Know the ins and outs of your business priorities

A great presentation is all about delivering value. You need to draw distinct lines between the content and its business value . Otherwise, you risk losing your audience’s attention right from the start.

“We have seconds to get people’s attention these days,” says Barrows. “A person’s most valuable asset is their time.”

You can give more engaging presentations simply by staying up to date on company goals and priorities. Get to know what’s top of mind for senior leaders and other stakeholders so you can tailor your presentation content accordingly.

On sales calls, Barrows does this by asking each individual attendee what they’d like to get out of the meeting. You can mimic this approach by setting up regular 1:1’s with team members to stay up to date on their priorities.

Practice, practice, practice

According to Barrows, practice can and will make perfect. “Public speaking is one of the biggest fears that most people have, but a lot of it comes down to confidence and preparation. The more prepared you are, the more confident you’ll be in your presentation.”

Barrows refers to confidence and preparation as the art and science of giving a good presentation. The art can be seen in skilled delivery and a snazzy deck, but it’s preparation that keeps everything on track. “If you come in unprepared to a meeting and you get one curveball of a question, you tend to fall apart. Preparation gives you the confidence you need to adjust on the fly.”

Watch your playback footage

It may make you cringe, but the best way to improve your presentation skills is to record yourself and watch it back.

Barrows figured this out after taking a presentation skills course, but not through instructor feedback. It was watching himself back on video that showed him everything he wanted to fix. Common public speaking issues—like overusing filler words and standing with closed body language—are easy to spot on tape.

The good news is, in increasingly distributed workforces, you don’t have to set up a camera during your Monday morning stand up to get footage of yourself speaking in front of an audience. You can just watch the Zoom recording.

Real-Life Example

After the pandemic, I have lost my concentration and focus on my studies due to social media. I procrastinate, and because of this, I cannot manage my time correctly. Social media has impacted my academic life, and I had lost academic validation, which I used to have when I did not have an account on any social media applications, basically when I did not own a smartphone. Social media has created a trap that makes me spend hours just scrolling the whole day on Youtube or Instagram. I feel I have lost all my productivity; even when I want to learn or open some notes from my smartphone or laptop, I end up scrolling and watching unnecessary stuff which is of no benefit to me.

The reason I chose this topic because of the growing popularity of social media.

As we all know that social media platforms like Facebook, Instagram, Twitter, and Whatsapp are gaining importance these days as they are connecting people worldwide with just a click of a button.

If we look at the positive impact of social media, there are various advantages. One of the major advantages of social media is that it is full of information and helps in providing education. For example, children approach social media to get information on the desired topic.

It is a great device for education. It has made live education possible. We can attend a lecture happening in some other part of the world by just sitting in front of a screen in our country.

Isn’t it great?

Social media is also very convenient to stay updated about what is happening around us. We don’t need to wait for a newspaper to give us information. There are various news-related applications that can instantly update us about any serious happening around us.

Social media has also created opportunities for people such as to show their talent. It is also great for advertisements. But despite being so many benefits, it has been criticized. It has disadvantages too.

Are you on social media a lot? When is the last time you checked Twitter, Facebook, or Instagram? Last night? Before breakfast? Five minutes ago?

If so, you are not alone — which is the point, of course. Humans are highly social creatures. Our brains have become wired to process social information, and we usually feel better when we are connected. Social media taps into this tendency.

“Human brains have essentially evolved because of sociality more than any other thing,” says Sinan Aral, an MIT professor and expert in information technology and marketing. “When you develop a population-scale technology that delivers social signals to the tune of trillions per day in real-time, the rise of social media isn’t unexpected. It’s like tossing a lit match into a pool of gasoline.”

The numbers make this clear. In 2005, about 7 percent of American adults used social media. But by 2017, 80 percent of American adults used Facebook alone. About 3.5 billion people on the planet, out of 7.7 billion, are active social media participants. Globally, during a typical day, people post 500 million tweets, share over 10 billion pieces of Facebook content, and watch over a billion hours of YouTube video.

As social media platforms have grown, though, the once-prevalent, gauzy utopian vision of online community has disappeared. Along with the benefits of easy connectivity and increased information, social media has also become a vehicle for disinformation and political attacks from beyond sovereign borders.

“Social media disrupts our elections, our economy, and our health,” says Aral, who is the David Austin Professor of Management at the MIT Sloan School of Management.

Now Aral has written a book about it. In “The Hype Machine,” published this month by Currency, a Random House imprint, Aral details why social media platforms have become so successful yet so problematic, and suggests ways to improve them.

As Aral notes, the book covers some of the same territory as “The Social Dilemma,” a documentary that is one of the most popular films on Netflix at the moment. But Aral’s book, as he puts it, "starts where ‘The Social Dilemma’ leaves off and goes one step further to ask: What can we do about it?”

“This machine exists in every facet of our lives,” Aral says. “And the question in the book is, what do we do? How do we achieve the promise of this machine and avoid the peril? We’re at a crossroads. What we do next is essential, so I want to equip people, policymakers, and platforms to help us achieve the good outcomes and avoid the bad outcomes.”

When “engagement” equals anger

“The Hype Machine” draws on Aral’s own research about social networks, as well as other findings, from the cognitive sciences, computer science, business, politics, and more. Researchers at the University of California at Los Angeles, for instance, have found that people obtain bigger hits of dopamine — the chemical in our brains highly bound up with motivation and reward — when their social media posts receive more likes.

At the same time, consider a 2018 MIT study by Soroush Vosoughi, an MIT PhD student and now an assistant professor of computer science at Dartmouth College; Deb Roy, MIT professor of media arts and sciences and executive director of the MIT Media Lab; and Aral, who has been studying social networking for 20 years. The three researchers found that on Twitter, from 2006 to 2017, false news stories were 70 percent more likely to be retweeted than true ones. Why? Most likely because false news has greater novelty value compared to the truth, and provokes stronger reactions — especially disgust and surprise.

In this light, the essential tension surrounding social media companies is that their platforms gain audiences and revenue when posts provoke strong emotional responses, often based on dubious content.

“This is a well-designed, well-thought-out machine that has objectives it maximizes,” Aral says. “The business models that run the social-media industrial complex have a lot to do with the outcomes we’re seeing — it’s an attention economy, and businesses want you engaged. How do they get engagement? Well, they give you little dopamine hits, and … get you riled up. That’s why I call it the hype machine. We know strong emotions get us engaged, so [that favors] anger and salacious content.”

From Russia to marketing

“The Hype Machine” explores both the political implications and business dimensions of social media in depth. Certainly social media is fertile terrain for misinformation campaigns. During the 2016 U.S. presidential election, Russia spread  false information to at least 126 million people on Facebook and another 20 million people on Insta­gram (which Facebook owns), and was responsible for 10 million tweets. About 44 percent of adult Americans visited a false news source in the final weeks of the campaign.

“I think we need to be a lot more vigilant than we are,” says Aral.

We do not know if Russia’s efforts altered the outcome of the 2016 election, Aral says, though they may have been fairly effective. Curiously, it is not clear if the same is true of most U.S. corporate engagement efforts.

As Aral examines, digital advertising on most big U.S. online platforms is often wildly ineffective, with academic studies showing that the “lift” generated by ad campaigns — the extent to which they affect consumer action — has been overstated by a factor of hundreds, in some cases. Simply counting clicks on ads is not enough. Instead, online engagement tends to be more effective among new consumers, and when it is targeted well; in that sense, there is a parallel between good marketing and guerilla social media campaigns.

“The two questions I get asked the most these days,” Aral says, “are, one, did Russia succeed in intervening in our democracy? And two, how do I measure the ROI [return on investment] from marketing investments? As I was writing this book, I realized the answer to those two questions is the same.”

Ideas for improvement

“The Hype Machine” has received praise from many commentators. Foster Provost, a professor at New York University’s Stern School of Business, says it is a “masterful integration of science, business, law, and policy.” Duncan Watts, a university professor at the University of Pennsylvania, says the book is “essential reading for anyone who wants to understand how we got here and how we can get somewhere better.”

In that vein, “The Hype Machine” has several detailed suggestions for improving social media. Aral favors automated and user-generated labeling of false news, and limiting revenue-collection that is based on false content. He also calls for firms to help scholars better research the issue of election interference.

Aral believes federal privacy measures could be useful, if we learn from the benefits and missteps of the General Data Protection Regulation (GDPR) in Europe and a new California law that lets consumers stop some data-sharing and allows people to find out what information companies have stored about them. He does not endorse breaking up Facebook, and suggests instead that the social media economy needs structural reform. He calls for data portability and interoperability, so “consumers would own their identities and could freely switch from one network to another.” Aral believes that without such fundamental changes, new platforms will simply replace the old ones, propelled by the network effects that drive the social-media economy.

“I do not advocate any one silver bullet,” says Aral, who emphasizes that changes in four areas together — money, code, norms, and laws — can alter the trajectory of the social media industry.

But if things continue without change, Aral adds, Facebook and the other social media giants risk substantial civic backlash and user burnout.

“If you get me angry and riled up, I might click more in the short term, but I might also grow really tired and annoyed by how this is making my life miserable, and I might turn you off entirely,” Aral observes. “I mean, that’s why we have a Delete Facebook movement, that’s why we have a Stop Hate for Profit movement. People are pushing back against the short-term vision, and I think we need to embrace this longer-term vision of a healthier communications ecosystem.”

Changing the social media giants can seem like a tall order. Still, Aral says, these firms are not necessarily destined for domination.

“I don’t think this technology or any other technology has some deterministic endpoint,” Aral says. “I want to bring us back to a more practical reality, which is that technology is what we make it, and we are abdicating our responsibility to steer technology toward good and away from bad. That is the path I try to illuminate in this book.”

How to use social media wisely and mindfully, it's time to be clear about how social media affects our relationships and well-being—and what our intentions are each time we log on..

It was no one other than Facebook’s former vice president for user growth, Chamath Palihapitiya, who advised people to take a “hard break” from social media. “We have created tools that are ripping apart the social fabric of how society works,” he said recently .

His comments echoed those of Facebook founding president Sean Parker . Social media provides a “social validation feedback loop (‘a little dopamine hit…because someone liked or commented on a photo or a post’),” he said. “That’s exactly the thing a hacker like myself would come up with because you’re exploiting a vulnerability in human psychology.”

Are their fears overblown? What is social media doing to us as individuals and as a society?

Since over 70 percent of American teens and adults are on Facebook and over 1.2 billion users visit the site daily—with the average person spending over 90 minutes a day on all social media platforms combined—it’s vital that we gain wisdom about the social media genie, because it’s not going back into the bottle. Our wish to connect with others and express ourselves may indeed come with unwanted side effects.

The problems with social media

Social media is, of course, far from being all bad. There are often tangible benefits that follow from social media use. Many of us log on to social media for a sense of belonging, self-expression, curiosity, or a desire to connect. Apps like Facebook and Twitter allow us to stay in touch with geographically dispersed family and friends, communicate with like-minded others around our interests, and join with an online community to advocate for causes dear to our hearts.

Honestly sharing about ourselves online can enhance our feelings of well-being and online social support, at least in the short term. Facebook communities can help break down the stigma and negative stereotypes of illness, while social media, in general, can “serve as a spring board” for the “more reclusive…into greater social integration,” one study suggested.

But Parker and Palihapitiya are on to something when they talk about the addictive and socially corrosive qualities of social media. Facebook “addiction” (yes, there’s a test for this) looks similar on an MRI scan in some ways to substance abuse and gambling addictions. Some users even go to extremes to chase the highs of likes and followers. Twenty-six-year-old Wu Yongning recently fell to his death in pursuit of selfies precariously taken atop skyscrapers.

Facebook can also exacerbate envy . Envy is nothing if not corrosive of the social fabric, turning friendship into rivalry, hostility, and grudges. Social media tugs at us to view each other’s “highlight reels,” and all too often, we feel ourselves lacking by comparison. This can fuel personal growth, if we can turn envy into admiration, inspiration, and self-compassion ; but, instead, it often causes us to feel dissatisfied with ourselves and others.

For example, a 2013 study by Ethan Kross and colleagues showed quite definitively that the more time young adults spent on Facebook, the worse off they felt. Participants were texted five times daily for two weeks to answer questions about their well-being, direct social contact, and Facebook use. The people who spent more time on Facebook felt significantly worse later on, even after controlling for other factors such as depression and loneliness. 

Interestingly, those spending significant time on Facebook, but also engaging in moderate or high levels of direct social contact, still reported worsening well-being. The authors hypothesized that the comparisons and negative emotions triggered by Facebook were carried into real-world contact, perhaps damaging the healing power of in-person relationships.

More recently, Holly Shakya and Nicholas Christakis studied 5,208 adult Facebook users over two years, measuring life satisfaction and mental and physical health over time. All these outcomes were worse with greater Facebook use, and the way people used Facebook (e.g., passive or active use, liking, clicking, or posting) didn’t seem to matter.

“Exposure to the carefully curated images from others’ lives leads to negative self-comparison, and the sheer quantity of social media interaction may detract from more meaningful real-life experiences,” the researchers concluded.

How to rein in social media overuse

So, what can we do to manage the downsides of social media? One idea is to log out of Facebook completely and take that “hard break.” Researcher Morten Tromholt of Denmark found that after taking a one-week break from Facebook, people had higher life satisfaction and positive emotions compared to people who stayed connected. The effect was especially pronounced for “heavy Facebook users, passive Facebook users, and users who tend to envy others on Facebook.”

We can also become more mindful and curious about social media’s effects on our minds and hearts, weighing the good and bad. We should ask ourselves how social media makes us feel and behave, and decide whether we need to limit our exposure to social media altogether (by logging out or deactivating our accounts) or simply modify our social media environment. Some people I’ve spoken with find ways of cleaning up their newsfeeds—from hiding everyone but their closest friends to “liking” only reputable news, information, and entertainment sources.

Knowing how social media affects our relationships, we might limit social media interactions to those that support real-world relationships. Instead of lurking or passively scrolling through a never-ending bevy of posts, we can stop to ask ourselves important questions, like What are my intentions? and What is this online realm doing to me and my relationships?

We each have to come to our own individual decisions about social media use, based on our own personal experience. Grounding ourselves in the research helps us weigh the good and bad and make those decisions. Though the genie is out of the bottle, we may find, as Shakya and Christakis put it, that “online social interactions are no substitute for the real thing,” and that in-person, healthy relationships are vital to society and our own individual well-being. We would do well to remember that truth and not put all our eggs in the social media basket.

We all know that the plural of medium is media, which refers to the contact networks we disseminate. The media is a term that refers to the networks of connections through which we transmit material such as news, music, films, education, advertising communications, and other types of information. These are often included in physical and online journals and magazines, tv, radio, publicity, cellphone, the internet, fax, and billboards. The media explain the various ways we communicate in culture. As all means of communication are used, the media can cover anything from a telephone call to network coverage.

Moving ahead on my speech on importance of social media let us look at the different kinds of social media . 

Traditional radio may no longer be important, but we have discovered a modern counterpart in the form of podcasts, which are on-demand audio content series that you can listen to anytime, whenever, and wherever you choose.

Any multimedia medium that helps users easily build and post content with the public is social media. The word “social media” refers to a multitude of websites and applications. Twitter, for example, focuses on exchanging connections and brief written posts. Others, such as Instagram and TikTok, are designed to make picture and video sharing simpler.

Television, movies, advertising films, advertisements, and video-sharing services are examples of video and film-based content. Visual content is the most relevant medium of the twenty-first century because it is entertaining, emotional, informative, and empathic.

Books, journals, websites, websites, and academic papers are examples of publications. While the importance of printed media has waned over time, they continue to be valuable for transmitting critical government messages.

Email and text applications are examples of conventional mail and modern messaging tools. For casual conversations, messaging apps like Whatsapp, Telegram, or Signal are common, although emails remain the traditional means of communication for formal discussions.

A digital community, also known as an online community or web community, is a group of people who connect mainly over the Internet. Members in a culture typically have a lot of things in common. Many people consider online groups to be their second home, with a “family of unseen relatives.”

The most diverse types of media-based entertainment are digital gaming and immersive worlds. Gaming is at an all-time peak in 2021, and it will continue to climb as technology progresses and increasingly complex and immersive environments become possible. This momentum, according to experts, will propel gaming into becoming a primary marketing outlet for brands and agencies in the next five years and beyond.

The term “applications” refers to all software that people use, like smartphone apps. Apps  are not only a type of media in the same sense as consumer apps and games have always been, but they are rapidly displacing other types of media such as television, books, and music for consumers’ time and energy.

Signs, banners, multimedia ads, t-shirts, and food packaging are examples of graphics that can be called media. Take for example, you’re driving down the highway and come across a billboard promoting a specific brand’s goods. This will finally be used to connect with consumers and share the offer.

For speaking to large crowds of individuals, visual aids such as charts, slides, and video are often used. Public speaking is no longer just about a microphone and a speaker; it now incorporates a vital part known as presentation, which has proven to be a gamechanger.

Various media keep us informed of what is going on in the country and across the world. This knowledge allows us to stay in contact with reality and consider what is going on around us, as well as what is going on with others. We shape our own opinions about various topics and ideas by evaluating the knowledge we get. Since we stick to those opinions and step on from others, this behavioural practise reinforces our personalities. What counts is that our views and beliefs mature in a peaceful way, with reverence for those who hold differing viewpoints.

The media produces material depending on what they want to say to the viewer or what the audience needs to see. The success of such cultural material, such as a tv programme, is dependent on how long it lasts. That ensures that if a dance talent show is a success and makes a lot of money, it will be followed by a slew of other series. As a result, more people will choose to be a part of these projects, and they will serve as an inspiration to those who want to be famous. In this way, a new fact has emerged: participating in a televised talent contest is the fastest way to instant celebrity.

It would be unfair if I did not include that the media is a critical thinking source in my speech on importance of social media. The media plays a vital role in education because it helps adolescents and youth improve critical thinking skills. Tv and the internet provide us with a multitude of choices from which to choose. It’s worth noting that communication methods tend to set borrowed habits. They persuade each person to choose one choice over another. That is why teachers and parents need to help children and teens develop a positive personality. This allows them to make decisions based on their own beliefs.

The media, with its immense influence, takes knowledge to a wide range of topics. This helps to introduce children and teens to a variety of learning sources and to pique their interest in what they want to read. Teachers should advise students on how to correctly interpret the sources from which they receive results. This would allow them to distinguish between the types of data they collect, which may be fine, normal, or bad. Bear in mind that whatever piques a child’s attention today might become a source of career motivation in the future. Analyze the origins from which they collect results.

Democracy is, by far, the most equitable form of government currently in use. It enables voters to elect their rulers and then exert power over their acts as elected officials. In this phase, the media plays a vital role. Journalists must try to convey the facts of leaders’ lives and present them as they are. Any person should judge lawmakers in this way. Each person will vote for the person that he or she believes is the most trustworthy and competent, based on their standards. Unfortunately, different interests will emerge during this period, preventing us from seeing the politician for who he or she is. According to their convenience, the media can exploit a politician’s portrait.Therefore, each citizen must strengthen his or her own criteria so that he or she can make better choices.

The media has a huge impact on culture. They keep the public informed on what is going on. It pervades people’s lives by instilling in them their own set of criteria and viewpoints. The media drives the masses in this direction, resulting in numerous social revolutions. Each part of society, in essence, forecasts the possible changes that will occur. The media plays a critical role in highlighting various social issues, allowing for the development of various remedies, as well as reacting to those who fail to perform their duties. Authorities in various areas of government are therefore judged based on their results.

Without question, the media is there with the public during all of the shifts that exist. People’s ways of getting information have evolved, with some favouring some newspapers and some ignoring them. The popularisation of the use of social media is one of the most significant developments that has occurred in the media. People, among other things, engage with other people, form views, and generate patterns.

The media is an integral part of our lives and has a major impact on our culture. Because of the high level of accessibility that occurs around the world, the relevance of media is increasing by the day. As a result, it is critical that each of us become mindful of the media’s influence. With this, I come to the end of my speech on importance of social media. Thank you!

What to Know About the Supreme Court Arguments on Social Media Laws

Both Florida and Texas passed laws regulating how social media companies moderate speech online. The laws, if upheld, could fundamentally alter how the platforms police their sites.

Social media companies are bracing for Supreme Court arguments on Monday that could fundamentally alter the way they police their sites.

After Facebook, Twitter and YouTube barred President Donald J. Trump in the wake of the Jan. 6, 2021, riots at the Capitol, Florida made it illegal for technology companies to ban from their sites a candidate for office in the state. Texas later passed its own law prohibiting platforms from taking down political content.

Two tech industry groups, NetChoice and the Computer & Communications Industry Association, sued to block the laws from taking effect. They argued that the companies have the right to make decisions about their own platforms under the First Amendment, much as a newspaper gets to decide what runs in its pages.

So what’s at stake?

The Supreme Court’s decision in those cases — Moody v. NetChoice and NetChoice v. Paxton — is a big test of the power of social media companies, potentially reshaping millions of social media feeds by giving the government influence over how and what stays online.

“What’s at stake is whether they can be forced to carry content they don’t want to,” said Daphne Keller, a lecturer at Stanford Law School who filed a brief with the Supreme Court supporting the tech groups’ challenge to the Texas and Florida laws. “And, maybe more to the point, whether the government can force them to carry content they don’t want to.”

If the Supreme Court says the Texas and Florida laws are constitutional and they take effect, some legal experts speculate that the companies could create versions of their feeds specifically for those states. Still, such a ruling could usher in similar laws in other states, and it is technically complicated to accurately restrict access to a website based on location.

Critics of the laws say the feeds to the two states could include extremist content — from neo-Nazis, for example — that the platforms previously would have taken down for violating their standards. Or, the critics say, the platforms could ban discussion of anything remotely political by barring posts about many contentious issues.

What are the Florida and Texas social media laws?

The Texas law prohibits social media platforms from taking down content based on the “viewpoint” of the user or expressed in the post. The law gives individuals and the state’s attorney general the right to file lawsuits against the platforms for violations.

The Florida law fines platforms if they permanently ban from their sites a candidate for office in the state. It also forbids the platforms from taking down content from a “journalistic enterprise” and requires the companies to be upfront about their rules for moderating content.

Proponents of the Texas and Florida laws, which were passed in 2021, say that they will protect conservatives from the liberal bias that they say pervades the platforms, which are based in California.

“People the world over use Facebook, YouTube, and X (the social-media platform formerly known as Twitter) to communicate with friends, family, politicians, reporters, and the broader public,” Ken Paxton, the Texas attorney general, said in one legal brief. “And like the telegraph companies of yore, the social media giants of today use their control over the mechanics of this ‘modern public square’ to direct — and often stifle — public discourse.”

Chase Sizemore, a spokesman for the Florida attorney general, said the state looked “forward to defending our social media law that protects Floridians.” A spokeswoman for the Texas attorney general did not provide a comment.

What are the current rights of social media platforms?

They now decide what does and doesn’t stay online.

Companies including Meta’s Facebook and Instagram, TikTok, Snap, YouTube and X have long policed themselves, setting their own rules for what users are allowed to say while the government has taken a hands-off approach.

In 1997, the Supreme Court ruled that a law regulating indecent speech online was unconstitutional, differentiating the internet from mediums where the government regulates content. The government, for instance, enforces decency standards on broadcast television and radio.

For years, bad actors have flooded social media with misleading information , hate speech and harassment, prompting the companies to come up with new rules over the last decade that include forbidding false information about elections and the pandemic. Platforms have banned figures like the influencer Andrew Tate for violating their rules, including against hate speech.

But there has been a right-wing backlash to these measures, with some conservatives accusing the platforms of censoring their views — and even prompting Elon Musk to say he wanted to buy Twitter in 2022 to help ensure users’ freedom of speech.

What are the social media platforms arguing?

The tech groups say that the First Amendment gives the companies the right to take down content as they see fit, because it protects their ability to make editorial choices about the content of their products.

In their lawsuit against the Texas law, the groups said that just like a magazine’s publishing decision, “a platform’s decision about what content to host and what to exclude is intended to convey a message about the type of community that the platform hopes to foster.”

Still, some legal scholars are worried about the implications of allowing the social media companies unlimited power under the First Amendment, which is intended to protect the freedom of speech as well as the freedom of the press.

“I do worry about a world in which these companies invoke the First Amendment to protect what many of us believe are commercial activities and conduct that is not expressive,” said Olivier Sylvain, a professor at Fordham Law School who until recently was a senior adviser to the Federal Trade Commission chair, Lina Khan.

How does this affect Big Tech’s liability for content?

A federal law known as Section 230 of the Communications Decency Act shields the platforms from lawsuits over most user content. It also protects them from legal liability for how they choose to moderate that content.

That law has been criticized in recent years for making it impossible to hold the platforms accountable for real-world harm that flows from posts they carry, including online drug sales and terrorist videos.

The cases being argued on Monday do not challenge that law head-on. But the Section 230 protections could play a role in the broader arguments over whether the court should uphold the Texas and Florida laws. And the state laws would indeed create new legal liability for the platforms if they take down certain content or ban certain accounts.

Last year, the Supreme Court considered two cases, directed at Google’s YouTube and Twitter, that sought to limit the reach of the Section 230 protections. The justices declined to hold the tech platforms legally liable for the content in question.

What comes next?

The court will hear arguments from both sides on Monday. A decision is expected by June.

Legal experts say the court may rule that the laws are unconstitutional, but provide a road map on how to fix them. Or it may uphold the companies’ First Amendment rights completely.

Carl Szabo, the general counsel of NetChoice, which represents companies including Google and Meta and lobbies against tech regulations, said that if the group’s challenge to the laws fails, “Americans across the country would be required to see lawful but awful content” that could be construed as political and therefore covered by the laws.

“There’s a lot of stuff that gets couched as political content,” he said. “Terrorist recruitment is arguably political content.”

But if the Supreme Court rules that the laws violate the Constitution, it will entrench the status quo: Platforms, not anybody else, will determine what speech gets to stay online.

Florida latest to restrict social media for kids as legal battle looms

Florida Gov. Ron DeSantis on Monday signed strong restrictions against children using social media, following other Republican-led states amid a national push to crack down on minors’ access to online platforms over safety fears.

“You can have a kid in the house safe, seemingly, and then you have predators that can get right in there into your own home,” DeSantis said during a news conference Monday. “You could be doing everything right, but they know how to get and manipulate these different platforms.”

The new law prohibits children 13 and younger from creating social media profiles and requires parental consent for those who are 14 and 15. Social media platforms will be required to delete existing accounts for children younger than 14 — though account holders will have a 90-day period to dispute terminations. If platforms “knowingly or recklessly” violate the law, they face up to $50,000 per violation in civil penalties. The bill also bans minors from “pornographic or sexually explicit” websites and requires age verification to access these sites.

Major social media platforms, including Instagram , Facebook and TikTok , require users to be at least 13 — a requirement that stems from the 1998 Children’s Online Privacy Protection Rule , which banned the collection of children’s personal data without parental consent. However, a survey published in 2022 by the nonprofit research organization Common Sense Media found an upswing in usage among children ages 8 to 12.

While the bill, H.B. 3 , does not specify which social media platforms would be affected by the changes, its text states that it applies to sites on which more than 10 percent “of the daily active users who are younger than 16 years of age spend on average 2 hours per day” — as well as those that have “addictive features” such as infinite scrolling and push alerts.

Such habit-forming features, said Florida House Speaker Paul Renner (R), are “at the heart of why children stay on these platforms for hours and hours on end” — “nudging them in a very, very dark direction.”

Politicians across the country have taken aim at the ingredients that make social media alluring — that algorithm magic and slew of notifications that make it hard for consumers to turn away from the incoming flood of information. Last year, U.S. Surgeon General Vivek H. Murthy warned that “social media use is associated with harm to young people’s mental health.” And its misuse can increase the risk of children developing anxiety, depression and eating disorders.

Those concerns have spurred a flurry of legislation relating to children’s social media usage that range from bans — such as those in Arkansas and Utah — to efforts to bolster media-literacy education. But the push to curb children’s social media use is coming most from state legislatures, which have by far outpaced federal legislators in passing laws in that area.

According to a tally by the National Conference of State Legislatures , more than 140 bills on the issue are pending this year across 30 states. Last year, 13 states passed 23 laws on online child safety — which included imposing verification requirements, granting greater parental oversight and limiting children’s social media usage, according to a report by the University of North Carolina’s Center on Technology Policy.

“Of all tech-policy issues covered in this report, states were most active in this area,” according to the researchers. “Both parties ramped up efforts on child safety, but Republican-led states passed four times the number of new laws as Democrat-led states.”

Like similar laws passed in other states, Florida’s restrictions — which are set to take effect in January — are likely to face constitutional backlash over concerns that they infringe on free speech and would push companies to collect even more data to verify that children are not accessing their sites. Federal judges temporarily blocked similar laws in Arkansas and Ohio from going into effect, citing concerns that they may run afoul of the First Amendment.

An executive for NetChoice, a tech industry group that sued to block many of those measures, called Florida’s measure an “unconstitutional law” that “will protect exactly zero Floridians.” The group counts Facebook, Google, Amazon and other tech companies as members. (Amazon founder Jeff Bezos owns The Washington Post.)

“HB 3 forces Floridians to hand over sensitive personal information to websites or lose their access to critical information channels,” Carl Szabo, NetChoice’s vice president and general counsel, said in a statement Monday after DeSantis signed it into law. “This infringes on Floridians’ First Amendment rights to share and access speech online.”

Greg Gonzalez, legislative counsel for the nonpartisan group Foundation for Individual Rights and Expression, called the bill “unconstitutional.”

“We urge the states currently considering bills similar to HB 3 to respect the First Amendment rights of their citizens and avoid wasting resources defending an unconstitutional law in court,” Gonzalez said in a statement to The Washington Post. “Protecting children is a laudable goal, but enacting futile and unconstitutional legislation does not protect anyone.”

Though the bill’s proponents on Monday predicted an imminent legal challenge, they said the new restrictions could survive judicial scrutiny.

“What’s unique in this bill is we didn’t focus on content,” said Renner, the state House speaker. “You will not find a line in this bill that addresses good speech or bad speech because that would violate the First Amendment.” Instead, he said, the restrictions are aimed at “the addictive technology.”

DeSantis, who this month vetoed an initial and more restrictive version of the bill , said its current iteration — which grants parents greater control over their children’s social media use — “is not engaging in any regulation of speech.”

“We worked hard with the legislature because, at the end of the day, we’re not just here spinning our wheels — we’re not just trying to get a photo,” he said. “We want something that actually sticks and actually has a positive impact, and there was a lot of work that was done to ensure that.”

Nevertheless, DeSantis added: “I think it’s going to be a challenge. We’ll see how that shakes out.”
