Lastly, the letter should be respectful and not undermine the defendant’s case. The following guidelines can assist in composing a persuasive character letter.

Tip 1 for a Character Letter: Establish Credibility

First, the author of the letter should tell the judge how they know the defendant. Use the first paragraph to build credibility and answer the following questions:

  • How long have you known the person?
  • How did you come to know the person – professionally, family, as a community member, etc?
  • If you know the person professionally, this is a good place to add your position or role that allowed you to get to know the defendant.

A character letter should come from from individuals who genuinely know the defendant. Generic character letters lack persuasive power. Writers should begin their letter by discussing the duration and nature of their relationship with the defendant. If the relationship is professional, the opening paragraph can clarify this connection. Your letter will carry more weight if you detail the basis of your impression of the defendant, such as working together for several years or knowing each other since childhood.

Tip 2 for a Character Letter: Avoid Landmines

The biggest mistake a letter writer can make is to either detract from the defendant’s acceptance of responsibility or the jury’s verdict. Avoid phrases like “this is not like him” or “he pleaded guilty to get a better sentence and not because he was guilty.” Instead, this paragraph should include something along the lines of:

  • I respect a jury has found _____ guilty of __________. I am writing to offer a more complete picture of who ________ is.
  • I know ___________ has pleaded guilty to ___________. I am writing to offer a glimpse of who _____ is, and that is someone who is far more than the offense he/she pled guilty to.

You can even add something along the lines of, “I know the Federal Sentencing Guidelines, although not mandatory, provide the court with recommendations, and I realize how significant the possible sentence could be. I hope that you will find ____’s life and work to warrant a low sentence.”

Importantly, there is no need to disregard the fact that the defendant has committed a crime. Since your letter will likely be used during a sentencing hearing, it should not attempt to assert the defendant’s innocence. If you are disappointed in the defendant, you can express that. It is crucial for the judge to know that the defendant has people in their life who will hold them accountable and be honest with them about their mistakes. You should not request a specific sentence from the judge without first consulting the defendant’s attorney.

It is often tempting for writers to argue the defendant’s innocence, claim that the situation is out of character, state that the defendant only pleaded guilty for a better sentence, or even suggest that the jury made a mistake. Such statements will not benefit the defendant and might even harm their case.

Tip 3 for a Character Letter: Tell a Story

You have established how you know the defendant and you’ve expressed respect for the court and the sentencing process. Now comes the most important part: What are you going to tell the judge that will stand out in his or her mind? How do you convey that the defendant is much more than a “defendant?”

The best way to do this is to tell a story about the defendant. Give specific examples. For example, instead of saying the defendant is generous and kind-hearted, give the judge an example of an instance when the defendant showed these attributes. Instead of saying the defendant is the sole provider for this family, give detailed examples of how the defendant legitimately provided for his family in the past.

Consider what distinguishes your friend, family member, or coworker from simply being a “defendant,” and how to communicate that to the court. This approach can potentially affect the judge’s decision and contribute to a more favorable outcome.

When writing, avoid merely describing the defendant with phrases like “he is loyal.” Instead, narrate a story demonstrating his loyalty or his upstanding role in the community. A story will resonate with the judge more than adjectives, making your letter more impactful.

Tip 4 for a Character Letter for a Judge: Paint the Full Picture

Always keep in mind the picture you are painting for the judge and use the character letters strategically to paint that picture completely. For example, consider using one family member, one professional connection, and one from a church or civic organization as a bare minimum.

After establishing your relationship with the defendant, provide your candid opinion about their character. You may discuss the defendant’s upbringing, challenges faced, work history, family role, relationships with family members, health issues, substance abuse, available support structures upon release, or future plans. You may also mention the defendant’s remorse and whether you believe they will re-offend.

Tip 5 for a Character Letter: Always Include Verifiable Information

Remember the judge will have judicial clerks who will have time to verify any letters the judge wishes to have verified. Always include an address block with your letter, in the following format:

Phone Number

Email Address

Providing the court with your contact information will make the letter easily verifiable, should the court wish to do so.

Tip 6 for a Character Letter: Check with the Attorney

Every court is going to have different filing requirements. All the letters should be sent to the defense attorney and not the court directly. Most courts will accept letters on 8.5 x 11 standard letter-sized paper. Most courts will accept copies of electronically delivered letters, but be sure to check with the attorney first. Remember that judges read hundreds of letters. The easier you make it for the judge to read, the most likely the judge will be able to focus on the message you are trying to convey. For most people, a typed letter is more legible than a handwritten one. You can always add a personal touch by delivering a letter with an ink signature on the letter – but remember some judges will only see the scanned electronic copy of the letter. Letters from young children are an exception – where the handwriting may actually make the letter more powerful – the judge will know the letter came directly from the child.

Tip 7 for a Character Letter: How to Address the Judge

You can address the judge to “The Honorable First Name Last Name” or “Judge First Name Last Name” or “Judge Last Name.” It is redundant to say “Honorable Judge” so use either “Judge” or “Honorable.”

Tip 8: Don’t Worry about the Reference Line or Court’s Address

While you can include identifiers like the Court’s address, the reference line, the case number etc, the reality is that all the letters should be delivered to the defense attorney. The attorney, in turn, will make sure the letter gets to the court and is filed into the correct case.

Tip 9 for a Character Letter for the Judge: Know Your Ask

Most federal defendants are not going to be eligible for probation. Check with the defense attorney before making statements like “nothing good can be accomplished by sending ______ to prison.” Instead, end your letter with the same credibility you built at the beginning of the letter by making a reasonable request – whether that is asking for a minimum sentence or even a sentence under the recommended guideline range.

Vietnamese real estate tycoon sentenced to death in country's largest fraud case

Vietnamese real estate tycoon Truong My Lan has been sentenced to death over the country's largest-ever financial fraud case.

The 67-year-old chair of real estate company Van Thinh Phat was charged with embezzling $US12.5 billion ($19.1 billion)  — nearly 3 per cent of the country's 2022 GDP. 

Prosecutors said on Thursday the total damages caused by the scam amounted to $US27 billion ($41 billion).

The court ordered Lan to pay almost the entire damages sum in compensation.

Her trial, which began on March 5 and ended earlier than planned, was one dramatic result of a campaign against corruption that the leader of the ruling Communist Party, Nguyen Phu Trong, has pledged for years to stamp out.

Lan was found guilty of embezzlement, bribery and violations of banking rules at the end of a trial in the business hub of Ho Chi Minh City, state media said.

She had pleaded not guilty to the embezzlement and bribery charges, Nguyen Huy Thiep, one of Lan's lawyers, told Reuters.

"Of course, she will appeal the verdict," he added noting she was sentenced to death for the embezzlement charge and to 20 years each for the other two charges of bribery and violations of banking regulations.

The court in Ho Chi Minh City said its harsh sentence was due to the seriousness of the case and there was no possibility of the money being recovered. 

Here is a look at the key details of the case.

Who is Truong My Lan?

Lan was born in 1956 and became a cosmetics trader at the central market in Ho Chi Minh City, helping her mother, she told judges during the trial.

She and her family established the Van Thinh Phat company in 1992, when Vietnam shed its state-run economy in favour of a more market-oriented one that was open to foreigners. 

Over the years, Van Thinh Phat became one of Vietnam’s richest real estate firms.

Today the company is linked to some of Ho Chi Minh's most valuable downtown properties, including the glittering 39-story Times Square Saigon, the five-star Windsor Plaza Hotel, the 37-story Capital Place office building and the five-star Sherwood Residence hotel, where Lan lived until her arrest.

Billions lost from corruption

Lan was involved in the 2011 merger of the beleaguered Saigon Joint Commercial Bank, or SCB, with two others in a plan coordinated by Vietnam's central bank.

She is accused of using the bank as her cash cow, illegally controlling it between 2012 to 2022, and using thousands of "ghost companies" in Vietnam and abroad to give loans to herself and her allies, according to government documents.

The loans resulted in losses of $41 billion, state media VN Express reported on Thursday.

She was accused of paying bribes to government officials — including a former central official who has been sentenced to life in prison for taking $7.6 million in bribes — and violating banking regulations, government documents said.

The court sentenced her to death, saying her actions "not only violate the property management rights of individuals but also pushed SCB into a state of special control, eroding people's trust in the leadership of the (Communist) party and state".

Why is the case significant?

Lan's arrest in October 2022 is among the highest profile in an ongoing anti-corruption drive in Vietnam that has ramped up since 2022.

Weeks after her trial started in early March, former president Vo Van Thuong resigned after being implicated in the graft crackdown "Blazing Furnace" campaign that has been the hallmark of Communist Party general secretary Nguyen Phu Trong, the country's most powerful politician.

Eighty-four others were tried alongside Lan and received sentences ranging from probation for three years to life imprisonment, according to state media. 

Vietnam researcher Nguyen Khac Giang, a visiting fellow at Singapore's Iseas-Yusof Ishak Institute, said the sentencing marked a turning point in Vietnam's decade-long anti-corruption campaign.

"Previously, the government only focused on investigations against state-owned sectors of the bureaucracy," he said.

"So I think this has sent shock waves through not only the business communities in Vietnam, but also to the society as well, given the many unprecedented things that led to the case."

What's been the impact of the case on Vietnam's business community?

While Lan's arrest and the scale of the scam shocked the nation, the case also raised questions about whether other banks or businesses had similarly erred, dampening Vietnam's economic outlook and making foreign investors jittery.

This is happening as Vietnam tries to argue its case for being the ideal home for businesses trying to move away from neighbouring China.

"When you crack down on private businesses, it actually makes people feel a bit worried about … whether doing business in Vietnam remains safe," Dr Giang said.

"Because Vietnam is not new to corruption, and it's actually seen as the only way for you to get things done is to give money to somebody in the system to speed things up. This is normal practice in Vietnam."

He said the government needed to reassure the business community that if they operated in the right way they could still thrive in Vietnam.

"They also must accompany the anti-corruption investigations — like the case we are seeing here — with more robust administrative reforms and with more assistance to businesses so that they can be assured that doing business in one-party countries or regimes like Vietnam is still possible," he said.

Calls for death sentence to be commuted

Phil Robertson, the deputy director of Human Rights Watch's Asia division, said Vietnam did not usually publicise death sentences but was likely the largest user of the death penalty in Asia after China, with hundreds executed every year.

"What is shocking in this case is this person is one of the most high-profile real estate business persons in the country," Mr Robertson said.

"She was hobnobbing with the elites. She was someone who was a daily fixture in the news.

"This is a person who owns some of the most important, luxurious developments in Vietnam. And now she's facing the death penalty.

"What it shows is that Vietnam, unfortunately, applies this ultimate sanction not just for violent crimes, but for crimes across the board."

Mr Robertson said despite Vietnam's pledges, there had been no reforms or backing away from the death penalty and the international community needed to do more. 

"This woman has been now found guilty of massive fraud," he said. "But the bottom line is that even if she goes to prison for the rest of her life, she shouldn't face the death penalty.

"That's cruel and unusual punishment that is outrageous and unacceptable, and Vietnam should commute that sentence to life in prison, or whatever the prosecutors deem appropriate, but certainly not sentenced to death."

Chiara Sangiorgio, Amnesty International's death penalty advisor, said Vietnam's use of the death penalty for corruption violated international law and standards because the offence did not meet the threshold of "most serious crimes", meaning intentional killing.

Ms Sangiorgio said Amnesty had recorded several death sentences imposed for economic offences in Vietnam in recent years.

"We often see calls to punish corruption with the death penalty come in high-profile cases as a way of the Vietnamese authorities sending a message to appease public outrage and rebuild trust in state institutions, but the death penalty is never the solution," she said.

"It is high time that the authorities of Viet Nam abolished this cruel punishment and focused on bringing about long-term measures to tackle the root causes of crime."

This as-told-to essay is based on a conversation with Rob Hamill , a 60-year-old former rowing Olympian from New Zealand, about how the murder of his brother by the Khmer Rouge inspired his family's decision to live at sea.

The Khmer Rouge was a Communist political regime ruled by dictator Pol Pot in Cambodia between 1975 and 1979. They were responsible for the deaths of nearly 2 million people .

The essay has been edited for length and clarity.

I grew up in a local small town with a population of 15,000 in a beachside community in New Zealand on the east coast of the North Island called Whakatane.

It was a pretty normal Kiwi upbringing.

I was the last of five children. I was closest to my sister, who was four years older than me. My eldest brother, Kerry, was 12 years older than me. He was probably the one I knew the least. But we were very close, especially as I grew older.

My father loved sailing. He was in the merchant Navy during World War II. He had a real love of the sea.

That heavily influenced Kerry. He ended up going to Australia in his early 20s, looking for sailing opportunities. He went up to Darwin and bought a boat called Foxy Lady.

Kerry wrote really lovely letters. You became part of his story as he told it to us, and we lived vicariously through his adventures.

I was 14 in August 1978 when the letters stopped.

My brother was killed by the Khmer Rouge

The last letter he sent us was from Malaysia's east coast. He and his crew got blown off into Cambodian waters and took shelter on King Island, about 50 kilometers offshore.

Around August 20, his boat was attacked by a gunboat. Kerry was captured by the Khmer Rouge.

Kerry and his friend Stuart Glass, a Canadian, were on deck at the time of the attack. Stuart was shot. They both went overboard, and Stuart died in Kerry's arms. He buried him at sea.

Kerry and John Dewhirst, another survivor on the boat, were taken hostage. A few days later, they were taken to Phnom Penh to the Tuol Sleng prison and tortured for months. We're pretty sure Kerry was executed there exactly two months later, in October 1978.

It was 16 months between his last letter and hearing what happened.

My parents were beside themselves. They wrote letters to different ports all over Asia, trying to find the news.

I heard the news around January 1980. Timelines are vague, but I vividly remember that a neighbor rang us one day saying, "You need to get the paper."

My second-eldest brother John and I drove down to the local shop. There was this pile of papers with the headline: Hamill captured by the Khmer Rouge.

Hearing about my brother's demise — reading about it in the paper — was a real shock. That was the first time I grieved.

John took Kerry's death very hard. They were about a year apart. They did everything together as kids. He came home, and there was considerable unrest as we all struggled.

He messed with some drugs along the way that had an effect on him. He got very depressed. So we had a memorial for Kerry, and then a few months later, John took his life.

I feel almost certainly that if Kerry were here, John would be here today as well.

Two funerals in quick succession shaped our family

I became a bit of a loose cannon, a reasonably big drinker during my school years.

But sport was my savior.

After leaving school, I did this electrical apprenticeship but had no passion for electricity. I was so unhappy, so I took up rugby. Every Kiwi bloke has a go at rugby at some point in their lives.

I did that for a couple of years, and then when I was 19, one of my mates said, "I'm going to try out this rowing thing tomorrow morning at the local club. We're going to just have a go. Do you want to come down?"

I remember going to the first race we had. We won by the thinnest of margins. I was absolutely euphoric.

With racing, you can just hammer yourself so hard, push yourself to the near feeling of death, and then the next minute, you're OK.

I trained harder again, and pretty soon, I was going, "Well, I want to go to the top of this thing."

I rowed in the World Championships for many years, and then the Olympics in 1996. In 1997, I won the first Atlantic rowing race.

It was a huge adventure, a big leap into the unknown. There had been several people who'd attempted to row oceans prior to this, but more people had walked Everest than rowed an ocean at that point.

We started in Tenerife, and six weeks later — 41 days later — Phil and I rowed into Barbados and won the race.

I discovered I wasn't at peace with the deaths in my family when I did the Atlantic race. When I was at sea, I grieved.

Every day, at some point, I wept like a baby — when I was on the oars, but usually in the cabin where you could take shelter.

It made me realize my grieving process was very stunted, and I knew there was something I was going to have to do about it.

In 2009, I got the opportunity to testify against Comrade Duch , a representative of the Khmer Rouge and Pol Pot, the first person to be brought to any sort of justice for the loss of millions of lives.

This guy was arrested and revealed to be the commandant at the prison where my brother was incarcerated. He ruled with a very heavy hand in a very brutal and clinical way.

My mom had died earlier, and my dad had dementia, so I told the story from my perspective, where I saw the trauma and how it affected each of them.

I did the best I could for the memory of my brother, my parents, and the people of Cambodia.

I just hope I left a little legacy there for them.

When I started my own family, I decided to prioritize experiences together

I met my wife Rachel in 1991. During that time, Rachel and her sister competed as triathletes for Ireland.

We knew each other for about 10 years before we got together. We became friends over time, and then it happened when we were both single and she was visiting New Zealand.

She came out to help her sister, who had had twins. She ended up spending three or four months and went home, engaged to me. We got married about six months later, in 2001.

The boys came along very quickly after that. Finn in 2002, Declan in 2004, and Ivan in 2007.

My parents sent Kerry and John off to boarding school when they were 15 and 16.

My memories of Kerry and John would have been much stronger if we had time to grow up together as a close-knit family.

Rachel and I wanted to be with our kids, have experiences, and grow together. So then the question became, "How do we do that?"

Travel is a great way to do that. After the Atlantic race, I had a bit of a career in speaking. Through that, I managed to raise enough money to buy our boat, the Javelot, in 2014.

The following year, we did a seven-month South Pacific tour and took the boys out of school. In 2018, we went full-time.

The homeschooling pretty quickly took a bit of a backseat. Ivan, our youngest, now 16, has never been to school. The other two did do schooling until we started going away for longer periods of time.

We do learning by doing. We talk a lot about world politics, we talk about local community politics. We go offshore and try to interact with the locals as much as possible.

In 2022, we spent two or three months in Darwin, where Kerry had lived for quite some time.

Through his letters, we knew where he had been, generally speaking, and we followed his path. It was amazing.

We went to Cambodia for Christmas 2022. It was emotional and fantastic, especially for the kids who had listened to this whole story told through their father, mother, uncles, and aunts.

We chose a life of adventure

If you're going to do adventurous things, things are going to happen.

( Editor's Note: In September 2023, Hamill's son Finn experienced a deep water blackout while freediving near the family's catamaran in Thailand. He survived.)

Finn didn't have a clue what happened. He thought he had made it to the surface, and we were going, "No, mate, you were out. You were gone."

About half an hour later, the secondary drowning started kicking in with his breathing.

We called for help, and it took about three or four hours for the boat to come out from the mainland to take him in. He didn't need any intervention at the end other than a saline drip.

It was exceedingly scary. But in the moment, there was almost a serenity about it. Watching how the boys handled it and the way everyone did their job, I could not have hoped for a better response, that show of character under pressure.

What Rachel and I are doing is very much an experiment. We've got no Ph.D to say, "Oh yes, this is the way to raise children." It's real gut instinct stuff — but I believe it's working.

We've got kids who are worldly, beautiful, humble, thoughtful, kind, funny, and adventurous.

I feel privileged and lucky to have this life with Rachel and the boys.

I sometimes dwell on what might have been — that my parents, Kerry, and John could have been sharing this with us. I know they would have absolutely loved it.

All you can do is live the life they might have otherwise had. A life of adventure.
