to demonstrate whether these objections are valid or not.

The Rogerian Model

This model is also frequently used within academia, and it also builds an argument using four steps, although in a slightly different fashion:

  • Acknowledge the merits of the opposing position and what might compel people to agree with it.
  • Draw attention to the problems with this position.
  • Lay out your own position and identify how it resolves those problems.
  • Proffer some middle ground between the two viewpoints and make the case that proponents of the opposing position might benefit from adopting at least some elements of your view.

The persuasiveness of this model owes to the fact that it offers a balanced view of the issue and attempts to find a compromise. For this reason, it works especially well for topics that are polarizing and where it’s important to demonstrate that you’re arguing in good faith.

To illustrate, here’s how you could argue that smartphones should be permitted in classrooms.

  • Concede that smartphones can be a distraction for students.
  • Argue that what teachers view as disruptions are actually opportunities for learning.
  • Offer the view that smartphones, and students’ interest in them, can be harnessed as teaching tools.
  • Suggest teaching activities that involve smartphones as a potential resource for teachers who are not convinced of their value.

It’s not essential to adhere strictly to one model or the other—you can borrow elements from both models to structure your essay. However, no matter which model of argumentation you choose, your essay will need to have an outline that effectively presents and develops your position.

How to outline and write an argumentative essay

A clear and straightforward structure works best for argumentative essays since you want to make it easy for your reader to understand your position and follow your arguments. The traditional essay outline comprises an introductory paragraph that announces your thesis statement, body paragraphs that unfold your argument point by point, and a concluding paragraph that summarizes your thesis and supporting points.

Introductory paragraph

This paragraph provides an overview of your topic and any background information that your readers will need in order to understand the context and your position. It generally concludes with an explicit statement of your position on the topic, which is known as your thesis statement.

Over the last decade, smartphones have transformed nearly every aspect of our lives, socially, culturally, and personally. They are now incorporated into almost every facet of daily life, and this includes making their way into classrooms. There are many educators who view smartphones with suspicion and see them as a threat to the sanctity of the classroom. Although there are reasons to regard smartphones with caution, there are ways to use them responsibly to teach and educate the next generation of young minds. Indeed, the value they hold as teaching tools is nearly unlimited: as a way to teach digital literacy, to reach students through a medium that is familiar and fun for them, and to provide a nimble and adaptable learning environment.

Body paragraphs

Most argumentative essays have at least three body paragraphs that lay out the supporting points in favor of your argument. Each paragraph should open with a topic sentence that presents a separate point that is then fleshed out and backed up by research, facts, figures, data, and other evidence. Remember that your aim in writing an argumentative essay is to convince or persuade your reader, and your body paragraphs are where you present your most compelling pieces of information in order to do just that.

The body of your essay is also where you should address any opposing arguments and make your case against them, either disproving them or stating the reasons why you disagree. Responding to potential rebuttals strengthens your argument and builds your credibility with your readers.

A frequent objection that teachers have to smartphones in the classroom is that students use them to socialize when they should be learning. This view overlooks the fact that students are using smartphones to connect with each other and this is a valuable skill that should be encouraged, not discouraged, in the classroom. A 2014 study demonstrated the benefits of providing students with individual smartphones. Sanctioned smartphone use in the classroom proved to be of particular importance in improving educational outcomes for low-income and at-risk students. What’s more, learning apps have been developed specifically to take advantage of the potential of smartphones to reach learners of various levels and backgrounds, and many offer the ability to customize the method and delivery of lessons to individual learner preferences. This shows that the untapped potential of smartphones is huge, and many teachers would do well to consider incorporating them into their classrooms.

Your concluding paragraph wraps up your essay by restating your thesis and recapping the arguments you presented in your body paragraphs. No new information should be introduced in your conclusion, however, you may consider shifting the lens of your argument to make a comment on how this issue affects the world at large or you personally, always keeping in mind that objectivity and relevance are your guiding principles.

Smartphones have a growing place in the world of education, and despite the presence of legitimate concerns about their use, their value as teaching tools has been clearly established. With more and more of our lives going digital and with the growing emphasis on offering distance learning as an option, educators with an eye to the future won't wait to embrace smartphones and find ways to use them to their fullest effect. As much time and space as we could devote to weighing the pros and cons of smartphones, the fact is that they are not going to disappear from our lives, and our best bet is to develop their, and our students', potential.

Argumentative Essays

You may have heard it said that all writing is an argument of some kind. Even if you’re writing an informative essay, you still have the job of trying to convince your audience that the information is important. However, there are times you’ll be asked to write an essay that is specifically an argumentative piece.

An argumentative essay is one that makes a clear assertion or argument about some topic or issue. When you’re writing an argumentative essay, it’s important to remember that an academic argument is quite different from a regular, emotional argument. Note that sometimes students forget the academic aspect of an argumentative essay and write essays that are much too emotional for an academic audience. It’s important for you to choose a topic you feel passionately about (if you’re allowed to pick your topic), but you have to be sure you aren’t too emotionally attached to a topic. In an academic argument, you’ll have a lot more constraints you have to consider, and you’ll focus much more on logic and reasoning than emotions.

Argumentative essays are quite common in academic writing and are often an important part of writing in all disciplines. You may be asked to take a stand on a social issue in your introduction to writing course, but you could also be asked to take a stand on an issue related to health care in your nursing courses or make a case for solving a local environmental problem in your biology class. And, since argument is such a common essay assignment, it’s important to be aware of some basic elements of a good argumentative essay.

When your professor asks you to write an argumentative essay, you’ll often be given something specific to write about. For example, you may be asked to take a stand on an issue you have been discussing in class. Perhaps, in your education class, you would be asked to write about standardized testing in public schools. Or, in your literature class, you might be asked to argue the effects of protest literature on public policy in the United States.

However, there are times when you’ll be given a choice of topics. You might even be asked to write an argumentative essay on any topic related to your field of study or a topic you feel that is important personally.

Whatever the case, having some knowledge of some basic argumentative techniques or strategies will be helpful as you write. Below are some common types of arguments.

Causal Arguments

  • In this type of argument, you argue that something has caused something else. For example, you might explore the causes of the decline of large mammals in the world’s ocean and make a case for your cause.

Evaluation Arguments

  • In this type of argument, you make an argumentative evaluation of something as “good” or “bad,” but you need to establish the criteria for “good” or “bad.” For example, you might evaluate a children’s book for your education class, but you would need to establish clear criteria for your evaluation for your audience.

Proposal Arguments

  • In this type of argument, you must propose a solution to a problem. First, you must establish a clear problem and then propose a specific solution to that problem. For example, you might argue for a proposal that would increase retention rates at your college.

Narrative Arguments

  • In this type of argument, you make your case by telling a story with a clear point related to your argument. For example, you might write a narrative about your experiences with standardized testing in order to make a case for reform.

Rebuttal Arguments

  • In a rebuttal argument, you build your case around refuting an idea or ideas that have come before. In other words, your starting point is to challenge the ideas of the past.

Definition Arguments

  • In this type of argument, you use a definition as the starting point for making your case. For example, in a definition argument, you might argue that NCAA basketball players should be defined as professional players and, therefore, should be paid.

10 English Phrases to Express Your Opinion in an Essay

I admire international students. Seriously.  If you’re a non-native English speaker doing a degree or doctorate in English, then I take my hat off to you.

I get a lot of questions about writing essays, and I’ve taught hundreds of students how to write effective essays (which get good grades).  One of the most common mistakes that I see is a lack of opinion.

Most of the time, students describe a situation, but they don’t give their opinion or stance. This can really damage your grade because lecturers are always looking for ‘critical thinking’. If you don’t give your opinion in your essays, your lecturers can’t see your critical thinking.

To put it simply: If you don’t put your opinion or stance in an essay, then you’ll probably lose marks.

In this article, you’ll learn 10 effective phrases that you can use to give your opinion in your essay.  I’ve also created a free lesson pack which will help you to practice the phrases in this article. CLICK HERE to download it.

Introducing the Phrases

If you’re looking for a quick fix for your essay, these phrases should help you to start putting your own opinions in your essays.

But, before you rush over to your essays to start putting these phrases in, there’s something you need to know.

If you’re writing an academic essay, you will need to support your opinions with strong evidence . This is especially true if you are using some of the stronger phrases.

This evidence can be a journal article, a lecture, a textbook, or something else which is a trustworthy source of information.

In a more informal essay, like one in an IELTS or TOEFL language test, you don’t need to support your answers with strong evidence. Your experiences or opinions will be enough.

10 English Phrases to Express Your Opinion in an Essay Espresso English

Informal English Phrases

These phrases are suitable for language tests such as TOEFL or IELTS. In an academic essay, these phrases will probably be too informal because they are too personal.

“In my opinion, + [your sentence]”

  • In my opinion , a good education is more important than a good car.

“I believe that + [your sentence]”

  • I believe that schools should encourage students to walk or cycle to school rather than drive.

“In my mind, + [your sentence]”

  • “ In my mind , no-one should have to pay for medical care.”

More Formal Academic Phrases With ‘That’

These phrases are more suitable for academic essays. If you are unsure whether you should use an informal phrase or an academic phrase, use an academic one. If you think your writing might be informal, read this post to learn more.

The patterns here are quite straightforward. Just add your sentence after ‘that’.

“It would seem that + [your sentence]”

Use this when you support your opinion with evidence.

  • “ It would seem that children learn best when they are feeling comfortable.”

“It could be argued that + [your sentence]”

Use this when you want to challenge an existing opinion.

  • “ It could be argued that the benefits outweigh the drawbacks in this situation.”

“This suggests that + [your sentence]”

Use this when you don’t want to fully commit to an opinion. You’re giving yourself some distance.

  • “ The evidence suggests that people who speak more than one language have more job opportunities.”

“This proves that + [your sentence]”

Use this when you are confident with your opinion. This phrase is quite strong*

  • “ This proves that the best way to lose weight is through a controlled diet and a good exercise program.”

“This supports the idea that + [your sentence]”

Use this one when you are supporting an opinion that you have already made.

  • “ This new research supports the idea that successful English learners look for opportunities to use English.”

Other Ways to Express Opinion

“although [idea you disagree with], [idea you agree with]”.

Use this when you want make your opinion seem balanced.

  • “ Although reports suggest that cigarettes could help people to lose weight, there are too many serious health problems associated with smoking.”

Note: The ‘ although’ pattern is very effective because it shows two sides of the argument. In the example, I support the idea that smoking is bad for your health –BUT- I recognise that it could have some benefits.

Structure your ‘ although’ sentence like this: Although, [weaker argument you disagree with], [stronger argument you agree with].

Using Adverbs, Adjectives and Nouns

You can use adjectives to show your opinion.

  • “This research was poorly conducted with a lack of control .”

The adjective and nouns in the example are negative . You can get some good ideas from this video on Extreme Adjectives . Note: try not to use any emotional adjectives .

Make Your Own Phrases!

Of course, these phrases aren’t the only ones that you can use! You can find more – or – you can create your own by combining different patterns.

Here’s an example of #7, #9 and #10 used together.

“Although it is difficult for older adults to learn a second language, an important study by Smith (2014) proved that the elderly can successfully learn new languages.”

What Should You Do Now?

So now you should have a better idea of how to include more opinions in your essays. But that’s not all; there are probably some new words here that you don’t know.

So here’s what you should do:

  • Choose three of the opinion expressions and phrases that you want to try.
  • Practice writing sentences using them (if you don’t have a topic, try this: should students do homework? You can see examples of this in the lesson pack )

Can You Use “I Believe” in an Essay?

You can use “I believe” in an essay, but you should only use it once. It’s not something you should repeat if you can avoid it.

It’s okay to use in an argumentative essay . After all, it suggests you have an argument to share that provides your honest opinion about something.

However, it is bad to use if you repeat it too much . Try to avoid using it more than once. Stick to alternatives to keep things interesting.

Here’s an example to help you understand it:

I believe this is the best way to go about the situation. I’m certain we can find common ground.

1. From Where I Stand

You can write “from where I stand” instead of “I believe” in an essay. It works well in academic writing because it’s very professional and unbiased .

It suggests you have an opinion , but you’re willing to debate with the reader. We recommend using it if you’re trying to write a more argumentative essay.

After all, it’s a great way to capture the reader’s attention. It suggests you’re willing to hear them out (even though they can’t talk to you).

Here are some great examples to help you:

From where I stand , this is the only way to tackle the situation. There are no alternatives.

From where I stand , this is the best course of action. Therefore, I think we should capitalize on it.

2. My Take Is

For a more direct alternative, you can write “my take is.” It’s another way to say “I believe” in an essay.

Saying you have a “take” suggests you believe something that others might not . It’s useful because it shares an opinion that you don’t expect the reader to share with you.

It’s just a simple way to share your idea and debate the different sides.

Review these examples if you’re still unsure:

My take is that we can’t find a better solution for this. It’s the only way the project can continue.

My take is argued a lot, but it happens to suggest the best way to move forward.

3. In My Opinion

One of the most common alternatives to “I believe” is “in my opinion.” It’s highly effective because it’s formal and respectful .

It’s a considerate phrase that suggests you’re only sharing your thoughts . It doesn’t imply that the reader is wrong if they don’t share the same opinion as you.

We recommend using it to keep your essay unbiased. It’s especially effective if you’re not trying to antagonize the reader.

You may even refer to the following examples:

In my opinion , this isn’t the only option. However, it is the only option that doesn’t cost the company more money.

In my opinion , they made a mistake in their judgment. Now, everyone has to pay for it.

4. It Seems to Me

If you want to know how to say “I believe” in an essay without saying I, you can start with “it seems to me.”

It’s a great way to start a sentence sharing an opinion . We recommend using it to express your views , even if you’re not convinced your views are correct.

This phrase works incredibly well in most formal writing . It’s useful in academic cases because it shows you’re open to exploring your ideas and what “seems” to be correct.

You can also review these examples:

It seems to me this whole situation could have been resolved sooner. Unfortunately, nobody wanted to listen.

It seems to me there are more ways to create problems for them. This battle is far from over.

5. I’m of the Opinion That

For a slightly wordier alternative, you can use “I’m of the opinion that.” Of course, it’s a bit redundant , meaning you should only use it once in an essay.

The more you use this phrase, the less impactful it’ll sound throughout your essay.

Don’t get us wrong; it’s still effective. However, it’s something you should only include to mix things up and keep your writing fresh whenever possible.

Generally, this works well in academic writing. It shows you’re open to new opinions and will express different viewpoints in your essay.

Here are some examples to help you understand more about it:

I’m of the opinion that they didn’t need to advance to the frontline. The war did not need to continue.

I’m of the opinion that this was the best way to complete the project. I would like to hear if this isn’t the case.

6. As Far as I Know

You may use “as far as I know” instead of “I believe” as well. It’s another word for “I believe” in an essay that shows you’re exploring your ideas and talking about your opinions.

Generally, this phrase makes it clear that you don’t claim to know everything . It suggests to the reader that you’re willing to hear different views before concluding anything.

Therefore, this is a great way to remain unbiased in your writing. You should absolutely try to include it to keep things interesting.

7. My Position Is

Sharing your position (i.e., your opinion) in an essay is an excellent choice. It works well argumentatively because it shows where you stand and whether you’re willing to change your mind.

When gathering evidence, use credible sources . To determine the credibility of the source, consider authority, currency, accuracy, and objectivity:

Who is the author ? Are they an expert in the field? Has a reputable publisher published the work?

How current is the information in the source? Does the currency of the source matter? Does the age of the source impact the content? Is there newer information that disproves the source’s information?

Can other sources verify the accuracy of the information? Does the information contradict that found in other commonly accepted sources?

There are many reasons for a stimulating statement to surprise a reader. Sometimes it is joyful; sometimes it is shocking; sometimes it is surprising because of who said it.

An interesting incident or anecdote can act as a teaser to lure the reader into the remainder of the essay. Be sure that the device is appropriate for the subject and focus of what follows.

Provide the reader with relevant context and background information necessary to understand the topic.

Conclude with a thesis statement that identifies the overall purpose of the essay (topic and position). Writers can also include their support directly in the thesis, which outlines the structure of the essay for the reader.

Avoid the following when writing the introduction to argumentative writing:

Starting with dictionary definitions is too overdone and unappealing.

Do not make an announcement of the topic like “In this paper I will…” or “The purpose of this essay is to….”

Evidence supporting or developing the thesis should be in the body paragraphs, not the introduction.

Beginning the essay with general or absolute statements such as “throughout history...” or “as human beings we always...” or similar statements suggest the writer knows all of history or that all people behave or think in the same way.

Argumentative essay thesis

The thesis statement is the single, specific claim the writer sets out to prove and is typically positioned as the last sentence of the introduction . It is the controlling idea of the entire argument that identifies the topic, position, and reasoning.

When constructing a thesis for an argumentative paper, make sure it contains a side of the argument, not simply a topic. An argumentative thesis identifies the writer’s position on a given topic. If a position cannot be taken, then it is not argumentative thesis:

Topic: Capital punishment is practiced in many states.

Thesis: Capital punishment should be illegal.

While not always required, the thesis statement can include the supports the writer will use to prove the main claim. Therefore, a thesis statement can be structured as follows:

TOPIC + POSITION (+ SUPPORTS)

No Supports: College athletes (TOPIC) should be financially compensated (POSITION).

Supports: College athletes (TOPIC) should be financially compensated (POSITION) because they sacrifice their minds and bodies (SUPPORT 1), cannot hold

Argumentative essay body paragraphs

Body paragraphs can be of varying lengths, but they must present a coherent argument unified under a single topic. They are rarely ever longer than one page, double-spaced; usually they are much shorter.

Lengthy paragraphs indicate a lack of structure. Identify the main ideas of a lengthy paragraph to determine if they make more sense as separate topics in separate paragraphs.

Shorter paragraphs usually indicate a lack of substance; there is not enough evidence or analysis to prove the argument. Develop the ideas more or integrate the information into another paragraph.

The structure of an argumentative paragraph should include a topic sentence, evidence, and a transition.

The topic sentence is the thesis of the paragraph that identifies the arguable point in support of the main argument. The reader should know exactly what the writer is trying to prove within the paragraph by reading the first sentence.

The supporting evidence and analysis provide information to support the claim. There should be a balance between the evidence (facts, quotations, summary of events/plot, etc.) and analysis (interpretation of evidence). If the paragraph is evidence-heavy, there is not much of an argument; if it is analysis-heavy, there is not enough evidence in support of the claim.

The transition can be at the beginning or the end of a paragraph. However, it is much easier to combine the transition with the concluding observation to help the paragraphs flow into one another. Transitions in academic writing should tell the reader where you were, where you are going, and relate to the thesis.

Some essays may benefit from the inclusion of rebuttals to potential counterarguments of the writer’s position.

Argumentative essay conclusion

The conclusion should make readers glad they read the paper. It can suggest broader implications that will not only interest readers but also enrich their understanding in some way. There are three aspects to follow when constructing the conclusion: rephrase the thesis, synthesize information, and call the reader to action.

Rephrased the thesis in the first sentence of the conclusion. It must be in different words; do not simply write it verbatim.

Synthesize the argument by showing how the paper's main points support the argument.

Propose a course of action or a solution to an issue. This can redirect the reader's thought process to apply the ideas to their life or to see the broader implications of the topic.

Avoid the following when constructing the conclusion:

Beginning with an unnecessary, overused phrase such as "in conclusion," "in summary," or "in closing;" although these phrases can work in speeches, they come across as trite in writing

Introducing a new idea or subtopic in the conclusion

Making sentimental, emotional appeals that are out of character with the rest of the paper

Including evidence (quotations, statistics, etc.) that should be in the body of the paper

Using “I” in Academic Writing

Traditionally, some fields have frowned on the use of the first-person singular in an academic essay and others have encouraged that use, and both the frowning and the encouraging persist today—and there are good reasons for both positions (see “Should I”).

I recommend that you not look on the question of using “I” in an academic paper as a matter of a rule to follow, as part of a political agenda (see webb), or even as the need to create a strategy to avoid falling into Scylla-or-Charybdis error. Let the first-person singular be, instead, a tool that you take out when you think it’s needed and that you leave in the toolbox when you think it’s not.

Examples of When “I” May Be Needed

  • You are narrating how you made a discovery, and the process of your discovering is important or at the very least entertaining.
  • You are describing how you teach something and how your students have responded or respond.
  • You disagree with another scholar and want to stress that you are not waving the banner of absolute truth.
  • You need “I” for rhetorical effect, to be clear, simple, or direct.

Examples of When “I” Should Be Given a Rest

  • It’s off-putting to readers, generally, when “I” appears too often. You may not feel one bit modest, but remember the advice of Benjamin Franklin, still excellent, on the wisdom of preserving the semblance of modesty when your purpose is to convince others.
  • You are the author of your paper, so if an opinion is expressed in it, it is usually clear that this opinion is yours. You don’t have to add a phrase like, “I believe” or “it seems to me.”

I discourage the use of "I" in essays for undergraduates to reinforce a conversational tone and to "self-recognize" the writer as an authority or at least a thorough researcher. Writing a play is different than an essay with a purpose.

This passion should be clear in his/her expression. However, I encourage the use of the first-person, I, sparingly -- only when and where absolutely necessary.

Should I Use “I”?

What this handout is about.

This handout is about determining when to use first person pronouns (“I”, “we,” “me,” “us,” “my,” and “our”) and personal experience in academic writing. “First person” and “personal experience” might sound like two ways of saying the same thing, but first person and personal experience can work in very different ways in your writing. You might choose to use “I” but not make any reference to your individual experiences in a particular paper. Or you might include a brief description of an experience that could help illustrate a point you’re making without ever using the word “I.” So whether or not you should use first person and personal experience are really two separate questions, both of which this handout addresses. It also offers some alternatives if you decide that either “I” or personal experience isn’t appropriate for your project. If you’ve decided that you do want to use one of them, this handout offers some ideas about how to do so effectively, because in many cases using one or the other might strengthen your writing.

Expectations about academic writing

Students often arrive at college with strict lists of writing rules in mind. Often these are rather strict lists of absolutes, including rules both stated and unstated:

  • Each essay should have exactly five paragraphs.
  • Don’t begin a sentence with “and” or “because.”
  • Never include personal opinion.
  • Never use “I” in essays.

We get these ideas primarily from teachers and other students. Often these ideas are derived from good advice but have been turned into unnecessarily strict rules in our minds. The problem is that overly strict rules about writing can prevent us, as writers, from being flexible enough to learn to adapt to the writing styles of different fields, ranging from the sciences to the humanities, and different kinds of writing projects, ranging from reviews to research.

So when it suits your purpose as a scholar, you will probably need to break some of the old rules, particularly the rules that prohibit first person pronouns and personal experience. Although there are certainly some instructors who think that these rules should be followed (so it is a good idea to ask directly), many instructors in all kinds of fields are finding reason to depart from these rules. Avoiding “I” can lead to awkwardness and vagueness, whereas using it in your writing can improve style and clarity. Using personal experience, when relevant, can add concreteness and even authority to writing that might otherwise be vague and impersonal. Because college writing situations vary widely in terms of stylistic conventions, tone, audience, and purpose, the trick is deciphering the conventions of your writing context and determining how your purpose and audience affect the way you write. The rest of this handout is devoted to strategies for figuring out when to use “I” and personal experience.

Effective uses of “I”:

In many cases, using the first person pronoun can improve your writing, by offering the following benefits:

  • Assertiveness: In some cases you might wish to emphasize agency (who is doing what), as for instance if you need to point out how valuable your particular project is to an academic discipline or to claim your unique perspective or argument.
  • Clarity: Because trying to avoid the first person can lead to awkward constructions and vagueness, using the first person can improve your writing style.
  • Positioning yourself in the essay: In some projects, you need to explain how your research or ideas build on or depart from the work of others, in which case you’ll need to say “I,” “we,” “my,” or “our”; if you wish to claim some kind of authority on the topic, first person may help you do so.

Deciding whether “I” will help your style

Here is an example of how using the first person can make the writing clearer and more assertive:

Original example:

In studying American popular culture of the 1980s, the question of to what degree materialism was a major characteristic of the cultural milieu was explored.

Better example using first person:

In our study of American popular culture of the 1980s, we explored the degree to which materialism characterized the cultural milieu.

The original example sounds less emphatic and direct than the revised version; using “I” allows the writers to avoid the convoluted construction of the original and clarifies who did what.

Here is an example in which alternatives to the first person would be more appropriate:

As I observed the communication styles of first-year Carolina women, I noticed frequent use of non-verbal cues.

Better example:

A study of the communication styles of first-year Carolina women revealed frequent use of non-verbal cues.

In the original example, using the first person grounds the experience heavily in the writer’s subjective, individual perspective, but the writer’s purpose is to describe a phenomenon that is in fact objective or independent of that perspective. Avoiding the first person here creates the desired impression of an observed phenomenon that could be reproduced and also creates a stronger, clearer statement.

Here’s another example in which an alternative to first person works better:

As I was reading this study of medieval village life, I noticed that social class tended to be clearly defined.

This study of medieval village life reveals that social class tended to be clearly defined.

Although you may run across instructors who find the casual style of the original example refreshing, they are probably rare. The revised version sounds more academic and renders the statement more assertive and direct.

Here’s a final example:

I think that Aristotle’s ethical arguments are logical and readily applicable to contemporary cases, or at least it seems that way to me.

Better example

Aristotle’s ethical arguments are logical and readily applicable to contemporary cases.

In this example, there is no real need to announce that that statement about Aristotle is your thought; this is your paper, so readers will assume that the ideas in it are yours.

Determining whether to use “I” according to the conventions of the academic field

Which fields allow “I”?

The rules for this are changing, so it’s always best to ask your instructor if you’re not sure about using first person. But here are some general guidelines.

Sciences: In the past, scientific writers avoided the use of “I” because scientists often view the first person as interfering with the impression of objectivity and impersonality they are seeking to create. But conventions seem to be changing in some cases—for instance, when a scientific writer is describing a project she is working on or positioning that project within the existing research on the topic. Check with your science instructor to find out whether it’s o.k. to use “I” in their class.

Social Sciences: Some social scientists try to avoid “I” for the same reasons that other scientists do. But first person is becoming more commonly accepted, especially when the writer is describing their project or perspective.

Humanities: Ask your instructor whether you should use “I.” The purpose of writing in the humanities is generally to offer your own analysis of language, ideas, or a work of art. Writers in these fields tend to value assertiveness and to emphasize agency (who’s doing what), so the first person is often—but not always—appropriate. Sometimes writers use the first person in a less effective way, preceding an assertion with “I think,” “I feel,” or “I believe” as if such a phrase could replace a real defense of an argument. While your audience is generally interested in your perspective in the humanities fields, readers do expect you to fully argue, support, and illustrate your assertions. Personal belief or opinion is generally not sufficient in itself; you will need evidence of some kind to convince your reader.

Other writing situations: If you’re writing a speech, use of the first and even the second person (“you”) is generally encouraged because these personal pronouns can create a desirable sense of connection between speaker and listener and can contribute to the sense that the speaker is sincere and involved in the issue. If you’re writing a resume, though, avoid the first person; describe your experience, education, and skills without using a personal pronoun (for example, under “Experience” you might write “Volunteered as a peer counselor”).

A note on the second person “you”:

In situations where your intention is to sound conversational and friendly because it suits your purpose, as it does in this handout intended to offer helpful advice, or in a letter or speech, “you” might help to create just the sense of familiarity you’re after. But in most academic writing situations, “you” sounds overly conversational, as for instance in a claim like “when you read the poem ‘The Wasteland,’ you feel a sense of emptiness.” In this case, the “you” sounds overly conversational. The statement would read better as “The poem ‘The Wasteland’ creates a sense of emptiness.” Academic writers almost always use alternatives to the second person pronoun, such as “one,” “the reader,” or “people.”

Personal experience in academic writing

The question of whether personal experience has a place in academic writing depends on context and purpose. In papers that seek to analyze an objective principle or data as in science papers, or in papers for a field that explicitly tries to minimize the effect of the researcher’s presence such as anthropology, personal experience would probably distract from your purpose. But sometimes you might need to explicitly situate your position as researcher in relation to your subject of study. Or if your purpose is to present your individual response to a work of art, to offer examples of how an idea or theory might apply to life, or to use experience as evidence or a demonstration of an abstract principle, personal experience might have a legitimate role to play in your academic writing. Using personal experience effectively usually means keeping it in the service of your argument, as opposed to letting it become an end in itself or take over the paper.

It’s also usually best to keep your real or hypothetical stories brief, but they can strengthen arguments in need of concrete illustrations or even just a little more vitality.

Here are some examples of effective ways to incorporate personal experience in academic writing:

  • Anecdotes: In some cases, brief examples of experiences you’ve had or witnessed may serve as useful illustrations of a point you’re arguing or a theory you’re evaluating. For instance, in philosophical arguments, writers often use a real or hypothetical situation to illustrate abstract ideas and principles.
  • References to your own experience can explain your interest in an issue or even help to establish your authority on a topic.
  • Some specific writing situations, such as application essays, explicitly call for discussion of personal experience.

Here are some suggestions about including personal experience in writing for specific fields:

Philosophy: In philosophical writing, your purpose is generally to reconstruct or evaluate an existing argument, and/or to generate your own. Sometimes, doing this effectively may involve offering a hypothetical example or an illustration. In these cases, you might find that inventing or recounting a scenario that you’ve experienced or witnessed could help demonstrate your point. Personal experience can play a very useful role in your philosophy papers, as long as you always explain to the reader how the experience is related to your argument. Religion: Religion courses might seem like a place where personal experience would be welcomed. But most religion courses take a cultural, historical, or textual approach, and these generally require objectivity and impersonality. So although you probably have very strong beliefs or powerful experiences in this area that might motivate your interest in the field, they shouldn’t supplant scholarly analysis. But ask your instructor, as it is possible that they are interested in your personal experiences with religion, especially in less formal assignments such as response papers. Literature, Music, Fine Arts, and Film: Writing projects in these fields can sometimes benefit from the inclusion of personal experience, as long as it isn’t tangential. For instance, your annoyance over your roommate’s habits might not add much to an analysis of “Citizen Kane.” However, if you’re writing about Ridley Scott’s treatment of relationships between women in the movie “Thelma and Louise,” some reference your own observations about these relationships might be relevant if it adds to your analysis of the film. Personal experience can be especially appropriate in a response paper, or in any kind of assignment that asks about your experience of the work as a reader or viewer. Some film and literature scholars are interested in how a film or literary text is received by different audiences, so a discussion of how a particular viewer or reader experiences or identifies with the piece would probably be appropriate. Women’s Studies: Women’s Studies classes tend to be taught from a feminist perspective, a perspective which is generally interested in the ways in which individuals experience gender roles. So personal experience can often serve as evidence for your analytical and argumentative papers in this field. This field is also one in which you might be asked to keep a journal, a kind of writing that requires you to apply theoretical concepts to your experiences.

History: If you’re analyzing a historical period or issue, personal experience is less likely to advance your purpose of objectivity. However, some kinds of historical scholarship do involve the exploration of personal histories. So although you might not be referencing your own experience, you might very well be discussing other people’s experiences as illustrations of their historical contexts. Sciences: Because the primary purpose is to study data and fixed principles in an objective way, personal experience is less likely to have a place in this kind of writing. Often, as in a lab report, your goal is to describe observations in such a way that a reader could duplicate the experiment, so the less extra information, the better. Of course, if you’re working in the social sciences, case studies—accounts of the personal experiences of other people—are a crucial part of your scholarship. When you write an academic essay, you make an argument: you propose a thesis and offer some reasoning, using evidence, that suggests why the thesis is true. When you counter-argue, you consider a possible argument  against  your thesis or some aspect of your reasoning. This is a good way to test your ideas when drafting, while you still have time to revise them. And in the finished essay, it can be a persuasive and (in both senses of the word) disarming tactic. It allows you to anticipate doubts and pre-empt objections that a skeptical reader might have; it presents you as the kind of person who weighs alternatives before arguing for one, who confronts difficulties instead of sweeping them under the rug, who is more interested in discovering the truth than winning a point.

Not every objection is worth entertaining, of course, and you shouldn't include one just to include one. But some imagining of other views, or of resistance to one's own, occurs in most good essays. And instructors are glad to encounter counterargument in student papers, even if they haven't specifically asked for it.

The Turn Against

Counterargument in an essay has two stages: you turn against your argument to challenge it and then you turn back to re-affirm it. You first imagine a skeptical reader, or cite an actual source, who might resist your argument by pointing out

  • a problem with your demonstration, e.g., that a different conclusion could be drawn from the same facts, a key assumption is unwarranted, a key term is used unfairly, certain evidence is ignored or played down;
  • one or more disadvantages or practical drawbacks to what you propose;
  • an alternative explanation or proposal that makes more sense.

You introduce this turn against with a phrase like  One might object here that...  or  It might seem that...  or  It's true that...  or  Admittedly,...  or  Of course,...  or with an anticipated challenging question:  But how...?  or  But why...?  or  But isn't this just...?  or  But if this is so, what about...?  Then you state the case against yourself as briefly but as clearly and forcefully as you can, pointing to evidence where possible. (An obviously feeble or perfunctory counterargument does more harm than good.)

The Turn Back

Your return to your own argument—which you announce with a  but, yet, however, nevertheless or still —must likewise involve careful reasoning, not a flippant (or nervous) dismissal. In reasoning about the proposed counterargument, you may

  • refute it, showing why it is mistaken—an apparent but not real problem;
  • acknowledge its validity or plausibility, but suggest why on balance it's relatively less important or less likely than what you propose, and thus doesn't overturn it;
  • concede its force and complicate your idea accordingly—restate your thesis in a more exact, qualified, or nuanced way that takes account of the objection, or start a new section in which you consider your topic in light of it. This will work if the counterargument concerns only an aspect of your argument; if it undermines your whole case, you need a new thesis.

Where to Put a Counterargument

Counterargument can appear anywhere in the essay, but it most commonly appears

  • as part of your introduction—before you propose your thesis—where the existence of a different view is the motive for your essay, the reason it needs writing;
  • as a section or paragraph just after your introduction, in which you lay out the expected reaction or standard position before turning away to develop your own;
  • as a quick move within a paragraph, where you imagine a counterargument not to your main idea but to the sub-idea that the paragraph is arguing or is about to argue;
  • as a section or paragraph just before the conclusion of your essay, in which you imagine what someone might object to what you have argued.

But watch that you don't overdo it. A turn into counterargument here and there will sharpen and energize your essay, but too many such turns will have the reverse effect by obscuring your main idea or suggesting that you're ambivalent.

Counterargument in Pre-Writing and Revising

Good thinking constantly questions itself, as Socrates observed long ago. But at some point in the process of composing an essay, you need to switch off the questioning in your head and make a case. Having such an inner conversation during the drafting stage, however, can help you settle on a case worth making. As you consider possible theses and begin to work on your draft, ask yourself how an intelligent person might plausibly disagree with you or see matters differently. When you can imagine an intelligent disagreement, you have an arguable idea.

And, of course, the disagreeing reader doesn't need to be in your head: if, as you're starting work on an essay, you ask a few people around you what  they  think of topic X (or of your idea about X) and keep alert for uncongenial remarks in class discussion and in assigned readings, you'll encounter a useful disagreement somewhere. Awareness of this disagreement, however you use it in your essay, will force you to sharpen your own thinking as you compose. If you come to find the counterargument truer than your thesis, consider making  it  your thesis and turning your original thesis into a counterargument. If you manage to draft an essay  without  imagining a counterargument, make yourself imagine one before you revise and see if you can integrate it.

Here are some ways you can use “it could be argued”:

  • It could be argued that teaching Shakespeare in school only serves to confuse students due to the extremely antiquated language.
  • It could be argued that the color blue represents sadness, but there are many examples in the text that point to blue instead representing loneliness.
  • The bird could be a representation of her fear. Conversely, it could be argued that the bird is there simply because the lead character loves birds.

Many Believe

“Many believe” is useful when you want to discuss widely held beliefs and the fact that these beliefs are widely held is common knowledge. You can also use “many believe” when you have a statistic to back up the claim.

“Many believe” is better than “I think” and “I believe” in those sorts of situations because it creates a less personal statement. That helps it feel more formal and makes the argument feel more expansive.

  • The students who got more recess time did better on tests than children who had more quiet study time. This proves that children need more playtime throughout the day.
  • This proves my original hypothesis, though not in the way I expected.

This Supports The Idea

This is another useful phrase for directly tying previously stated evidence to your arguments and conclusions. Once you provide your evidence, you can go into your argument by saying “this supports the idea that…”

It’s Time to Treat Sugar Like Cigarettes

T he food we eat impacts every aspect of our lives and our bodies: our hormones, brain chemistry, immune system, microbiome; the list goes on. As consumers, we deserve the right to easily understand our foods’ nutritional value in order to make informed decisions about what we consume and how that will impact our health and well being. This is especially important when it comes to ingredients that are detrimental when eaten in excess, such as sugar. As researchers in functional medicine, longevity, AI, and nutrition, as well as inventors of health-enhancing and life-saving solutions, we have dedicated our professional lives to improving the health and well-being of millions everywhere. And while we applaud the Food and Drug Administration (FDA) taking important strides to pass mandatory front-of-package labeling for packaged foods in the U.S., this is a change that cannot come soon enough. Everyone’s health depends on it. 

The FDA recommends adults consume no more than 50 grams of added sugar per day (based on a 2,000 calorie diet), but the average American consumes closer to one-third of a pound of sugar daily, more than three times the recommended amount. To put that into perspective, the average American consumes over 100 pounds of sugar per person per year. With that much sugar consumption, it is no wonder that 49% of American adults are diabetic or pre-diabetic. What’s worse is that much of the sugar we consume occurs without our even realizing it. There are over 60 different ways sugar is identified on nutrition labels, making a consumer’s attempt to regulate their sugar intake unfairly complicated.

Extensive academic research published in medical peer-reviewed journals backs common knowledge that excess sugar consumption can lead to serious chronic conditions , as well as fatigue , anxiety , memory loss , ADHD , and even to a shorter life .

Seventy four percent of packaged foods in the U.S. contain added sugar, including seemingly healthy foods, such as salad dressing, coleslaw, and even baked beans, marinades, and yogurt; some sweetened yogurts contain more sugar than a can of soda. The fact that sugar is so biologically addictive — studies indicate it is eight times more addictive than cocaine — makes the reality that it’s hidden in so many foods even more harmful. Most of us are addicted to sugar and we don’t even know it.

This cycle of addiction is relentless and hard to break: we eat food with sugar, which then triggers a blood sugar spike, which lights up the pleasure center in our brain. When the inevitable sugar crash comes, we seek that spike again in the form of craving more sugar. Without easily discernible food labeling, shoppers unknowingly create this cycle inside their own bodies, even while they erroneously think the food they’re buying is healthy.

In many countries, labels on packaged foods serve a similar function to labels on cigarette cartons: to warn consumers of risk. In Chile , a policy of “high in” labels on the front of sugary drinks dramatically reduced the consumption of those beverages. In Israel, a front-of-package labelling system , wherein a red label indicates an item high in sugar, has led to significant positive changes in 76% of the population’s food buying habits. We’re excited to see what a similar program in the U.S. would yield.

Those in the U.S. lobbying against this front-of-package change, unsurprisingly, have an interest in the continued popularity of their products. In a February 2023 joint filing , the nation’s largest cereal producers threatened a lawsuit after proposed changes would not allow them to label products as “healthy” if they didn’t meet nutritional standards. The front-of-package suggested change would rightfully prevent many cereals on the market with excess sugar from calling themselves “healthy.”

This dynamic is similar to changes made in cigarette advertising in the 20th century. In the 1940s, a famous Camel cigarettes campaign featured the slogan , “More doctors smoke Camels.” By 1969, a mandatory warning label was added to cigarettes, giving consumers clearer access to information about risks, allowing them to make more informed choices about their health. Today the percentage of Americans who smoke is 11% compared to nearly 50% back in the day when “more doctors smoked Camels”. Life expectancy rose nearly 11 years in that span of time too, and the decrease in smoking certainly contributed.

While front-of-package labeling on packaged foods is a crucial first step towards a healthier society, education and awareness alone will only get us so far. To drive even more significant change in the way most Americans eat, a change that will lead to a healthier population, we must also incentivize the production and widespread distribution of healthier alternatives. These alternatives—a packaged cookie with healthier ingredients, for instance—must be just as delicious, and readily available as those loaded with sugar. The recently announced new standards by the U.S. Department of Agriculture (USDA) that will limit added sugars in school meals can greatly help with the availability of healthier alternatives, especially when children form their eating habits. For the rest of us, though, front-of-package labeling is an important step one in this journey towards national wellness and it will also encourage producers to create healthier options for consumers; readily available healthier alternatives is step two.

FDA leadership ensuring labeling of high contents of sugar in packaged foods could increase awareness and reduce the negative impacts of sugar and help millions live healthier longer lives. This change would help us make more informed choices about our food and our health. We believe it is our right, and every American’s right, to have clear and visible information about the sugar content of the foods we are eating in order to make more informed decisions.

For three long years, Supreme Court watchers mollified themselves (and others) with vague promises that when the rubber hit the road, even the ultraconservative Federalist Society justices of the Roberts court would put democracy before party whenever they were finally confronted with the legal effort to hold Donald Trump accountable for Jan. 6. There were promising signs: They had, after all, refused to wade into the Trumpian efforts to set aside the election results in 2020. They had, after all, hewed to a kind of sanity in batting away Trumpist claims about presidential records (with the lone exception of Clarence Thomas, too long marinated in the Ginni-scented Kool-Aid to be capable of surprising us, but he was just one vote). We promised ourselves that there would be cool heads and grand bargains and that even though the court might sometimes help Trump in small ways, it would privilege the country in the end. We kept thinking that at least for Justices Brett Kavanaugh and Neil Gorsuch and Chief Justice John Roberts , the voice of reasoned never-Trumpers might still penetrate the Fox News fog. We told ourselves that at least six justices, and maybe even seven, of the most MAGA-friendly court in history would still want to ensure that this November’s elections would not be the last in history. Political hacks they may be, but they were not lawless ones.

On Thursday, during oral arguments in Trump v. United States , the Republican-appointed justices shattered those illusions. This was the case we had been waiting for, and all was made clear—brutally so. These justices donned the attitude of cynical partisans, repeatedly lending legitimacy to the former president’s outrageous claims of immunity from criminal prosecution. To at least five of the conservatives, the real threat to democracy wasn’t Trump’s attempt to overturn the election—but the Justice Department’s efforts to prosecute him for the act. These justices fear that it is Trump’s prosecution for election subversion that will “destabilize” democracy, requiring them to read a brand-new principle of presidential immunity into a Constitution that guarantees nothing of the sort. They evinced virtually no concern for our ability to continue holding free and fair elections that culminate in a peaceful transfer of power. They instead offered endless solicitude for the former president who fought that transfer of power.

However the court disposes of Trump v. U.S. , the result will almost certainly be precisely what the former president craves: more delays, more hearings, more appeals—more of everything but justice . This was not a legitimate claim from the start, but a wild attempt by Trump’s attorneys to use his former role as chief executive of the United States to shield himself from the consequences of trying to turn the presidency into a dictatorship. After so much speculation that these reasonable, rational jurists would surely dispose of this ridiculous case quickly and easily, Thursday delivered a morass of bad-faith hand-wringing on the right about the apparently unbearable possibility that a president might no longer be allowed to wield his powers of office in pursuit of illegal ends. Just as bad, we heard a constant minimization of Jan. 6, for the second week in a row , as if the insurrection were ancient history, and history that has since been dramatically overblown, presumably for Democrats’ partisan aims.

We got an early taste of this minimization in Trump v. Anderson , the Colorado case about removing Trump from the ballot. The court didn’t have the stomach to discuss the violence at the Capitol in its sharply divided decision, which found for Trump ; indeed, the majority barely mentioned the events of Jan. 6 at all when rejecting Colorado’s effort to bar from the ballot an insurrectionist who tried to steal our democracy. But we let that one be, because we figured special counsel Jack Smith would ride to the rescue. Smith has indicted Trump on election subversion charges related to Jan. 6, and the biggest obstacle standing between the special counsel and a trial has been the former president’s outlandish claim that he has absolute immunity from criminal charges as a result of his having been president at the time. Specifically, Trump alleges that his crusade to overturn the election constituted “official acts” that are immune from criminal liability under a heretofore unknown constitutional principle that the chief executive is quite literally above the law.

The U.S. Court of Appeals for the District of Columbia Circuit held in February that the president does not have blanket or absolute immunity for all actions taken in office, including “official” acts performed under the guise of executing the law (for example, Trump’s attempt to weaponize the DOJ against election results under the pretense of investigating fraud). The D.C. Circuit’s emphatic, cross-ideological decision should have been summarily affirmed by SCOTUS within days. Instead, the justices set it for arguments two months down the road—a bad omen, to put it mildly . Even then, many court watchers held out hope that Thursday morning’s oral arguments were to be the moment for the nine justices of the Supreme Court to finally indicate their readiness to take on Trump, Trumpism, illiberalism, and slouching fascism.

It was not to be. Justice Samuel Alito best captured the spirit of arguments when he asked gravely “what is required for the functioning of a stable democratic society” (good start!), then answered his own question: total immunity for criminal presidents (oh, dear). Indeed, anything but immunity would, he suggested, encourage presidents to commit more crimes to stay in office: “Now, if an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?” Never mind that the president in question did not leave office peacefully and is not sitting quietly in retirement but is instead running for presidential office once again. No, if we want criminal presidents to leave office when they lose, we have to let them commit crimes scot-free. If ever a better articulation of the legal principle “Don’t make me hit you again” has been proffered at an oral argument, it’s hard to imagine it.

Justice Sonia Sotomayor spoke to this absurdity when she responded in what could only be heard as a cri de coeur: “Stable democratic society needs good faith of public officials,” she said. “That good faith assumes that they will follow the law.” The justice noted that despite all the protections in place, a democracy can sometimes “potentially fail.” She concluded: “In the end, if it fails completely, it’s because we destroyed our democracy on our own, isn’t it?”

But it was probably too late to make this plea, because by that point we had heard both Alito and Gorsuch opine that presidents must be protected at all costs from the whims of overzealous deep state prosecutors brandishing “vague” criminal statutes. We heard Kavanaugh opine mindlessly on the independent counsel statute and how mean it is to presidents, reading extensively from Justice Antonin Scalia’s dissent in a case arguing that independent counsels are unconstitutional. (Yes, Kavanaugh worked for Ken Starr , the independent counsel.) If you’re clocking a trend here, it’s gender. Just as was the case in Anderson , it’s the women justices doing the second-shift work here: both probing the thorny constitutional and criminal questions and signaling a refusal to tank democracy over abstractions and deflections. As was the case in the EMTALA arguments, it’s the women who understand what it looks like to cheat death.

Is the president, Sotomayor asked, immune from prosecution if he orders the military to assassinate a political rival? Yes, said John Sauer, who represented Trump—though it “depends on the circumstances.” Could the president, Justice Elena Kagan asked, order the military to stage a coup? Yes, Sauer said again, depending on the circumstances. To which Kagan tartly replied that Sauer’s insistence on specifying the “circumstances” boiled down to “Under my test, it’s an official act, but that sure sounds bad, doesn’t it?” (Cue polite laughter in the chamber.)

This shameless, maximalist approach should have drawn anger from the conservative justices—indignation, at least, that Sauer took them for such easy marks. But it turns out that he calibrated his terrible arguments just right. The cynicism on display was truly breathtaking: Alito winkingly implied to Michael Dreeben, representing Smith, that we all know that Justice Department lawyers are political hacks, right? Roberts mocked Dreeben for saying “There’s no reason to worry because the prosecutor will act in good faith.”

The conservative justices are so in love with their own voices and so convinced of their own rectitude that they monologued about how improper it was for Dreeben to keep talking about the facts of this case, as opposed to the “abstract” principles at play. “I’m talking about the future!” Kavanaugh declared at one point to Dreeben, pitching himself not as Trump’s human shield but as a principled defender of the treasured constitutional right of all presidents to do crime. (We’re sure whatever rule he cooks up will apply equally to Democratic presidents, right?) Kavanaugh eventually landed on the proposition that prosecutors may charge presidents only under criminal statutes that explicitly state they can be applied to the president. Which, as Sotomayor pointed out, would mean no charges everywhere, because just a tiny handful of statutes are stamped with the label “CAN BE APPLIED TO PRESIDENT.”

The words bold and fearless action were repeated on a loop today, as a kind of mantra of how effective presidents must be free to act quickly and decisively to save democracy from the many unanticipated threats it faces. And yet the court—which has been asked to take bold and fearless action to deter the person who called Georgia’s secretary of state to demand that he alter the vote count, and threatened to fire DOJ officials who would not help steal an election—is backing away from its own duty. The prospect of a criminal trial for a criminal president shocked and appalled five men: Thomas, Alito, Kavanaugh, and Gorsuch suggested that Smith’s entire prosecution is unconstitutional; meanwhile, Roberts sounded eager at times to handle the case just a hair more gracefully: by cutting out its heart by preventing the jury from hearing about “official acts” (which lie at the center of the alleged conspiracy). Justice Amy Coney Barrett was far more measured, teasing out a compromise with Dreeben that would compel the trial court to tell the jury it could not impose criminal liability for these “official” acts, only “private ones.” Remember, drawing that line would require months of hearings and appeals, pushing any trial into 2025 or beyond. The president who tried to steal the most recent election is running in the next one, which is happening in mere months.

The liberal justices tried their best to make the case that justice required denying Trump’s sweeping immunity claim, permitting the trial to move forward, and sorting out lingering constitutional issues afterward, as virtually all other criminal defendants must do. They got little traction. Everyone on that bench was well aware that the entire nation was listening to arguments; that the whole nation wants to understand whether Trump’s refusal to concede the 2020 election was an existential threat to democracy or a lark. Five justices sent the message, loud and clear, that they are far more worried about Trump’s prosecution at the hands of the deep-state DOJ than about his alleged crimes, which were barely mentioned. This trial will almost certainly face yet more delays. These delays might mean that its subject could win back the presidency in the meantime and render the trial moot. But the court has now signaled that nothing he did was all that serious and that the danger he may pose is not worth reining in. The real threats they see are the ones Trump himself shouts from the rooftops: witch hunts and partisan Biden prosecutors. These men have picked their team. The rest hardly matters.

“How about if a president orders the military to stage a coup?” Justice Elena Kagan asked Sauer. “I think it would depend on the circumstances whether it was an official act,” Sauer said after a brief exchange. “If it were an official act … he would have to be impeached and convicted.”

“That sure sounds bad, doesn’t it?” Kagan replied later.

The Democratic appointees on the bench sought to illustrate the inherent absurdity of this argument with other scenarios as well—Kagan got Sauer to admit that the president could share nuclear secrets, while Justice Sonia Sotomayor presented a scenario in which a president orders the military to assassinate a political rival. Sauer said that might qualify as an official act too. It was the only way to maintain the logic of his argument, which is that Trump is above the law.

David A. Graham: The cases against Trump: A guide

“Trying to overthrow the Constitution and subvert the peaceful transfer of power is not an official act, even if you conspire with other government employees to do it and you make phone calls from the Oval Office,” Michael Waldman, a legal expert at the Brennan Center for Justice, a liberal public-policy organization, told me.

Trump’s legal argument is a path to dictatorship. That is not an exaggeration: His legal theory is that presidents are entitled to absolute immunity for official acts. Under this theory, a sitting president could violate the law with impunity, whether that is serving unlimited terms or assassinating any potential political opponents, unless the Senate impeaches and convicts the president. Yet a legislature would be strongly disinclined to impeach, much less convict, a president who could murder all of them with total immunity because he did so as an official act. The same scenario applies to the Supreme Court, which would probably not rule against a chief executive who could assassinate them and get away with it.

The conservative justices have, over the years, seen harbingers of tyranny in union organizing , environmental regulations , civil-rights laws , and universal-health-care plans . When confronted with a legal theory that establishes actual tyranny, they were simply intrigued. As long as Donald Trump is the standard-bearer for the Republicans, every institution they control will contort itself in his image in an effort to protect him.

The Supreme Court, however, does not need to accept Trump’s absurdly broad claim of immunity for him to prevail in his broader legal battle. Such a ruling might damage the image of the Court, which has already been battered by a parade of hard-right ideological rulings. But if Trump can prevail in November, delay is as good as immunity. The former president’s best chance at defeating the federal criminal charges against him is to win the election and then order the Justice Department to dump the cases. The Court could superficially rule against Trump’s immunity claim, but stall things enough to give him that more fundamental victory.

If they wanted, the justices could rule expeditiously as well as narrowly , focusing on the central claim in the case and rejecting the argument that former presidents have absolute immunity for acts committed as president, without getting into which acts might qualify as official or not. Sauer also acknowledged under questioning by Justice Amy Coney Barrett that some of the allegations against Trump do not involve official acts but private ones, and so theoretically the prosecution could move ahead with those charges and not others. But that wouldn’t necessarily delay the trial sufficiently for Trump’s purposes.

“On big cases, it’s entirely appropriate for the Supreme Court to really limit what they are doing to the facts of the case in front of it, rather than needing to take the time to write an epic poem on the limits of presidential immunity,” Waldman said. “If they write a grant opinion, saying no president is above the law, but it comes out too late in the year, they will have effectively immunized Trump from prosecution before the election while pretending not to.”

Trump’s own attorneys argued in 2021, during his second impeachment trial, that the fact that he could be criminally prosecuted later was a reason not to impeach him. As The New York Times reported , Trump’s attorney Bruce Castor told Congress that “after he is out of office,” then “you go and arrest him.” Trump was acquitted in the Senate for his attempted coup after only a few Republicans voted for conviction; some of those who voted to acquit did so reasoning that Trump was subject to criminal prosecution as a private citizen. The catch-22 here reveals that the actual position being taken is that the president is a king, or that he is entitled to make himself one. At least if his name is Donald Trump.

David A. Graham: The Supreme Courts goes through the looking glass of presidential immunity

Democracy relies on the rule of law and the consent of the governed—neither of which is possible in a system where the president can commit crimes or order them committed if he feels like it. “We can’t possibly have an executive branch that is cloaked in immunity and still expect them to act in the best interests of the people in a functioning democracy,” Praveen Fernandes, the vice president of the Constitutional Accountability Center, a liberal legal organization, told me.

The only part of Trump’s case that contains anything resembling a reasonable argument is the idea that without some kind of immunity for official acts, presidents could be prosecuted on a flimsy basis by political rivals. But this argument is stretched beyond credibility when it comes to what Trump did, which was to try repeatedly and in multiple ways to unlawfully seize power after losing an election. Even if the prospect of presidents being prosecuted for official acts could undermine the peaceful transfer of power, actually trying to prevent the peaceful transfer of power is a much more direct threat—especially because it has already happened. But the Republican-appointed justices seemed much more concerned about the hypothetical than the reality.

“If an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by a bitter political opponent,” Justice Samuel Alito asked, “will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?”

Trump has the conservative justices arguing that you cannot prosecute a former president for trying to overthrow the country, because then they might try to overthrow the country, something Trump already attempted and is demanding immunity for doing. The incentive for an incumbent to execute a coup is simply much greater if the Supreme Court decides that the incumbent cannot be held accountable if he fails. And not just a coup, but any kind of brazen criminal behavior. “The Framers did not put an immunity clause into the Constitution. They knew how to,” Kagan pointed out during oral arguments. “And, you know, not so surprising, they were reacting against a monarch who claimed to be above the law. Wasn’t the whole point that the president was not a monarch and the president was not supposed to be above the law?”

At least a few of the right-wing justices seemed inclined to if not accept Trump’s immunity claim, then delay the trial, which would likely improve his reelection prospects. As with the Colorado ballot-access case earlier this year, in which the justices prevented Trump from being thrown off the ballot in accordance with the Constitution’s ban on insurrectionists holding office , the justices’ positions rest on a denial of the singularity of Trump’s actions.

No previous president has sought to overthrow the Constitution by staying in power after losing an election. Trump is the only one, which is why these questions are being raised now. Pretending that these matters concern the powers of the presidency more broadly is merely the path the justices sympathetic to Trump have chosen to take in order to rationalize protecting the man they would prefer to be the next president. What the justices—and other Republican loyalists—are loath to acknowledge is that Trump is not being uniquely persecuted; he is uniquely criminal.

This case—even more than the Colorado ballot-eligibility case—unites the right-wing justices’ political and ideological interests with Trump’s own. One way or another, they will have to choose between Trumpism and democracy. They’ve given the public little reason to believe that they will choose any differently than the majority of their colleagues in the Republican Party.

There’s an obvious political utility for voices on the right to amplify the idea that White Americans are experiencing unusual duress.

Concerns among Republicans that White people were losing out in America were a strong indicator of support for Donald Trump in 2016. As president, he amplified the idea that White Americans faced discrimination or were targets of racism. As a candidate in 2024, Trump has made unwinding programs targeting historic discrimination a focus of a potential second term in office.

“I think the laws are very unfair right now,” Trump said in an interview with Time magazine. “If you look right now,” he added, “there’s absolutely a bias against White and that’s a problem.”

There’s no reason to think that Trump doesn’t believe this to be true, given his politics. Polling conducted by KFF last year found that Republicans were more likely to say White people faced discrimination than they were to say any other racial group did. But that reinforces that pledging to combat this purported reverse discrimination holds political value.

The current presentation of White defense that Trump is selling follows a mounting vocal rejection of diversity efforts among his compatriots. The Black Lives Matter protests in 2020 triggered new hostility to the idea that racism is systemic in the United States. That evolved into identifying critical race theory as a boogeyman; that, in turn, became opposition to diversity, equity and inclusion (DEI) initiatives. Officials like Florida Gov. Ron DeSantis (R) have earned political capital by pledging to uproot state funding of DEI efforts, leveraging right-wing fears about White disadvantage.

On Tuesday, former Trump administration official Larry Kudlow used this line of argument for a more tenuous purpose: combating Biden administration proposals for increasing taxes on wealthy people.

In a diatribe presented on his eponymous Fox Business show (and an essay published by the New York Sun ), Kudlow tied the wealth tax to DEI — after disparaging DEI programs in a sweeping, dishonest fashion.

“Joe Biden’s strong support for woke DEI policy — diversity, equity and inclusion — that his administration has inserted into virtually every aspect of American life and government and of course, these colleges,” Kudlow said . “DEI is also the progenitor of the antisemitism virus that is spreading throughout American culture, including universities.”

No part of that is true? The administration has not “inserted” DEI into much of anything, including colleges. That’s just Kudlow trying to leverage the right’s fixation (the protests on college campuses) for his purposes, even as he was trying to leverage the right’s slightly older fixation (DEI) in the same way. Hence blaming DEI for antisemitism, which is a bit like blaming computers for the bubonic plague.

Kudlow then asserted that DEI was “socialist class warfare,” an allegation more commonly leveled against critical race theory. But he needed the hook for his next claim.

“The Biden budget has come up with this crazy idea of taxing White people because they own more assets than people of color. So Biden seeks to raise capital gains tax all the way up to 44.6 percent,” he told viewers. “And the Janet Yellen Treasury Department points out that White families disproportionately hold assets.”

“We know that,” Kudlow offered dismissively, pivoting to offer praise for the economy during Trump’s presidency. But it’s useful to not dismiss the point quite so quickly. White Americans hold 83 percent of the nation’s assets, according to the Federal Reserve, despite making up less than 60 percent of the population. (Those assets include real estate and stocks that might be subject to capital gains taxes.) Black and Hispanic Americans, meanwhile, hold less than 7 percent of assets combined. Those racial groups make up 31 percent of the population.

Part of this overlaps with age; White Americans are older , and older people typically have more wealth. But part of it is a reflection of the inequality that numerous programs are hoping to address by adjusting for historic discrimination .

White Republicans simply don’t believe economic differences between White and Black Americans are a function of discrimination. For decades, the General Social Survey has asked a question specifically centered on that divide. While White Democrats became more likely to point to discrimination as a cause in the wake of the initial Black Lives Matter protests a decade ago, White Republicans are still most likely to say the problem is that Black Americans “don’t have the motivation or will power” to overcome poverty.

Or, in Kudlow’s framing on Fox Business, they don’t have the beneficence of Donald Trump’s tax cuts to help reduce levels of poverty.

“Biden is proposing a $5 trillion tax hike overall, which will punish the economy and raise the inflation rate,” Kudlow said in concluding his on-air speech. “But when you look under the hood of this tax policy’s goals, you see class warfare. You see diversity, equity, inclusion. You see racial warfare against White folks and especially successful White folks.”

That last line is important. Biden’s tax proposals focus on rich Americans and, therefore, disproportionately on White Americans. But Kudlow doesn’t emphasize the “rich” in “rich White Americans,” because it is less appealing. He emphasizes the “White,” with the caveat that the White people being targeted will “especially” — read, overwhelmingly — be “successful” ones.

“This left-wing, socialist, woke approach,” he continued, “is absolutely antithetical to traditional American values and the traditional ladder of opportunity that is colorblind and has made America the strongest country in the world.”

The emphasis on the ladder being colorblind was his. But it begs the question: The whole point of programs including affirmative action elements is that the ladder hasn’t been colorblind. There are reams of evidence bolstering that idea. Mind you, DEI programs generally focus on diverse representation rather than affirmative action, but it’s clear what Kudlow is trying to get people mad about here.

Kudlow probably didn’t convince many people with his argument. Not simply because it’s not a great argument, but because his audience is presumably disproportionately wealthy and conservative and didn’t need culture-war reasons to oppose a tax on the wealthy.

But the argument was still useful. It is a stark, unvarnished demonstration of how appeals based on race can be and often are stalking horses for standard Republican economic policies.

What Weinstein’s Overturned Conviction Means for His California Case

Harvey Weinstein faced similar sex crimes charges in New York and California, but the arguments used to overturn one case may not help in the other.

The decision by New York’s top court on Thursday to overturn the conviction of Harvey Weinstein on sex crime charges raised many thorny legal questions. Perhaps chief among them: Will it bolster his chances of a successful appeal in a similar case in California?

Mr. Weinstein’s lawyer in California, Jennifer Bonjean, plans to file that appeal next month, and has said she believes the New York decision helps her chances of winning. In both cases, prosecutors offered witnesses who said they had been assaulted by Mr. Weinstein, the disgraced Hollywood producer, even though their accounts were not tied to criminal charges.

Prosecutors in sexual assault cases sometimes use such witnesses to establish a pattern of behavior, but it can be a risky move because defendants are typically supposed to be judged only on the crimes with which they have been charged.

The tactic was at the heart of the 4-to-3 decision on Thursday by New York’s Court of Appeals, which concluded that the judge who presided over Mr. Weinstein’s case in 2020 had deprived him of a fair trial by allowing those witnesses to testify.

Mr. Weinstein is expected to appear in State Supreme Court in Manhattan on Wednesday for a procedural hearing that is the first step for prosecutors to restart the criminal case to try him again.

New York and California law differ on the crucial issue of witnesses. The office of the Los Angeles district attorney, George Gascón, said that California’s law, unlike New York’s, allows evidence, at a judge’s discretion, that shows a defendant’s “propensity” to commit sexual assault.

“Although we do not know what arguments the defense will raise on appeal, we are confident that our convictions will withstand appellate scrutiny,” Mr. Gascón’s office said in a statement. “Our office stands ready to see that Mr. Weinstein faces the serious consequences of his deplorable conduct.”

Gloria Allred, who represented three of the victims involved in Mr. Weinstein’s Los Angeles trial, said the “prior bad acts” witnesses admitted at that proceeding were allowed under a state law that permits testimony from these witnesses if it is used to prove motive, opportunity, intent, preparation or a plan to commit a crime, or whether the defendant could have reasonably believed an alleged victim consented.

In contrast, Ms. Allred said, New York courts see such testimony as “more prejudicial than probative.”

In the California case, in which Mr. Weinstein was convicted of raping an Italian actress in 2013, the judge allowed four witnesses whose accusations were not tied to criminal charges. Testimony from accusers, whether their allegations are tied to charges or not, can be emotional and elicit strong reactions.

When Jane Doe 1, the actress Mr. Weinstein was convicted of raping, recounted graphic details of the crime at trial, her hands trembled. She paused often and took slow, deep breaths. The judge ended the day early when she broke down sobbing.

Ms. Allred, who has also represented sex crime victims in New York, said she does not believe the New York decision would affect Mr. Weinstein’s conviction in California.

In New York, testimony and evidence related to uncharged crimes must be used “to show a material element to the prosecution’s case,” said Douglas H. Wigdor, who represented two women who testified at Mr. Weinstein’s Manhattan trial and whose allegations were not tied to the crimes at issue there. That meant trying to establish that Mr. Weinstein knew his accusers had not consented to sexual activity, Mr. Wigdor said.

“That’s why the additional evidence of other women who he did this to is important, to show that there wasn’t a mistake on his part, that he knew, that he knows, when someone’s not consented,” Mr. Wigdor said.

In California, judges have much greater discretion in determining whether to admit such evidence to speak to the person’s character, he added.

Mr. Weinstein, 72, was sentenced to 16 years in prison in the California case . The jury deadlocked on charges related to accusations by two other women, and acquitted Mr. Weinstein of one count of sexual battery involving a massage therapist.

Ms. Bonjean, Mr. Weinstein’s lawyer in California, said that the witnesses were only one of several issues she might raise in her appeal; others included evidence that was excluded at trial and the jury’s being informed of Mr. Weinstein’s New York conviction. She said she would also contest the length of his sentence, which was increased because of the prior conviction in New York.

In the New York case, Mr. Weinstein was sentenced to 23 years in prison after he was convicted of forcibly performing oral sex on a TV and film production assistant in 2006, and of third-degree rape for an attack on an aspiring actor in 2013. He was acquitted on the most serious charges — two counts of predatory sexual assault and first-degree rape.

Mr. Weinstein has been imprisoned in upstate New York, and Alvin Bragg, the Manhattan district attorney, has vowed to retry him. Mr. Weinstein has maintained his innocence.

Cynthia Godsoe, a professor at Brooklyn Law School and a former public defender, said so-called Molineux witnesses — a term used in New York for people who testify about uncharged crimes — are typically used with great restraint. She said the argument used in Mr. Weinstein’s New York appeal was less likely to succeed in California because of the different laws.

She added that she had long believed using the Molineux witnesses in the New York case was a mistake, arguing that bringing in evidence that prejudices a jury against a defendant is fundamentally unfair.

“Like when you have someone like Harvey Weinstein that you’re like, ‘OK, he’s so terrible, and there’s so many uncharged assaults that we want to make sure he is locked away forever,’” she said. “But that makes a really bad precedent for most accused people.”
