This letter collects all of the information necessary to create a notification of name change that can be sent out to both business and personal contacts. 1. Get a Copy of Your Marriage Certificate

Changing your name after marriage first requires a certified physical copy of your marriage certificate. Not to be confused with your marriage license , which is the legal document obtained prior to your ceremony, your marriage certificate is a different document that verifies when and where you were legally married.

You should’ve received your official certificate when your marriage license was issued. For name-changing purposes, however, you should use a certified copy so you can hold onto the original.

A certified copy has a raised seal and can’t be created yourself. Instead, simply call the clerk’s office where your license was filed to request a copy (or two for good measure). Once you pay a small fee ($5-$20), your certified copy will be processed and mailed to you in a few business days.

2. Apply for a New Social Security Card

Before you can change your name anywhere else, you’ll need to apply for a new Social Security card. Head to the Social Security Administration (SSA) website and fill out the application for a new Social Security card . Your Social Security number won’t change, but your legal name will.

Since you can’t submit your application online, you’ll need to mail your completed form to your local Social Security office or apply in person to receive your new card within 10 business days.

Here are the materials you’ll need to apply for a new Social Security card:

  • Valid photo ID (driver’s license, state ID card, military ID, etc.)

  • Applicable fee (make checks payable to “U.S. Department of State”)

5. Update Your Car Title and Registration

In some states, you may be able to update your car title and registration at the time you update your driver’s license, but most states require you to visit separate departments. In order to get a legal name change after marriage, you'll need to start by contacting a few government agencies. The name change process varies by state , but generally speaking, you'll start with these four pieces of ID.

1. Get Your Marriage License

Before you can change your name, you'll need a certified copy of your marriage license (a.k.a. marriage certificate ) with the raised seal. Call the clerk's office where your license was filed to get a few copies if one wasn't automatically sent to you.

2. Change Your Social Security Card

Visit the Social Security Administration website and fill out the application for a new Social Security card . You'll keep the same social security number—just your name will be different. You should get your new card within 10 business days.

The process of legally changing your name depends on your state's laws and the reason you are changing your name.

Common reasons to legally change your name include marriage or divorce, gender identity change, and personal preference. But no matter your reason, you'll have to make a legal name change request.

Once you do change your name, there is a long list of people, entities, and other institutions to contact with the new information to make sure the change is complete.

In this article we'll explain the processes for legally changing your name to a new name and the steps for getting a name change order.

Deciding to legally change your name is a big step and one that should not be made lightly. In most situations, you must have a very good reason to change your name, and a judge must approve your request and issue a name change order unless the name change is related to marital status.

You may change your first name, middle name, and/or last name to a new name or names. Note that you can change your title (for example, Mr., Ms., or Mrs.) at any time you want since it is not a legal designation.

If you decide you want to legally change your name (first name, middle name, or last name) for a reason not related to marriage or divorce (such as gender change or gender identity, because your name is hard to spell or pronounce, or because you just do not like it), you must go through a court process, make a name change request, and receive a court order to be allowed to change your name. The simple process is easy to do, is the same process whatever your reason, and is governed by state law.

How to file for a name change

In most states, your local court clerk at your county courthouse can provide you with the legal forms, legal documents, name change request form, or name change document with the basic steps you need to request a name change. You must file the original completed documents with the court.

You may have to show your current driver's license as legal proof of identity when you submit your paperwork. You will likely need to submit a petition for a name change along with other documents required in your court. There will be a local document fee which varies by state. The fee varies by state but is usually under $300. In Texas, for example, the filing fee for the petition with the court is between $150 and $300, depending on where you live.

The court may require you to undergo a background check by the FBI and have your fingerprints taken in addition to the completed form you must file. You will pay a fee for this as well.

Your state might also require you to publish a public notice of your name change in a local newspaper so that anyone who objects can be heard. The court clerk or county clerk's office will give you step-by-step instructions. You will have to provide proof of publication and pay the publication cost.

In most states, you will likely have to attend a brief court hearing at a court date where the judge may ask a few questions about why you are changing your name. The entire process from filing to completion may take a few weeks to a few months, depending on how busy the courts are.

You cannot change your name to impersonate someone else (such as a famous person), hide your identity, escape prosecution for a crime or a debt, or defraud anyone. You cannot change your name to something obscene or offensive, like a racial slur. In most states, your name must use letters, not numbers. Your new name must meet your state's requirements for a legal name.

Once you work through the court process for legally changing your name, submit your completed form, and have your court appearance, there are still more steps you need to take to ensure that your new name is fully in use.

1. Obtain the court order and new birth certificate

Once your court procedure is completed, the court will issue a court order legally changing your name to the new name. You may need to obtain a certified copy of the order. Your state will then issue a new birth certificate. This document is key because you will need to present it to change other documents and records. You may need a certified copy of it for some institutions.

2. Change government and financial records

Once you have your new birth certificate, get a copy with a raised seal (getting this upfront will save hours because you will have to request it later) and present that to the DMV and the Social Security Administration to get your new driver's license or photo ID, and Social Security card. They will each have specific forms you will need to complete and may have other documents you must bring with you for the change. The DMV may have a fee for the change.

Once you have the new driver's license and Social Security card, you can use those to change other documents and obtain altered items such as your new passport (make sure the passport matches your name on other documents), insurance card, car registration, credit cards, bank accounts, credit union accounts, investment accounts, government offices, voter registration information, bank statements, Global Entry, investments, financial records, other financial accounts, deeds, titles, and other documents.

If you aren't sure how to change your name on something, check with the issuing agency. Changing your name everywhere can be time-consuming, but it is important to be thorough.

It is also important to note that simply changing your name does not change your intestacy rights to inheritance.

If you want to know how to change your name after marriage, the first thing to know about a name change after marriage is that it is your choice whether to change it or not. You do not need a court order or a change document to change your name after you get married.

If you are wondering how to legally change your last name after marriage, you can take your spouse's last name or hyphenate your last name and your spouse's last name. In a name change after marriage, you cannot change your first name, but you can also change your current middle name if you change it to your premarital last name.

Sometimes when changing their name after marriage, a couple may decide they both want to change their names to an entirely new last name or combination of their previous names. In that instance, each spouse will need to file a formal name change petition with a local court.

It is important to understand that if your marriage ends, your name remains the same unless you take steps to change it.

Social Security card

After your marriage, you take your marriage certificate along with the required Social Security form and other documents requested to the local Social Security Administration office, and you will be issued a new Social Security card in your married name.

Driver's license

To change your last name on your driver's license after marriage, you take your marriage certificate to the Department of Motor Vehicles, complete the required paperwork, pay a fee, and provide any further documentation.

Other steps in marriage name change process

Once you have your new driver's license and Social Security card, you can go on to legally change your name with other government agencies. Note that your name is not changed when you do a name change after getting married unless you actively ask for it to be changed on all documents.

When can you change your name with a divorce?

If you changed your name to your spouse's name when you married and had a new married name, you might want to change your name back to your maiden name (also called a premarital name) if you get divorced. You are not required to do so, however. If you have a child, you might want to keep your married name so it will match your child's name. Your former spouse does not have to give permission or agree if you want to do a name change after divorce.

Steps for changing your name after divorce

To change your name after divorce back to your former name, you must decide that you want to change your name back (or that you want to have the option to change it back) during the divorce proceedings or divorce case. During the divorce process, you must make a request to the court to be able to change your name. Your name will not automatically revert to your maiden name or premarital name. Divorce decree and name change process

If you ask the court for the right to change your name to your premarital name, the judge will include a clause in your divorce decree giving you the legal ability to change your name to your premarital name. You do not need to go through any other court process or file for a legal name change. Your name after divorce can be legally changed to your premarital name without any other court order.

How to legally change your name in the divorce process

Once the divorce is concluded and your state's court has issued the  divorce judgment or divorce decree , you will then use that document to legally change your name elsewhere as part of your name change process.

Birth certificate after divorce

If you changed your name when you married, your birth certificate was not altered. Therefore, when you get divorced, you do not need to make any changes to your birth certificate.

Social Security Administration legal name change

After you have your divorce decree, take it to a Social Security office and have your Social Security card changed back to your premarital name as part of your name change process. You will get a new Social Security card.

Other steps

After you have completed the legal steps for changing your name after a marriage or divorce, make sure you change your name on documents and accounts, including with your insurance companies, utilities, Global Entry, financial institutions, investment accounts, doctor's offices, driver's license, your current passport, credit cards, brokerage account, banks, investments, loyalty programs, your employer, and payroll information.

Banks require that you provide legal identification when you change your name on accounts, so bring the document that authorizes the change as well as your new driver's license.

You may also want to change your name on your social media accounts, but you don't have to wait for the name change to be official to do that.

You don't need to notify the United State Postal Service of the name change since all mail addressed to your address will be delivered. But if you move soon after a name change and have an address change, be sure to forward mail in both names.

If you have airline tickets, be sure the name on the boarding pass matches the ID you present. It may be wise to hold off on booking tickets until you complete your name change.

Changing a child's name

If you want to change your child's birth name, you must file a petition for a name change in court, and both parents must agree, or a court must order the child's name change when a judge signs an order if a parent makes an ex parte application. Sometimes after a divorce, a parent wants the child's name to change to a stepparent's last name because of the child's relationship with the stepparent. This is only possible if the other parent agrees.

If a child is adopted, their legal name is legally changed on their new birth certificate.

Your name is a very personal choice, and you have the right to change it to fit your marital status, personal preferences, and other life changes. Generally, while you can request a name change for any reason, some types of name changes will be trickier than others.

There are many reasons why someone might consider changing their name, including marriage, adoption or the desire to reflect a different gender identity.

“The most common situations that prompt people to want to change their names are marriage and divorce or related family situations, such as stepparent adoption,” says Elizabeth Katz, visiting professor at Harvard Law School. “In more recent years, there's also been an increase in people wanting to change their first names to better fit their gender identity.”

Nonetheless, you do not need a formal reason to change your name. Disliking your name or preferring a nickname, for example, is enough to kickstart the name change process in a court of law.

The Name-Change Process

Name change requests are generally processed in a state court where the requester lives. Each state will have a slightly different system depending on the situation and jurisdiction. Most states will offer a how-to guide on their unique process, which will provide a step-by-step list of tasks. This California guide is an example .

Generally, while you can request a name change for any reason, some types of name changes will be trickier than others. On one end of the spectrum, changing your name after marriage, divorce or adoption is a relatively simple process.

To change your surname after marriage, all that is required to is to show a marriage certificate to the Social Security Administration. This will allow you to obtain a new Social Security card that you can use to change your driver’s license, passport and tax returns, among other important documents.

Similarly, for divorce, a certificate of dissolution or a divorce judgment, depending on the state, may allow a requester to restore their premarital surname with the Social Security Administration.

Finally, for an adoption, a child’s name change is automatically completed as a product of the adoption process: Once a child is officially adopted, their new birth certificate will be issued with the adopter’s surname.

Handling More Complicated Name Changes

Changing your name for reasons other than marriage, divorce or adoption will typically involve a more complicated legal process.

“A common process is to file paperwork with a family court or probate court, including an explanation of the reason for the requested change,” Katz says. This generally requires filling out a name change form, filing the form with the court, paying a fee (usually less than $500) and providing associated documentation with the court.

In many states, people can fill out and file name change forms electronically through a state court website. Otherwise, you can typically take these forms to a family or probate court clerk, who can file the form and pay the associated fee in person.

Additionally, the state will need supporting documentation to confirm that a change is not occurring to commit identity theft or fraud. The type of documentation requested by the state court is dependent on the reason for requesting the name change – more straightforward reasons for name changes may require fewer forms of documentation – and the state protocol where the requester lives.

Commonly requested forms of documentation are proof of identification such as driver's licenses or passports, proof of residency with a name and address such as a utility bill, or a birth certificate.

Some states might also require a few extra steps before approving a name change. The court may request additional information from a person on the reason why they wish to change their name. Depending on the state, a person requesting a name change might also be required to publish notice of the name change request in the local newspaper or appear in person for a brief hearing.

Approval or Rejection of a Name Change

After all of these steps, a court clerk will decide whether they will grant or deny a legal name change. If the clerk decides to grant the legal name change, the clerk must issue a formal court order that will officially change the person’s name. This document will entitle the requestor to make that change on legal documents such as a passport or driver’s license.

If the clerk decides to deny the legal name change, they must issue a notice of denial explaining the reason for the decision as well as instructions for appeal. This decision could take anywhere from a few weeks to a few months, depending on the state, the complexity of the request or the current workload of the court.

“Courts may reject name change requests when it seems the person has a fraudulent or other wrongful purpose,” Katz says. For example, changing your name to impersonate someone, to conceal your identity to escape prosecution, or to assume a name that is derogatory or obscene – like a curse word – is not allowed. Additionally, a person’s request might be rejected if the name includes numbers or symbols.

After the Name Change Process Is Complete

Once a person receives a name change order from the court, they must notify relevant state and federal agencies about the name change. This includes the IRS, Department of Motor Vehicles and Social Security Administration.

A person’s name on important legal records – like wills, deeds and trusts – should also be changed. While heirs cannot lose their right to property because of confusion over an old name, keeping records updated will make the estate planning process easier in the future.

Change Your Name

The process to change your name on your passport varies depending on your situation. Expand the boxes below to find the process that applies to you.

Less than one year after BOTH my passport was issued and my name was legally changed

Submit the following by mail:

  • Form DS-5504  (find mailing instructions on the form)
  • Your most recent U.S. passport
  • An original or certified document which shows that you changed your name less than one year after we issued your most recent U.S. passport. Examples include a marriage certificate, divorce decree, or court order.
  • One  passport photo

You will not have to submit any passport fees unless you want expedited service which costs an extra $60. 

More than one year after either my passport was issued or my name was legally changed

You may be eligible to renew your passport by mail using Form DS-82 or apply in person using Form DS-11.

Can I renew by mail?

You can renew by mail using  Form DS-82  if your most recent passport:

  • Is submitted with your application
  • Is undamaged (other than normal wear and tear )
  • Was issued when you were age 16 or older
  • Was issued within the last 15 years
  • Was issued in your current name (or you can show your name change)

If you are eligible to renew, submit the following by mail:

  • Your original or certified name change document, such as a marriage certificate, divorce decree, or court order
  • One color  passport photo
  • Fees , which are different depending on your age
  • Send Form DS-82 and supporting documents using USPS. UPS, FedEx, DHL, and other companies cannot deliver to the PO Box addresses listed on Form DS-82.

How do I apply in person if I cannot renew by mail?

If you are not eligible to renew your passport by mail using Form DS-82,  apply in person  and submit the following:

  • Your evidence of U.S. citizenship and photocopy of that evidence
  • Valid ID and photocopy of that ID
  • Fees , which are different depending on your age

Please note : If your name has changed because you are married  and  you show us an ID issued in your new name, you do not need to submit proof of your name change. You must include the details of the marriage on the second page of Form DS-11.

Already using a different name but cannot show the change

If you cannot show the change with a court order, divorce decree, or marriage certificate, apply in person and submit:

  • Your evidence of U.S. citizenship
  • Valid ID issued in the name you are currently using and photocopy of that ID

What should I do if my name is different than what is on my citizenship evidence, or I cannot show my new name through marriage or on a court order?

You may need to fill out  Form DS-60: Affidavit Regarding a Change of Name  if:

  • The name you are using is different than the name on your evidence of U.S. citizenship, or
  • Your new name is not shown on a court order or through marriage.

This form must be completed by two people who have known you by both names. You must also submit three certified or original public records that show you have used the new name for five years or more.

Correct a Data or Printing Error

You can correct your passport if there is a data or printing error. A data error may include an issue with your name, gender, or place of birth. A printing error may include data is missing on the biographical page, discoloration, or crooked printing. We will correct the error at no charge if the passport is still valid.

  • Evidence of the error (e.g. your U.S. birth certificate showing the correct spelling of your last name).
  • You will not have to submit any fees.
  • If you are reporting the error within one year of us issuing your incorrect passport, the new passport will be valid for 10 years.
  • If you are reporting the error after one year, the new passport will be valid until the expiration date of your original, incorrect passport.

My passport photo is really bad. Can I change it?

If your photo looks bad because of our printing error, you can use Form DS-5504 to reapply at no cost to you.

If your photo is printed correctly and you dislike your photo, you may use Form DS-82 (if eligible) to reapply. You must pay the normal fees.

Routine:  6-8 weeks*

Expedited: 2-3 weeks and an extra $60*

*Consider the total time it will take to get a passport when you are booking travel.  Processing times only include the time your application is at a passport agency or center.
